This permit is issued pursuant to the requirements of North Carolina General Statute 143- 215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007,or as subsequently amended. The Division understands that this facility has abandoned its oil/water separator at Outfall 003 and applauds your decision to re-rout truck loading-rack spillage/stormwater wastes to a tank, and transport these wastes offsite for licensed disposal. We have modified your permit accordingly(see attached change pages). You have requested the Division to relax monitoring frequencies for BTEX, Naphthalene, and Oil &Grease from I/Month to 1/Quarter. However, after reviewing Discharge Monitoring Report(DMRs) over the past six years (2004-2009), we note that this facility has recorded only nine (9)sample events for Outfall 003 and only three (3) events for Outfall 002. We understand that sampling frequency is storm-dependent,but these events average less than one or two samples per year. We therefore find insufficient justification to alter your monitoring frequencies at this time, and must deny your request. All storm water runoff from the truck loading rack area is routed to an aboveground storage tank for eventual haul off to a licensed recycling facility. TransMontaigne requests the NPDES permit be modified to reflect this change. Storm water and hydrostatic test water from the AST containment area continue to be discharged through Outfall 003. Additionally, TransMontaigne requests a reduction in monitoring for Benzene, Toluene, Ethylbenzene, Xylene, Napthalene, and Oil & Grease from monthly monitoring to quarterly monitoring.
