Dear Mr. Wakild: Thank you for your consideration in this letter to appeal the denied request by the Town Of Cary to reverse the steps off a deck at 104 Turk House Lane in Cary, NC within zone 2 of the riparian buffer zone. Alternatively, my opinion with regards to the best practical alternative is to complete the steps per the plan submitted to the Town of Cary. Below is a list of reasons in requesting this appeal. 1. The primary reason was to upgrade to a more structurally sound deck and stabilizing deck stairs that were in a severe state of disrepair while maintaining the same square footage. Implementing a design that offers a logical flow and includes a landing within the stairs to avoid continuous treads. 2. At this point in the construction process, it would require considerable effort to change the stair design to match the original configuration. This effort would include removing the deck approximately 8 feet above grade and removal of piers and footings. By deconstruction and reconstruction would add to the impact on the stream buffer. 3. The new deck design and layout removes a total of 100 square feet of impervious surfaces. Achieved by eliminating 80 square feet of hardscape and 20 square feet of impervious decking. 4. The new deck and stair design is located further away from the stream than the original stairs and will be less intrusive on the stream buffer by implementing a more efficient and logical flow of foot traffic. Upon a thorough review and careful consideration, this request is denied since it does not meet the no practical alternatives criteria in the Land Development Ordinance Section 7.2.14 (1)(1)(a) or 7.2.14(I)(1)(b) for impacts in Zone 2 of the riparian buffer. The basic purpose can be practically accomplished by replacing the steps in the original layout. Alternately, the layout can be reconfigured or redesigned to potentially remove the impact from the buffer completely by coming off of one of the two sides of the screened porch within the built upon area of the existing patio. Either of these options would achieve the purpose of accessing the backyard from the accessory structure while better minimizing disturbance, preserving aquatic life and habitat, and protecting water quality. Describe the existing conditions of the site and the general land use in the vicinity of the project at the time of tnis Current conditions of the site are the structural framing of a 11x7 deck adjacent to a smaller framed 6x4 deck and a framed 4x4 raised landing for the proposed stairs to make a 90- degree turn. The structural framing of these is over a gravel bed and established patio. All deck framing is structurally completed with joists, supports and posts only and no decking boards or railing have been installed. The 11x7 and 6x4 decks are framed together and properly attached to the rim joist while the 4x4 landing is framed and secured by 4-6x6 king posts set in concrete footings. The use of this area is to exit down from the deck or the main level and land on the established patio in the back of the home and yard. See Figure 1 and 4 L List the total estimated linear feet of all existing streams (intermittent and perennial) on the An estimated 60 linear feet of storm water stream is at the back of the property, an estimated 20 feet off the back property line. The stream enters from the northwest comer approximately 20 feet in from the back comer of the property line traveling north approximitly 60 feet to the back where it exits the property going due north. See Figure 5. 3. Explain the purpose of the proposed project: The purpose of this project was to removal of the original stairs bulit in 1999 that were in a severe state of disrepair, unsafe, 14 continuous treads that dropped straight down approximately 12 feet to a 4x5 impervious deck landing at ground level, the stairs also blocked the view from 2 windows in the basement. The steps ran parallel to the home and pointed away from the main structure onto a impervious landing turning you left 90- degree back in toward the home then onto hardscape and into the yard. The steps came off a substandard, unsafe 11x8 stand -alone deck on 4 posts not bolted to the rim joist. (See figure 2) The goal is building a stronger, safer set of stairs with a break part way down then having them flow in a more unified direction. To achieve this required they be constructed in the opposite direction landing onto an existing patio. By doing so maintains the same square footage, removes a 20 square foot impervious surface and opens up the basement windows. With this concept creates structurally sound steps that are much safer and tied into a structurally sound deck that is properly constructed while maintaining the same square footage of the original deck, landing and stairs and eliminating an impervious surface. Changing to this direction puts less of an impact on the terrain, compacts the steps in a user - friendly logical flow, and opens the view from the basement windows. This scenario creates the best management practice of this space. Turning the steps makes better use of the overall property, better minimize disturbance, preserve aquatic life, habitat and protects water quality. The area of the old steps and old impervious deck landing will then be converted to natural area in a more environmentally friendly way. (See figure 3 of the old stairs overlay the new) At this point a certified engineer has approved all structures built to date and a copy of the letter has been recorded. 4. Describe the overall project in detail, including the type of equipment to be used: This project is focused on the removal of the stairs off a deck built in 1999 that were in a severe state of disrepair, unsafe and unusable, the elimination of 14 straight continuous stringers/steps and the removal of an impervious deck landing. This allows for the building of new steps that are much safer and more secure. To achieve this requires building the new stairs in the opposite direction to flow in a more unified manner, giving way to an environmentally friendly landscape where the old steps and landing once were and allowing for better use of the space and surrounding area. The new stairs incorporate additional decking and landing for a 90- degree turn to eliminate the straight drop. The new steps would then terminate on an existing established patio. 2 The old deck resting on 4 king posts not secured to the house or rim joists (See figure 6) is what contributed to the unsafe and unusable substandard stairs. The old 14 stair treads each measured 48°x11° terminating on an impervious landing at the bottom that was 4'x5'. The old deck was 11x8 which is now framed out at 10'9 0x7', adjacent to this is a new section that is partially out of the zone 2 buffer and is framed out at 6'8 °x4' allowing the start of the stairs down to a new lower landing that is framed out at 4'3°x4'50 that allows for a 90 degree right turn. The remaining 9 treads will continue down and terminate on an existing patio, each tread measuring 45 °x11° with a total of 11 treads in all. With this new proposal the steps will be safe, secure and flow in a logical manner and better on the environment. This project does set the steps further out than the original deck. The new steps will be a total of 34 -112 °x96° further beyond the old original outside deck edge, the new lower landing is 36 041 ° further which creates an overall total of 36 square feet beyond the original deck. All decking and railing will be composite decking with slots and hidden fasteners. As shown in Figure 3, this reflects a more compact solution that is friendlier on the environment and gives a logical flow off the deck into the back yard and patio while eliminating an impervious surface. All work that remains will be completely done by hand with no heavy equipment involved. This design was put together with the efforts of an architect and myself maintaining the same total square footage as the old deck and stairs. In meeting the code variances today, reverting back to the original stairs would lead to soil extraction, heavy equipment, demolition, de- construction and erosion from footings, also the creation of an impervious surface for a ground level landing as well as moving even closer to zone 1 buffer line. With this design, I feel is the best management practice known in creating a strong, safe, secure structure and steps that can be used while making the best use of the terrain and minimizing the disturbance while protecting the water quality. The former steps were unusable, unstable and in disrepair due to poor workmanship built in substandard fashion. By building the new safer structure, the steps need to be reversed to land on an existing safe solid surface and in a more user- friendly direction. By doing this requires a portion of the treads to be built 34.5" x 96" further into zone 2. There is also a landing that gives a 90 degree right turn for the stairs that is also 36" x 51" into zone 2. This change maintains the same square footage as the old stairs and structure with a portion of new decking now partially out of zone 2. See figure 3 IV. Impact Justification and Mid adon: Avoidance and Minimization A. Specifically describe measures taken to avoid or minimize the proposed Impacts in designing the project. Avoidance and Minimization - design: In designing the change of direction to the stairs required they land on a stable structure, constructed properly, not block any windows and eliminate the unsafe straight drop. The old stairs and deck were built prior to the Urban Transitions Buffers being in place, the home now sits entirely in Zone 3 with the deck and the comer of the home in Zone 2 and 3. This gives no options to rebuilding steps outside the buffer. The architect proposed a solution that minimized the impact of the buffer and not encroach in other easements while maintaining the same square footage. The deck was reduced from 8 feet to 7 feet to accommodate this change in direction. This direction gives a break in the stairs for a safe 90 degree turn for the stairs to run parallel to the deck then land on a solid surface in a safe logical direction. This new design also eliminates a 20 square foot impervious surface and reduces the overall footprint of the entire stair design by 5 square feet compared to the old design. B. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. and Minimization- construction: The deconstruction and removal of the old stairs in Zone 2 was completed all by manual labor with no heavy equipment. All new work and new construction are to be completed the same with no heavy equipment involved. All landscaping will be done by hand in a more environmentally friendly way that will replace the area of the old stairs and impervious landing. All decking will be slotted composite material over gravel with appropriate drainage. All work will be done by hand with minimal impact within Zone 2 as the home itself sits in both Zone 2 and 3. Meeting todays code, reverting back to the original stairs would lead to soil extraction and possible erosion from digging footings with heavy equipment for a ground level landing, creating an impervious surface, hardscape and spreading the overall footprint wider into the buffer zone and closer to Zone 1. This would create an unsafe straight drop with14 treads and an impractical flow blocking a double window and a turn off the landing onto hardscape and straight into the house. C. Buffer Mitigation 1. This stream determination is valid until February 15, 2017. Town of Cary staff determined that the feature indicated on the most recent version of the Wake County Soil Survey mapping is subject to the Urban Transition Buffer (Town of Cary Land Development Ordinance (LDO) — Section 7.2.14) and would have a 50 -ft buffer. This buffer can be broken into two zones: Zone One begins at the top of bank and extends landward 30 ft while Zone Two begins at the outer edge of Zone One and extends landward 20 ft. Per Section 7.2.14 of the LDO, exemption can be established only if the use existed in the buffer as of July 27, 2000 and has continued to exist since that time. Uses designated as prohibited or not specifically designated in the Table of Uses as Exempt, Allowable, or Allowable with Mitigation may not proceed within the UTB unless a variance is granted. A minor variance request pertains to activities that will impact Zone Two of the buffer while a major variance applies to any activity that will impact Zone One or both Zones One and Two.
