Dunn, Northeast Coastal Region Coordinator Habitat Conservation Program DATE: December 19, 2012 SUBJECT: PCN — Nobel Canal Enhancement, Town of Winterville, Pitt County, North Carolina. DWQ No. 20120707V2 Biologists with the North Carolina Wildlife Resources Commission ( NCWRC) reviewed the application with regard to impacts of the project on fish and wildlife resources. The project site is located in Winterville, NC within Nobel Creek, a tributary to Swift Creek near Good Hope Baptist Church. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.) and the Clean Water Act of 1977 (as amended). The applicant proposes to the 602' of Nobel Creek to address an ongoing bank erosion concern. Impacts to jurisdictional resources include 602' of stream, 0.21 acre of wetlands, 36,120 ft2 of Zone 1 buffer, and 12,040 ft2 of Zone 2 buffer. Two 60" pipes will contain 502' of stream with the remaining 100' contained within a 72" pipe. Nobel Creek is classified C NSW by the Environmental Management Commission and is subject to the Neuse Basin Buffer Rules. In general the NCWRC does not support tiling of surface waters. We understand the Town's concern for ongoing erosion to residential and church buildings but also believe that tiling this portion of the system will only move the current problem further downstream. Tiling of this reach would remove what habitat resources are available to the urban system as well as remove the ability of the riparian area to treat any runoff prior to entering the system. If it is determined any portion of the project could be permitted once avoidance and minimization is demonstrated, appropriate mitigation should be applied.
