Box 250 Oriental, North Carolina 28571 Subject: Issuance of NPDES Permit No. NCO003174 Fulcher's Point Pride Seafood, Inc. 101 South street, Oriental Pamlico County Dear Mr. Fulcher: The Division of Water Quality(the Division) hereby issues this permit for the subject facility. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994, or as subsequently amended. Please Note --New Permit Conditions. The Division understands that this facility was destroyed by fire during the previous permit cycle. Although the facility may have been partially rebuilt, Fulcher's Point Pride has not resumed operations or discharge, based on Discharge Monitoring Reports submitted by the Permittee (January 2001 through December 2005). Therefore, Production data are not available to establish permit limits and monitoring conditions for this renewal. Limits and monitoring conditions appearing in the permit are based on previous facility outfalls, previous production records, and previous waste-stream characteristics. Based on the above, the Division shall stipulate in the permit that, prior to resuming operations, the Permittee shall submit a written request to modify this permit, a minimums of 180 days prior to resuming discharge. This request shall include a site map with outfall locations, scale drawings of the facility, estimates of production, and associated waste-flow characteristics for each outfall whereby the Division may calculate new permit limits and monitoring conditions. Upon submittal of new production data, permit limits will be developed according to 40 CFR 408 and appropriate subparts for each outfall. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable, you have the right to an adjudicatory hearing upon written request within thirty(30) days after receiving this letter. Best Management Practices (BMPs) must be employed to ensure that excessive pollutants are not discharged to the surface water of the state. These practices should include as a minimum the following: • No discharge of fish pasts, floating solids, visible foam other than in trace amount. • The permittee shall direct employees and provide resources to follow, at a minimum, the following practices such that wastewater volume and wastewater constituents are reduced: a) All hoses used to provide on demand water delivery shall be equipped with automatic shut- off nozzles. b) Personnel shall be instructed to eliminate flows through idle equipment. c) All process and washdown equipment shall be fitted with high pressure/low volume nozzles. d) Dry cleanup shall be preformed prior to washdown of the facility Permit Number: NC0003174 There shall be no chromium, zinc or copper added to the treatment system except as pre-approved additives to biocidal compounds. The Permittee shall obtain approval from the Division of Water Quality's Aquatic Toxicology Unit (ATU) prior to the addition of any biocidal compound to the water discharged from outfall(s) 001. Approval for use of new compounds (not previously approved) must be submitted to the ATU at least 90 days in advance of any planned use of those compounds. The facility discharges into the mouth of Raccoon Creek [27-129-81 at Greens Creek,just upstream of the confluence of Greens Creek and the Neuse River. Raccoon Creek is classified as SC — NSW, HQW. RENEWAL STRATEGY: • The Division understands that this facility was destroyed by fire sometime late in the year 2000. Although the facility may have been partially rebuilt, this facility has not resumed operation or discharge, based on Discharge Monitoring Reports submitted by the Permittee (January 2001 through December 2005). Production data are not available to establish permit limits and monitoring conditions for this renewal. Therefore, limits and monitoring conditions appearing in the permit are based on previous facility outfalls, previous production records, and previous waste-stream characteristics. Based on the above, the Division shall stipulate in the permit that, prior to resuming operations, the Permittee shall submit a written request to modify this permit, a minimum of 180 days prior to resuming discharge. The Permittee shall submit for Division review, a site map with location(s) of outfall(s), scale drawings of the facility, estimates of production, and associated waste-flow characteristics for each outfall. Upon submittal of new data, permit limits will be developed using production data according to 40 CFR 408 and appropriate subparts for each outfall. A new plant is being built and therefore some of the discharge locations and outfall numbers have changed. The new facility is scheduled to be operational by the Spring of 2004 . The discussions with the permittee revealed that the facility will have a daily discharge of boiler blowdown during crab processing operations in the summer months. The boiler blowdown will be discharged via a separate pipe apart from the other outfalls. A separate outfall has also been constructed for a crab washing pit. It was noted during the site visit that the total requested flow is increased due to the inclusion of the boiler and the crab washing basin. The Washington Regional Office recommends that this permit be renewed for 5 years with the addition of the appropriate monitoring and limitations requirements for Outfall 001(Boiler Slowdown) and Outfall 003(Crab Washing) . `ti- 9'.
