The Divisio of Water Quality (the Division) hereby issues the attached NPDES permit for the
subject facili . This permit is issued pursuant to the requirements of North Carolina General
Statute 143- 15.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency (EPA) dated May 9, 1994, or as subsequently amended.
RENEWAL SUMMARY
The Division acknowledges your comments on the draft permit received on April 14, 2006 and
responded to ese comments on April 20, 2006. The Division's renewal evaluation included a
reasonable p tential analysis (RPA), in accordance with EPA permitting guidance. The Division
made the foil wing changes to your previous permit based on current information and your
Discharge Monitoring Reports (DMRs) submitted over the last permit cycle:
• Turbidity - added permit limit of 50 NTU; changed monitoring from quarterly to
Mont ly.
• Benz ne / Toluene / MTBE — not detected; continue Monthly monitoring; no permit
limit.
• Phen l — added permit limit of 60 µg /L; continue Monthly monitoring.

If any parts, monitoring frequencies, or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing, upon written request, within
thirty (30) days following receipt of this letter. You must submit this request in the form of a
written petition, conforming to Chapter 150B of the North Carolina General Statutes, and file it
with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina
27699-6714. Unless such a demand is made, this permit shall be final and binding.
Please notice that this permit is not transferable except after notifying the Division of Water
Quality. The Division of Water Quality may modify, or revoke and reissue this permit. This
permit does not affect your legal requirements to obtain other permits required by the Division o f
Water Quality, the Division of Land Resources, the Coastal Area Management Act, or other
federal or local governments.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked, and as of this issuance, any previously issued permit bearing this number is no longer effective.
Therefore, the exclusive authority to operate and discharge from this facility arises under the permit
conditions, requirements, terms, and provisions described herein.

1. to continue to operate a Water Pollution Control System consisting of
• oil/water separators (servicing stormwater runoff from fuel loading -rack areas),
• diked areas (secondary -containment for surface -storage tanks) with hand -operated discharge
valves (for stormwater and city water used for washing and/or hydrostatic testing);
a facility located at the Charlotte II Terminal, NC Highway 27, Paw Creek, Mecklenburg County,
and
2. to discharge the combined wastewaters from said treatment facility through Outfall 006 at a
specified location (see attached map) into an unnamed tributary to Long Creek, a waterbody
classified as WS-IV waters within the Catawba River Basin.

Footnotes:
1. Flow — During periods of no flow, the Permittee shall submit a monthly Discharge Monitoring Report (DMR)
indicating "No ischarge." Flow shall be monitored with each discharge event and may be monitored in one of
four ways:
a) measure flow continuously;
b) calculate flow based on total rainfall per area draining to the outfall; (this method of flow
measurement should not be used for facilities with large runoff -collection ponds);
c) estimate flow at 20-minute intervals during the entire discharge event; or
d) report flow used on discharge pump logs.
2. Turbidity — Effluent shall not cause receiving stream turbidity to exceed 50 NTU. If receiving stream
background turbidity exceeds 50 NTU, effluent shall not cause this background value to increase.
3. Oil and Grease — Where possible, the grab sample for oil and grease should be skimmed from the
surface of a quiescent (calm water) zone.
4. MTBE - Please see Part A.(3) for other requirements relating to MTBE.
5. Acute Toxicity (Fathead Minnow, 24-hour), Annual [see Special Condition A.(2)]. Samples for Acute Toxicity
shall be collected concurrent with BTEX sampling.

EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS
SPECIAL CONDITIONS
A. (2) ACUTE TOXICITY MONITORING (ANNUAL)
The Permittee shall conduct annual toxicity tests using protocols defined as definitive in EPA Document
EPA/600/4-90/027 entitled `Methods for Measuring the Acute Toxicity of Effluents to Freshwater and
Marine Organisms." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas)
24-hour static test. Effluent samples for self -monitoring purposes must be obtained below all waste
treatment. The Permittee will conduct one test annually, with the annual period beginning in January of
the calendar year of the effective date of the permit. The annual test requirement must be performed and
reported by June 30. If no discharge occurs by June 30, notification will be made to the Division by this
date. Toxicity testing will be performed on the next discharge event for the annual test requirement.
The parameter code for this test is TAE6C. All toxicity testing results required as part of this permit
condition will be entered on the Effluent Discharge Form (MR-1) for the month in which it was
performed, using the appropriate parameter code. Additionally, DWQ Form AT-1 (original) is to be sent
to the following address:

Completed Aquatic Toxicity Test Forms shall be filed with the Environmental Sciences Branch no later
than 30 days after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine
of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of
the waste stream.
Should any test data from either these monitoring requirements or tests performed by the North Carolina
Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re-
opened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control
organism survival and appropriate environmental controls, shall constitute an invalid test and will
require immediate follow-up testing to be completed no later than the last day of the month following
the month of the initial monitoring.

A. (3) MTBE - SPECIAL CONDITION
For the protectioij of public health, petroleum bulk -storage terminals that discharge to waters
classified as wat9r supply (WS waters) will adhere to an action plan for Methyl Tertiary Butyl Either
(MTBE). Based on previous analyses, MTBE was not detected at this facility. The Division has
therefore relaxed the monitoring frequency from Monthly to Quarterly for this renewal.
If the Permittee detects MTBE, the monitoring frequency shall immediately revert to Monthly and
the Permittee sh 1 submit to the Division an MTBE Action Plan to identify the sources of MTBE
contamination.

Magellan Charlotte II Terminal (#NC0005185):
1) Turbidity — Changed from quarterly to monthly. Requesting this be changed back
or dropped. No exceedences of turbidity recorded since at least January 2004.
Response: The Division evaluates turbidity (and other parameters) using the EPA -
mandated Reasonable Potential Analysis, or RPA. This equation evaluates a given
parameter's database for reasonable potential to exceed its water -quality stream standard.
As in your case, when the RPA maximum predicted for turbidity (224.1 µg/L) exceeds
the allowable concentration (standard 50 NTU), the Division adds a limit equal to the
standard and monthly monitoring. We apply this consistently across the state. No change
to the final permit.
2) MTBE — Request the testing for this parameter be dropped since none has been
detected since at least January 2004. Also note this is not a requirement for Charlotte I.
Response: MTBE is a potential carcinogenic compound and monthly monitoring is
required to establish a database for future consideration. Monitoring is mandatory for
potential dischargers across the state. Regarding Charlotte I, we evaluate each facility
using its unique parameter list, database, and receiving stream -- DWQ does not compare
them. No change to the final permit.
3) Phgnol — Request the testing for this parameter be dropped since only sporadic low-
level (e.g. 0.012 — 0.14 mg/1) detections have been recorded since at least January 2004.
Also note this is not a requirement for Charlotte I.
Respo se: RPA max. predicted 85 µg/L, max. allowable 60 µg/L. Therefore, RP = yes;
limit 60 µg/L. (RPA database Jan2002 - Dec2005; 34 samples / 12 hits; high = 140 µg/L
Oct2005). No change to the final permit.
4) Benzene — For hydro test only changed limit from 71.4 ug/1 to 1.19 ug/1. Why so
stringent a limit? Can this be changed back or increased?
Response: The Draft Permit shows no limit for benzene (RP = no). Therefore, the permit
requires benzene monitoring only — no limit. Benzene is an established carcinogen.
Monthly benzene monitoring is mandatory across the state for all bulk -storage facilities
discharging to WS water. No change to the final permit.

5) Section 1 (Water Pollution Control System) on Supplement to Permit Cover Sheet
page: It is indicated that the oil/water separator is used to treat stormwater however
this is only a physical separation. Can the word "treatment" be dropped in Section 1
and Section 2 (i.e. treatment facility) as to not imply any chemical or filtration
professes?
Response: The Supplement to Cover page has been revised considering the above:
• oillwater separators (servicing stormwater runoff from fuel loading -rack
areas),
However, be advised that an oil/water separator is deemed "treatment" under this permit,
as are ` containment facilities" providing retention time for transpiration, infiltration,
evaporation, physical settling, and/or sun UV alteration of potential contaminants.
6) Williams Terminal Holdings, LP on cover page and supplement pages needs to be
changed to Magellan Terminals Holdings, LP.
Response: Permit cover page and Supplement to Cover page have been revised to
reflect the correct Permittee. Sony about that!
Thanks for the thorough review of the Draft Permit. DWQ is currently generating the
Final Permit for signature and issuance. This final will reflect the above comments and
responses.

Thank you for the opportunity to comment on our draft NPDES permits for our refined products storage terminals
in Charlotte. Please see our comments noted below:
Charlotte I Terminal (#NC0074705):
1). Turbidity — Changed from quarterly to monthly. Requesting this be changed back or dropped. No
exceedances of turbidity recorded since at least January 2004.
2) Benenze — For hydro test only changed limit from 71.4 ug/I to 1.19 ug/I. Why so stringent a limit? Can
this be changed back or increased?
3) Section 1 (Water Pollution Control System) on Supplement to Permit Cover Sheet page: The waste
holding tank mentioned would actually be better described as a waste water tank. Also the carbon filter is
not part of a ground water remediation system but part of truck -loading rack water treatment. It is used in
conjunction with the oil/water spar an .

BACKGROUND
Waste Load Allocation (WLA) and Bulk -Storage SOP. A Waste Load Allocation was last conducted
in June 1993, when the receiving stream, Long Creek [11-210-(2.5)], was classified water supply WS-
IV. {NOTE: This discharge is mis-located in BIMS to the stream segment 11-210-(0.5) classified "C"
waters; this error should be corrected.} The 1993 WLA recommended monitoring for benzene, toluene,
ethylbenzene, xylene, phenols, TSS, Turbidity, oil & grease, pH, and MTBE. The Division established
new effluent limits and monitoring requirements for the previous permit following Requirements for
Discharges from Oil and Petroleum Storage Facilities (SOP 2001, version 30Ju101).
In September 2003, Magellan Terminals Holdings, L.P. purchased this facility from previous
owner/operator Williams Energy Ventures and registered a name -change with the Division. Previous
owners, Williams Energy Ventures and Amoco Oil Company, divided a larger facility, separating
multiple outfalls, thus the current facility retained the single Outfall 006. Stormwater collected from the
truck -loading racks area is treated by an oil/water separator and combined with stormwater collected
behind diked areas. This combined treated wastewater discharges through Outfall 006.

PERMITTING STRATEGY
New SOP for Oil Terminals. The Division established renewal criteria for this permit according to the
NPDES Permitting Requirements for Petroleum Bulk -Storage 2005 Permitting Strategy, version
September 9, 2005 (2005 SOP). This document recommends 12 criteria for renewal including
reasonable potential analyses (see Renewal Summary). Database for this RPA is attached to this
document.
Concerning Benzene, Toluene, and MTBE. The Division considered the standards for benzene (1.19
ttg/L) and toluene (11 itg/L) in its evaluation of reasonable potential (RP). The Permittee reported no
benzene or toluene at Outfall 001 in excess of the standard during the previous permit cycle (Jan 2002 —
1Dec 2005) Therefore there are no permit limits related to these parameters. Similarly Methyl Tertiary
Butyl Ether (MTBE) was not detected. Monthly monitoring is mandatory for these parameters (per SOP
2005) but there is no permit limit.
Reasonable Potential Analysis (RPA): The Division conducted a reasonable potential analysis
(according to EPA guidelines) in order to establish numerical potential for a given parameter to exceed
its water quality stream standard. The Division established a list of parameters of concern (POCs) based
on the previous permit. Tested parameters include benzene, toluene, phenol, turbidity, and MTBE.
Phenol Calculation. The Division calculated phenol limits appropriate for a discharge to water supply
(WS-IV) waters considering a total of eight discharges to this water shed (see 2005 SOP, item 11). The
phenol limits calculation considers the allowable mass loading (0.48 lbs/day) for all terminals
discharging to WS waters in the Paw Creek area (per SOP 2005). The allowable wasteload for this
permit:

The Division used the above loadings (60 ltg/L) to evaluate reasonable potential at Outfall 001. Phenol
was detected 12 times (method detection level 50 µg/L) during the permit cycle at Outfall 001 and data
suggest reasonable potential at this outfall (max. predicted = 85 ltg/L / max. allowable = 60 µg/L).
Therefore, the Division will add a permit limit at Outfall 001 (60 µg/L), and continue monthly
monitoring.
Whole Effluent Toxicity (WET) Testing. This facility has "passed" annual toxicity testing for the last
five years ("Pass" or LC-50 >100). No changes to the permit recommended.
Review of EPA Method 625. The Division reviewed annual analytical data (for the years 2003
through 2005) reported from EPA test method 625 (semi -volatile hydrocarbon compounds). This test
method did not detect any of the listed parameters at the test -method levels of detection. One exception:
May 2005 - bis (2-ethylhexyl) phthalate, a predicted/perceived laboratory contaminant.

SUBJECT: Revised Guidance to Permit Writers — Allowable Phenol Loads for Bulk
Oil Terminals in the Paw Creek Area, Catawba River Basin.
As part of the newly revised Standard Operating Procedures — Permit Requirements for
Discharges from Oil and Petroleum Storage Facilities (SOP-2001), the Division has
recalculated the allowable load for phenol. New numbers are appropriate for bulk oil
distribution terminals discharging to an unnamed tributary of Gum Branch (WS-IV) and an
unnamed tributary of Long Creek (WS-IV CA), both within subbasin 030834. This document
affects eight (8) permitted facilities discharging to WS waters (see Table 1).
I have made these calculations considering the following background and assumptions:
1. The water quality stream standard comes from the EPA Document Ambient Water
Quality Criteria for Chlorinated Phenols. This standard has been included in the North
Carolina 2B .0200 Rules and has been applied to Water Supply (WS) waters since 1990.
2. The standard for chlorinated phenolic compounds is 1.0 µg/L. Although it is unlikely
that petroleum bulk storage facilities would discharge chlorinated phenolic compounds,
they may discharge phenol. Therefore, the Division is concerned that phenol (at levels of
1 µg/L or greater) has potential to create "daughter compounds" at downstream water
intakes where water is drawn from the river and chlorinated. It is therefore appropriate to
calculate allowable phenol load near the closest water intake downstream of these bulk
storage facilities.
3. I have applied the 30Q2 flow because the standard is based on potential aesthetic
concerns (taste and odor associated with chlorinated phenols in fish and drinking water).
I have applied the standard (1.0 pg/L) near the confluence of Long Creek and the
Catawba River (approximately 1,000 feet upstream) where the Division calculated 30Q2
flow at 716 cfs (based on Clariant Corporation's 1996 WLA, NC0004375). Therefore,
the allowable wasteload for each of nine (9) dischargers is calculated:
716 cfs x 0.001 mg/L x 8.34 = 3.85 lbs./day total phenol

PART IV - EVALUATION AND RECOMMENDATIONS
The Pe 'nee, Magellan Terminals Holdings is requesting NPDES Permit renewal for the
discharge of tr ated wastewater. The wastewater is generated from the loading dock (treated by
oil water separator) and stormwater runoff.
A pilot test for groundwater treatment is being conducted at the facility by Amoco Oil
Company, prio owner, using a vapor extraction/air sparging system. According to Matt Tendam,

consultant with Amoco oil Company, tel # 919-637-3338, the existing pump and treat system was
determined to not be effective for the ground water remediation effort. Amoco Oil Company
retained operational responsibility/ownership of the groundwater remediation system located at
the facility. Amoco is planning to submit an A to C later this year once a decision has been made
regarding a ground water remediation system.
It is recommended that the NPDES Permit be renewed as requested.

Please find attached the NPDES permit applications for the renewal of the above
referenced permits. There have been no changes in the source, treatment or discharge of
wastewate at these refined product storage terminals since the last permits were issued.
The waste ater discharges consist of non -contact storm waters from diked storage tank
areas; storm water and wash water from loading rack areas treated with oil/water
separators and hydrostatic waters from testing tanks and/or associated pipelines.
There are virtually no solids generated from treatment of the wastewaters at either of
these terminals. Every few years any sediments are removed from the oil water
separators and the floor drain mud boxes in the loading racks. These sediments are
disposed of off -site as a product contact waste.
