Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994 (or as
subsequently amended).,
This final permit includes the following changes from the terms found in the draft permit sent to you on
January 14, 2009:
• Following a review of your request of January 25, 2009, instream monitoring for conductivity and
fecal coliform have been removed from the permit.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh,North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit.. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits
required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or
Local governmental permit that may be required.

We are in receipt of the draft permit January 14, 2009 for the referenced Wastewater
Treatment Plant (W WTP). As you may know, this plant has been operating for many
years and since 2004 under the new ownership and operation by Aqua North Carolina,
the facility has maintained regular compliance with its permit.

In response to the draft, Aqua requests that the upstream and downstream conductivity {�J
measurements be deleted from the permit. Based on the following justification, Aqua
wishes to request that the upstream and downstream fecal samples be removed and
replaced with a single plant effluent fecal measurement for the following reasons:
• Effluent sample results indicate negligible impact of the treatment plant on the
receiving stream: o./,
• The compliance record at this plant is good; and ` d1
• There is limited access to capture a downstream sample that represents adequate
mixing.

Aqua North Carolina, Inc. has applied for renewal of NPDES permit NCO028941 for
the Pine Valley Subdivision WWTP in Rowan County. This permitted facility dis-
charges treated wastewater to the Selman Branch in the Yadkin Pee-Dee River
Basin. Currently BOD,ammonia nitrogen,and total residual chlorine are water quali-
ty limited. This discharge may affect future allocations in this portion of the Yadkin
Pee-Dee River Basin.
The Town of Cleveland has applied for renewal of NPDES permit NC0049867 for the
Cleveland WWTP in Rowan County. This permitted facility discharges treated
wastewater to Third Creek in the Yadkin-Pee Dee River Basin. Currently ROD,am-
monia nitrogen, fecal coliforn and total residual chlorine are water quality limited.
This discharge may affect future allocations in this portion of the Yadkin-Pee Dee
River Basin.
RICH Tire and Retread Company(P.O. Box 187,Cleveland, NC 27013)has applied
for renewal of NPDES permit NCO075523 for its WWTP in Rowan County.This per-
mitted facility discharges contact cooling water and air compressor condensate to an
unnamed tributary to Beaverdam Creek in the Yadkin-Pee Dee River Basin. Cur-
rently oil and grease, total residual chlorine and total suspended solids are water
quality limited. This discharge may affect future allocations in this portion of the Yad-
kin-Pee Dee River Basin.

SLUDGE MANAGEMENT PLAN

No sludge will be treated on any wastewater treatment plant site operated by
Aqua North Carolina, Inc.
Where practical, sludge removal from Aqua North Carolina West facilities will be
transported via a contract hauler to another Aqua North Carolina West facility for
the purpose of "seeding" a new or under-loaded plant when there is a need for
such.
Unusable (or "dead") sludge will be removed by a permitted/licensed contract
hauler and properly disposed of in accordance with NCGS 143-215.1. Contract
haulers Used by Aqua North Carolina West will be required to report, via a
sludge-hauler manifest, the quantity of sludge transported and identify the
location of the proposed disposal site if the sludge is not taken to an existing
plant operated by Aqua North Carolina West. Aqua North Carolina West has not
entered into any agreement to accept sludge into its facilities from plants not
owned by them and have no intentions of doing so.
Aqua North Carolina West will keep records on the quantity of sludge removed
from each facility, the name of the contract hauler, and the destination of the
sludge (whether used in another plant or disposed of). The information will be
kept on file and will be made available to any regulatory agency having
jurisdiction over sludge treatment or disposal.
Aqua North Carolina West includes all of the facilities under the jurisdiction of the
Mooresville Regional Office.
