Dear Mr. Fulcher:
The Division of Water Quality(the Division) hereby issues this permit for the subject facility. This
permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the
Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency
dated May 9, 1994, or as subsequently amended.
Please Note --New Permit Conditions. The Division understands that this facility was destroyed by
fire during the previous permit cycle. Although the facility may have been partially rebuilt, Fulcher's
Point Pride has not resumed operations or discharge, based on Discharge Monitoring Reports submitted
by the Permittee (January 2001 through December 2005). Therefore, Production data are not
available to establish permit limits and monitoring conditions for this renewal. Limits and
monitoring conditions appearing in the permit are based on previous facility outfalls, previous
production records, and previous waste-stream characteristics.
Based on the above, the Division shall stipulate in the permit that, prior to resuming operations, the
Permittee shall submit a written request to modify this permit, a minimums of 180 days prior to
resuming discharge. This request shall include a site map with outfall locations, scale drawings of the
facility, estimates of production, and associated waste-flow characteristics for each outfall whereby the
Division may calculate new permit limits and monitoring conditions.
Upon submittal of new production data, permit limits will be developed according to 40 CFR 408 and
appropriate subparts for each outfall.
If any parts, measurement frequencies, or sampling requirements contained in this permit are
unacceptable, you have the right to an adjudicatory hearing upon written request within thirty(30) days
after receiving this letter. Your request must be in the form of a written petition conforming to Chapter
150B of the North Carolina General Statutes, and must be filed with the office of Administrative

Division of Land Resources, the Coastal Area Management Act, or other federal or local
governments.

In compliance with the provision of North Carolina General Statute 143-215.1, other lawful
standards and regulations promulgated and adopted by the North Carolina Environmental
Management Commission, and the Federal Water Pollution Control Act, as amended,
Fulcher's Point Pride Seafood
is hereby authorized to discharge wastewater from a facility located at
Fulcher's Point Pride Seafood
101 South Avenue
Oriental
Pamlico County
to receiving waters designated as Raccoon Creek in the Neuse River Basin in accordance with
effluent limitations, monitoring requirements, and other conditions set forth in Parts I, II, III and
IV hereof.
This permit shall become effective February 1, 2006
This permit and authorization to discharge shall expire at midnight on June 30, 2008.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are
hereby revoked, and as of this issuance, any previously issued permit bearing this number is no
longer effective. Therefore, the exclusive authority to operate and discharge from this facility
arises under the permit conditions, requirements, terms, and provisions described herein.
Fulcher's Point Pride Seafood
is hereby authorized to:
1. Continue operation of filter screens used to-treat process wastewater associated with fish
and shrimp (outfall 001) processing and crab (outfall 002) processing, located at
Fulcher's Point Pride Seafood, 101 South Avenue, on Chadwick Point, Oriental, Pamlico
County, and
2. Discharge process wastewater from said treatment works at the location specified on the
attached map through outfall 001 and 002 into Raccoon Creek, which is classified.SG
NSW, HQW water, in the Neuse River Basin.

scale).

The temperature of the effluent shall not cause the temperature of the receiving stream to
increase by more than 0.8 'C above the natural water temperature during the months of June,
July, and August nor more than 2.2°C during other months and in no case to exceed a
maximum of 32°C.
There shall be no discharge of floating solids or visible foam in other than trace amounts.
Best Management Practices (BMPs) must be employed to ensure that excessive pollutants are
not discharged to the surface water of the state. These practices should include as a minimum
the following:
• No discharge of fish pasts, floating solids, visible foam other than in trace amount.
• The permittee shall direct employees and provide resources to follow, at a minimum, the
following practices such that wastewater volume and wastewater constituents are reduced:
a) All hoses used to provide on demand water delivery shall be equipped with automatic shut-
off nozzles.
b) Personnel shall be instructed to eliminate flows through idle equipment.
c) All process and washdown equipment shall be fitted with high pressure/low volume
nozzles.
d) Dry cleanup shall be preformed prior to washdown of the facility

There shall be no chromium, zinc or copper added to the treatment system except as
pre-approved additives to biocidal compounds.
The Permittee shall obtain approval from the Division of Water Quality's Aquatic Toxicology
Unit (ATU) prior to the addition of any biocidal compound to the water discharged from
outfall(s) 001. Approval for use of new compounds (not previously approved) must be
submitted to the ATU at least 90 days in advance of any planned use of those compounds.

A. (3.) TOTAL NITROGEN MONITORING
The Permittee shall calculate the annual mass loading of total nitrogen as the sum of quarterly loadings, according to
the following equations:
(1) Quarterly Mass Loading(lb/qtr) = TN x Q x 8.34
where:
TN = the average total nitrogen concentration(mg/L)of the grab samples collected during the
quarter
Q = the total wastewater flow discharged during the quarter(MG/qtr)
8.34 = conversion factor, from(mg/L x MG)to pounds
(2) Annual Mass Loading(lb/yr) = E(Quarterly Mass Loadings) for the calendar year
The Permittee shall report the total nitrogen concentration for each sample and the quarterly mass loading in the
appropriate self-monitoring report and the annual mass loading of total nitrogen in the December

SUMMARY
Fulcher's Point Pride Seafood.has historically processed and packed crab, shrimp and fish at a
facility located in Pamlico County in Subbasin 03-04-10 within the Neuse River Basin. The
facility discharges into the mouth of Raccoon Creek [27-129-81 at Greens Creek,just upstream
of the confluence of Greens Creek and the Neuse River. Raccoon Creek is classified as SC —
NSW, HQW.
RENEWAL STRATEGY:
• The Division understands that this facility was destroyed by fire sometime late in the year
2000. Although the facility may have been partially rebuilt, this facility has not resumed
operation or discharge, based on Discharge Monitoring Reports submitted by the Permittee
(January 2001 through December 2005). Production data are not available to establish
permit limits and monitoring conditions for this renewal. Therefore, limits and monitoring
conditions appearing in the permit are based on previous facility outfalls, previous production
records, and previous waste-stream characteristics.
Based on the above, the Division shall stipulate in the permit that, prior to resuming
operations, the Permittee shall submit a written request to modify this permit, a
minimum of 180 days prior to resuming discharge. The Permittee shall submit for Division
review, a site map with location(s) of outfall(s), scale drawings of the facility, estimates of
production, and associated waste-flow characteristics for each outfall.
Upon submittal of new data, permit limits will be developed using production data according to
40 CFR 408 and appropriate subparts for each outfall.
PROPOSED SCHEDULE FOR PERMIT ISSUANCE:
Public Notice: This permit will not be sent to Public Notice until modified(see Renewal Strategy).

PART IV - EVALUATION AND RECOMaMATIONS
The site visit revealed that the crab and fish processing plant that
was previously permitted had burned down. A new plant is being built and
therefore some of the discharge locations and outfall numbers have changed.
The new facility is scheduled to be operational by the Spring of 2004 . The
discussions with the permittee revealed that the facility will have a daily
discharge of boiler blowdown during crab processing operations in the summer
months. The boiler blowdown will be discharged via a separate pipe apart from
the other outfalls. A separate outfall has also been constructed for a crab
washing pit. It was noted during the site visit that the total requested flow
is increased due to the inclusion of the boiler and the crab washing basin.
The Washington Regional Office recommends that this permit be renewed for 5
years with the addition of the appropriate monitoring and limitations
requirements for Outfall 001(Boiler Slowdown) and Outfall 003(Crab Washing) .
