Division pers nel have reviewed and approved your application for the subject permit. Accordingly, we are
forwarding th :attached NPDES discharge permit. This permit is issued pursuant to the requirements of
North Carotin General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and
the U.S. Envir nmental Protection Agency dated October 15, 2007 (or as subsequently amended).
The Division ceived public comments during the 30-day public comment period expressing concerns with
the historic p , ormance of the plant and requesting the State takes actions to address these issues. The
Division reco izes that the improvements to the chlorination system and pH adjustment system should
address the ` 'ority of the noncompliance issues. We expect the town to diligently complete the
improvements d to operate the plan efficiently to minimize noncompliance with the permit requirements.
If any parts, easurement frequencies or sampling requirements contained in this permit are unacceptable to
you, you hav --the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this 1tter. This request must be in the form of a written petition, conforming .to Chapter 150B of
the North Car Dina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service
Center, Raleig .North Carolina 27699-6714). Unless such demand is made, this decision shall be final and
binding.
Please note th t: this permit is not transferable except after notice to the Division. The Division may require
modification o ,revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain other permits which may be required by the Division of Water Quality or permits required by the
Division of L lid :Resources, the Coastal Area Management Act or any other Federal or Local governmental

1. All instream monitoring samples shall be instantaneous samples. These shall be collected three times
per week during June, July, August, and September, and once per week during the rest of the year.
They shall be collected as grab samples at one -foot intervals vertically throughout the water column.
Instream sampling locations are as follows: 1) at the mouth of Douglas Creek, 2) near the mouth of
Scarboro Creek, 3) in Shallowbag Bay approximately 800 feet northeast of Sandy Point, 4) in
Shallowbag Bay approximately 0.4 miles southeast of Ballast Point, and 5) in Roanoke sound
approximately 2 0 feet outside of Shallowbag Bay.
2. The monthly ave age BODs and Total Suspended Solids (TSS) concentrations shall not exceed 15% of
the respective in uent value (85% removal) .
3. The daily averag dissolved oxygen concentration shall not be less than 6. 0 mg/L.
4. Whole Effluent oxicity shall be measured by the Acute Toxicity (P/F) test using fathead minnow at
90%. Testing sh 11 be conducted in February, May, August and November (see condition A. (3)).
There shall be no l discharge of floating solids or visible foam in other than trace amounts.

.'Procedure Document a titled "Pass/Fail Methodology For Determining Acute Toxicity In A Single Effluent
Concentration" (Revise July, 1992 or subsequent versions). The monitoring shall be performed as a Fathead Minnow
Piot hales romelas 24-h ur static test. The effluent concentration at which there may be at no time significant
acute mortality is- 90% (defined as treatment two in the procedure document). Effluent samples for self -
monitoring purposes m st be obtained during representative effluent discharge below all waste treatment. The tests will

Should the Pertnittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring
will begin immediately 1 til such time that a single test is passed. Upon passing, this monthly test requirement will revert

Should any test data frdm either these monitoring requirements or tests performed by the North Carolina Division of
Water Qualityindicate potential impacts tothe receiving stream, this permit may be re -opened and modified to include
alternate monitoring re uirements or limits.
NOTE: Failure to achfieve test conditions as specified in the cited document, such as minimum control organism
survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up
testing to be complete ino later than the last day of the month following the month of the initial monitoring.

The Permittee shall perform an annual Effluent Pollutant Scan for.all parameters listed in the attached table. The
