AFFIDAVIT OF CREDIT SALE
TO: NORTH CAROLINA DIVISION OF WATER QUALITY
The undersigned, EBX Neuse I, LLC the Sponsor of the EBX Neuse Riparian Buffer Umbrella
Mitigation Bank (DWQ Number 08- 1473), hereby certifies the following: (Marston DWQ
Number 2008- 1473v1):
] . Stephen & Geraldine LaBreck has deposited monies with the Sponsor sufficient
to acquire 975.00 Buffer Credits (square feet) from the Bank for use on its 104
Whittaker Point Road project, in Oriental, NC, in HUC 03020204 of the Neuse
River Watershed.
2. The 104 Whittaker Point Road project requires a total of 975.00 Buffer Credits as
mitigation. Of this amount 975.00 Buffer Credits are being provided by the Bank.
3. The Sponsor has deducted 975.00 Buffer Credits from the Bank's credit ledger for
HUC 03020204 of the Neuse River Watershed.
A copy of the Bank's Credit ledger reflecting the above transaction is attached to this Affidavit.

Mitigation Plan
104 Whittaker Point Road
Oriental, NC 28571
Attached is a copy of the proposed conditions drawing for the project that we are seeking
mitigation for. Please consider this part of the mitigation plan for our proposed project.
We have calculated the square footage impacted by the creation of the new coastal Zones
1 and 2 as follows:
• Zone 1 - 150 square feet x 3 = 450 square feet
• Zone 2 - 350 square feet x 1.5 = 525 square feet
• Total square footage to be mitigated = 975 square feet
We would like to submit this mitigation plan to for your approval so we can purchase the
necessary credits through a private bank. We can then forward the document to EBX
mitigation bank that has credits available for this area
