Dear Mr. O'Brien:
Division personnel have reviewed and approved your application for renewal of the subject
permit. Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued
pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of
Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 17,
2007 (or as subsequently amended.)
The permit authorizes Athena Cedar LLC to discharge domestic wastewater from the Cedar
Park Estates WWTP to Reedy Creek, a class C water in the Yadkin-Pee Dee River Basin. The final
permit includes discharge limitations/or monitoring for flow, BOD5, ammonia nitrogen, total
suspended solids (TSS), dissolved oxygen, total residual chlorine, and fecal coliform.
Regarding the receiving stream of the WWTP discharge, Reedy Creek is listed as an impaired
stream on North Carolina's 2008 303(d) list. This means that the stream does not meet all water
quality standards. The Division is working toward the improvement of water quality in Reedy Creek.
If the current changes to permits discharging to these streams do not result in improved water quality,
removal of discharges to Reedy Creek may be necessary for the health of the stream.
If noncompliance with your permit's effluent limits is shown to be a direct cause of stream
degradation, the Division will recommend removal of your facility's discharge. Part III of your permit
requires you to "continually evaluate all wastewater disposal alternatives and pursue the most
environmentally sound alternative of the reasonably cost effective alternatives" to surface water
discharge. Such an evaluation may help you find an alternative to surface water discharge that is
more appropriate for your facility.
The following procedure has been recently implemented by DWQ: Total residual chlorine (TRC)
compliance level chanaed to 50 ua/1 Effective March 1, 2008, the Division received EPA approval to
allow a 50ug/1 TRC compliance level. This change is due to analytical difficulties with TRC
measurements. Facilities Will still be required to report actual results on their monthly discharge
monitoring report (DMR) submittals, but for compliance purposes, all TRC values below 50 ug/1 will be
treated as zero. A footnote regarding this change has been added to the effluent limitations page in
the draft permit.

unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such
a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. The Division may require modification
revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Water Quality or permits required by the
Division of Land Resources, Coastal Area Management Act, or any other Federal or Local governmental
permits may be required.

Please find enclosed our renewal application for the NPDE.,S Permit NCO034711. Since
the last application there have been no changes at the facility, except for a change in
ownership of the underlying property. My conclusion is based on extensive due diligence
with previous owner. Athena Cedar, L,LC, an entity which 1 am the Managing Member,
purchased the property in June 2007. or approximately I 1 months ago.
I want to call to your attention that item 10. Flow Information is based on our ownership
period of 1 1 months, rather than the requested 36 months. The population served during
the last 11 months is consistent with that of the last 36 months, so 1 believe that the
information provided is reliable. Previous owner was a licensed operator and was within
permitted levels. We have requested now information for the previous 25 months but we
do not know if we will receive. Over the last 11 months, we have consistently used a
reputable licensed operator in assisting with the management of the waste water treatment
plant.
