The most recent permit was issued on June 2, 1997 and expired on December 31, 2001. The Permittee submitted Standard Form A on July 3E 2001 in order to request renewal of the permit. Since this was prior to the implementation of EPA renewal forms and associated pollutant analyses, these data are not necessary for this renewal, though they will be required for subsequent renewals. The Permittee has not requested any changes to the existing NPDES permit. At the time of the previous permit renewal, the facility was under a Special Order by Consent (SOC) while needed upgrades were made to the wastewater treatment plant. Problems had arisen at the plant due to hydraulic overloading as a result of inflow and infiltration. The upgrade was completed during the permit term and the facility began meeting permit limits by the SOC compliance date of November 30, 1998. Spruce Pine has a modified pretreatment program with the Division of Water Quality's Pretreatment Unit and will continue to implement this program in the new permit term. None of the industries that were discharging to the facility at the last permit renewal are discharging to the Spruce Pine WWTP now. A new industry has begun to discharge but is not yet up to full production. Instream Monitoring, Verification of Existing Conditions and DMR Data Review This facility discharges to the North Toe River in subbasin 04-03-06 of the French Broad River Basin. This portion of the North Toe River bears classification of trout waters (Tr) in addition to a "C" classification. The North Toe River is not on the 2002 303(d) list. Instream data (upstream and downstream of the discharge, as specified in the permit) from May 2001 through May 2003 were analyzed and plotted (plots are attached to this fact sheet). Spruce Pine is required to monitor instream conductivity, fecal coliform, temperature and dissolved Fact Sheet. NPDES NC0021042 Rrneeail Page I oxygen (D.O.). As indicated by the plots, the discharge appears to have no instream effect on temperature and D.O. and only a very minor effect on conductivity and fecal coliform. Effluent data from DMRs elating from January 2001 through May 2003 were also reviewed. Data for conventional parameters are summarized in Table I. Plow was well below the permit limit of 2.0 MGD. Overall, compliance with these parameter limits was excellent throughout the last three years. The Permittee is also required to monitor for ammonia nitrogen (NI-13-N), total nitrogen and total phosphorus. Data for these parameters is summarized in Table 2. All values are fairly low for this type of facility, suggesting good nutrient and ammonia removal. NC0021402 Nutrient Data(January 2001-May 2003) A review of the metals (from both the DMRs and Pretreatment data) and toxicants was also performed. With the exception of total residual chlorine (TRC), these are discussed in the Reasonable Potential Analysis section. Average TRC from January 2001-May 2003 was 2.76 µg/L and was no higher than 20 Itg/L. Correspondence The Asheville Regional Office (ARO) conducted several site visits during this permit term to evaluate compliance. ARO has found the facility to be compliant with the terms of the permit with the exception of occasional effluent limits violations. The Permittee has experienced difficulty in properly implementing its Pretreatment program and the facility was issued a Notice of Violation (NOV) for a failure to properly enforce on its Significant Industrial Users (SIUs) in June 2000. The most recent Pretreatment Compliance Inspection indicated satisfactory compliance with the program. The Spruce Pine WWTP has received eight of NOVs over the course of this permit term. While three of these were more administrative in nature (in addition to the NOV mentioned above, one was issued for late payment of annual fees and the other was for failure to sign a toxicity report), two were for toxicity failures in 2001 and three were for violations of the mercury daily maximum limit. The Division assessed civil penalties for three of these violations. All civil penalties issued have been paid. PERMITTING STRATEGY Waste Load Allocation (WLA) The Division prepared the last WLA for the previous permit renewal. The previous and current effluent limits were based on guidelines and water quality standards. The Division has judged previous parameters and limits to be appropriate for renewal with some exceptions. Changes to toxicant monitoring are discussed in the Reasonable Potential Analysis section. Weekly average Fact Sheet NPDFS NCO0-21042 Rentwal Page ammonia limits based on a 3: 1 ratio with the monthly average (but no higher than 35.0 mg/L) will be implemented in this permit. This is a new statewide policy that resulted from EPA requirements. Since this permit only has a summer monthly average limit of 12.0 mglL (the winter monthly average limit was calculated to be 30.0 mg/L and is sufficiently high that it does not need to be expressed in the permit limits), the summer weekly average limit will be 35.0 mg/L. In addition, an annual pollutant scan will be added such that the Permittee can collect the necessary data required by EPA Form 2A throughout the permit term. This condition is now standard on all major municipal permits in North Carolina. Reasonable Potential Analysis (RPA) The Division conducted EPA-recommended analyses to determine the reasonable potential for toxicants to be discharged by this facility, based on DMR data from January 2000-May 2003. These toxicants consist of cadmium, copper, mercury and zinc, all of which are currently monitored through the NPDES permit. No pretreatment data were collected during this permit term. Results suggest no reasonable potential for the facility to discharge cadmium and copper. The limit for cadmium will be eliminated and monitoring will be reduced to twice monthly. Copper monitoring will remain at quarterly. The facility did demonstrate reasonable potential to discharge mercury and zinc. Mercury is already limited in the current permit; the limit and monitoring will carry over into the new permit term. Zinc is an action level parameter, and would only be limited if significant toxicity problems were demonstrated. Monitoring for this parameter, however, will be increased from quarterly to twice monthly. SUMMARY OF PROPOSED CHANGES In keeping with Division policies, the following will be incorporated into the permit: • New weekly average summer ammonia limit of 35.0 mo L • Annual pollutant scan • Elimination of cadmium limit and decrease of monitoring frequency to 2/month Increase in zinc monitoring from quarterly to 2/month New Weekly Average and Daily Maximum limits are derived from the latest NC/EPA policies considering ''/2 FAVs and allowable concentrations based on reasonable potential. The instream data plots are marked with the parameter name, like D.O. , fecal, etc. You can print out the raw instream data and attach it if you want. The region has already approved this one, but I guess they would probably like a hard copy anyway. Here are the few comments I can offer on the drafts. All appear ready to go forward with little or no change on your part. Once you have them ready, pls forward them to Charles. I noticed some minor formatting corrections (odd page breaks, for instance),but I'll leave it to Charles to look at the documents and make any neccssary changes before he prints them out. Elizabethtown - Looks good - go for it. Murphy - In the cover letter, you shouldn't have to apologize for past errors. Suggest you word it in a more straightforward way: "The Instream Waste Concentration (IWC) for the toxicity limit at 1.4 MGD has been changed to 2.2% to correct an error in the previous permit renewal." Spruce Pines - A couple of points in the fact sheet maybe worth clearing up: It sounds like the Town expanded its plant to handle the higher flows caused by 1/1 rather than fix the 1/1 problem. Is that correct? Also,it sounds like all of the industrial users left once the Town started implementing its pretreatment program. Is that how it went? La Grange - One minor point- the table on p.1 of the Fact Sheet gives an IWC of"90% for toxicity purposes." Since there is no tox limit, should this be dropped to avoid confusion? Contentnea MSD - There is a potential issue regarding"effluent channel" status and their discharge point - did the Region ever mention the issue? It came up during the 2000 renewal but was never resolved that I know of In short,the plant discharges to a man-made channel, several hundred yards long, that runs to the creek. Our limits are based on the IWC at the creek;it appears they should be changed to reflect the IWC in the channel (approx. 100%). That's it. I'll be gone Tuesday,back on Wednesday.
