This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as subsequently amended)., This final permit includes the following changes from the terms found in the draft permit sent to you on January 14, 2009: • Following a review of your request of January 25, 2009, instream monitoring for conductivity and fecal coliform have been removed from the permit. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh,North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit.. As you may know, this plant has been operating for many years and since 2004 under the new ownership and operation by Aqua North Carolina, the facility has maintained regular compliance with its permit. UK In response to the draft, Aqua requests that the upstream and downstream conductivity {�J measurements be deleted from the permit. Based on the following justification, Aqua wishes to request that the upstream and downstream fecal samples be removed and replaced with a single plant effluent fecal measurement for the following reasons: • Effluent sample results indicate negligible impact of the treatment plant on the receiving stream: o./, • The compliance record at this plant is good; and ` d1 • There is limited access to capture a downstream sample that represents adequate mixing. (Western Region-Denver) No sludge will be treated on any wastewater treatment plant site operated by Aqua North Carolina, Inc. Where practical, sludge removal from Aqua North Carolina West facilities will be transported via a contract hauler to another Aqua North Carolina West facility for the purpose of "seeding" a new or under-loaded plant when there is a need for such. Unusable (or "dead") sludge will be removed by a permitted/licensed contract hauler and properly disposed of in accordance with NCGS 143-215.1. Contract haulers Used by Aqua North Carolina West will be required to report, via a sludge-hauler manifest, the quantity of sludge transported and identify the location of the proposed disposal site if the sludge is not taken to an existing plant operated by Aqua North Carolina West. Aqua North Carolina West has not entered into any agreement to accept sludge into its facilities from plants not owned by them and have no intentions of doing so.
