Dear Mr. Moye:
Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit
is issued pursuant to the requirements of North Carolina General Statute 143-215. 1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection
Agency dated May 9, 1994 (or as subsequently amended).
The facility shall conduct a flood plain analysis evaluating the 100-year flood plain. At a
minimum this report shall include an analysis of whether the treatment plant is within the
100-year flood plain and plans (with a time schedule) to address the problem. This report is
due 90 days after the effective date of the permit and should be submitted in triplicate.
(Refer to special condition A. (2.)).
No later than 180 days following the effective date of this permit, the permittee shall submit
a detailed analysis of all available means to dispose of this facility's wastewater, including
connection to the Kings Grant Rocky River Interceptor. This Engineering Alternatives
Analysis (EAA) shall be prepared in compliance with the Division's guidance document for
EAA's. (Refer to special condition A. (3 ))•
If any parts, measurement frequencies or sampling requirements contained in this permit
are unacceptable to you, you have the right to an adjudicatory hearing upon written request
within thirty (30) days following receipt of this letter. This request must be in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and
filed with the Office of Administrative Hearings (6714 Mall Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and
binding.

Please note that this permit is not transferable except after notice to the Division. The
Division may require modification or revocation and reissuance of the permit. This permit
does not affect the legal requirements to obtain other permits which may be required by the
Division of Water Quality or permits required by the Division of Land Resources, the Coastal
Area Management Act or any other Federal or Local governmental permit that may be
required.

A. (2.) FLOOD PLAIN ANALYSIS
The facility shall conduct a flood plain analysis evaluating the 100-year flood plain. At a
minimum this report shall include an analysis of whether the treatment plant is within the
100-year flood plain and plans (with a time schedule) to address the problem. This report

A. (3.) ENGINEERING ALTERNATIVES ANALYSIS
No later than 180 days following the effective date of this permit, the permittee shall submit
a detailed analysis of all available means to dispose of this facility's wastewater, including

If no EAA is submitted, the Division may reopen and modify this permit-to increase
monitoring frequencies or change effluent limits as necessary to protect the receiving
stream.

Dear Ms. Jackson:
I am in receipt of a copy of a Public Notice by the Environmental Management
Commission (Commission) that intends to renew the subject NPDES Permit (Permit). We are
aware that the Commission has a policy of eliminating discharges to the surface waters if at all
possible, and in this situation it will be very possible. For the record, we would like to object
to the renewal of this Permit because this discharge could be eliminated by connecting to the
existing Kings Grant Rocky River Interceptor. Therefore, we respectfully request that the
subject Permit not be renewed and that the Permit holder work with the City of Concord
(Concord) to make arrangements to connect this .discharge to the public system. Concord
would be the retail sewer provider for this system. Concord has expressed a willingness to
work in conjunction with the Permit holder so that this discharge could be eliminated.
As I am sure you are aware, the citizens of Cabarrus County object to the construction
of package plants because of the failure and historic poor operation of these facilities.
Therefore, we further request that any Permit for a non-governmental package plant have a
special condition that requires the plant be replaced by a connection to the public sewer system
when a line is within 1,000 feet.

PART IV - EVALUATION AND RECOMMENDATIONS
The permittee, Silver Maples Mobile Estates, is applying for
renewal of the permit to discharge treated domestic wastewater..
A review of monitoring reports from 1/l/95 to 1/1/99 revealed 9
monthly flow violations . Also, the facility has been flooded by
the Rocky river 8 times in the past 5 years . The facility is
also experiencing Inflow/Infiltration that needs to be addressed.
Giving the urbanization along the Rocky River, a flood study .
should be conducted in order to determine flooding frequency at
the WWTP and whether the facility should remain at that location.
It should be noted that a sewer line for the Water and Sewer
Authority of Cabarrus County is available within 150 feet of this
facility.
It is recommended that the permit be issued for a period of
two years, during which a study regarding the flooding problem be
conducted. The study should also present -alternatives if
flooding is found to be a chronic problem at the plant .
We would suggest that the Mobile Home Park connect to the
nearby area-wide sewer.

Mr. Jimmy Allison is our Operator IN Charge of this wastewater treatment facility.
When he has a need to remove sludge from the plant he calls L.W.I. 9300 Steele
Creek Road Charlotte NC at 704588-2392 and they dispatch a pump truck to
remove the sludge and they take it to the Cabarrus Regional Treatment Plant for
disposal. a copy of their last invoice it attached.
