FILTER STRIP, RESTORED RIPARIAN BUFFER, AND LEVEL SPREADER OPERATION &
MAINTENANCE AGREEMENT
This Operation and Maintenance Agreement ( "Agreement ") is established this 18 day
of December , 2012, by Lufkin Leased Fee LLC
( "Owner "), who is the owner of the Property (hereinafter defined), on behalf of the Owner, the
Association (if applicable), and all successor Owners of the Property and the Town of Apex
( "Town ").
The "Property" is that certain property known as
Lufkin Leased Fee LLC L02 and which is more
particularly described in that certain deed recorded in Book _1-4-251-., Page 2628 , Wake
County Registry.
Owner represents, warrants, and agrees that Owner is financially responsible for the
construction, maintenance, repair and replacement of all stormwater control structures,
appurtenances and vegetation, including the impoundment, located on the Property. Owner
agrees to perform the maintenance as outlined below and as may be applicable or required as
part of the regulations set forth in Section 6.1.12 of the Town of Apex Unified Development
Ordinance. A Home Owners Association or Property Owners Association shall not be the
financially responsible party unless more than 50% of the lots or units have been sold and a
resident of the subdivision has been named the president.
Owner shall keep a maintenance record for maintenance performed related to
stormwater Best Management Practices on the Property ( "BMP Maintenance Record "). The
BMP Maintenance Record shall be kept by Owner in a log in a known, set location and made
available upon request. Any deficient BMP elements noted in the inspection shall be corrected,
repaired or replaced immediately by Owner. These deficiencies can affect the integrity of
structures, safety of the public, and the pollutant removal efficiency of the BMP.

A filter strip is a section of land capable of sustaining sheet flow and is either forested or
vegetated with turf grasses or other plants. Restored riparian buffers are natural or
constructed low- maintenance ecosystems adjacent to surface water bodies with trees, grasses,
shrubs, and herbaceous plants. Level spreaders do not remove pollutants by themselves, but
they are crucial in assuring the effectiveness of certain BMPs and in protecting the function of
riparian buffers. A level spreader consists of a concrete linear structure constructed at virtually
zero percent grade. One of the main purposes of a level spreader is to disperse concentrated
stormwater flows over a wide enough area to prevent erosion of the BMP or filter strip where it
outlets.
Inspection and maintenance procedures:
• Immediately after the filter strip is established, any newly planted vegetation shall be
watered twice weekly if needed until the plants become established (commonly six
weeks). The watering shall take place on designated days according to the odd /even
watering schedule cited in the Town of Apex Code of Ordinances.
• Once a year, the filter strip shall be reseeded to maintain a dense growth of vegetation.
• Stable groundcover shall be maintained in the drainage area to reduce the sediment
load to the vegetation.
• Two to three times a year, grass filter strips shall be mowed and the clippings harvested
to promote the growth of thick vegetation with optimum pollutant removal efficiency.
Turf grass should not be cut shorter than 3 to 5 inches and may be allowed to grow as
tall as 12 inches depending on aesthetic requirements.
• Once a year, the soil shall be aerated and lime will be added if necessary.
• Weeds or shrubs growing on level spreader or in swale shall be removed.
• The level lip shall be inspected for settling, erosion, or concentrated flow.
After the filter strip /buffer /level spreader is established /installed, Owner shall inspect once a
quarter and within 24 hours after every storm event greater than 1.0 inches. Owner shall keep
records of inspection and maintenance in a known, set location and will be made available
upon request.

WET DETENTION BASIN OPERATION & MAINTENANCE AGREEMENT
This Operation and Maintenance Agreement ( "Agreement ") is established this 18 day
of December 201? by Lufkin Lease Fee LLC
( "Owner "), who is the owner of the Property (hereinafter defined), on behalf of the Owner, the
Association (if applicable), and all successor Owners of the Property and the Town of Apex
( "Town ").
The "Property" is that certain property known as
Lufkin Leased Fee LLC L02 and which is more
particularly described in that certain deed recorded in Book 14251 Page 2628 Wake
County Registry.
Owner represents, warrants, and agrees that Owner is financially responsible for the
construction, maintenance, repair and replacement of all stormwater control structures,
appurtenances and vegetation, including the impoundment, located on the Property. Owner
agrees to perform the maintenance as outlined below and as may be applicable or required as
part of the regulations set forth in Section 6.1.12 of the Town of Apex Unified Development
Ordinance. A Home Owners Association or Property Owners Association shall not be the
financially responsible party unless more than 50% of the lots or units have been sold and a
resident of the subdivision has been named the president.
Owner shall keep a maintenance record for maintenance performed related to
stormwater Best Management Practices on the Property ( "BMP Maintenance Record "). The
BMP Maintenance Record shall be kept by Owner in a log in a known, set location and made
available upon request. Any deficient BMP elements noted in the inspection shall be corrected,
repaired or replaced immediately by Owner. These deficiencies can affect the integrity of
structures, safety of the public, and the pollutant removal efficiency of the BMP.

NUMBER OF WET DETENTION BASINS:

A wet detention basin is a stormwater management facility that includes a permanent
pool of water for removing pollutants and additional capacity above the permanent pool for
detaining stormwater runoff. The wet detention basin system is defined as the wet detention
basin, outlet structure, pretreatment including forebays, grassed swales, and the vegetated
filter if one is provided.

Inspection and maintenance procedures:
• Immediately after the wet detention basin is established, the plants on the vegetated
shelf and perimeter of the basin shall be watered twice weekly if needed, until the
plants become established (commonly six weeks). The watering shall take place on
designated days according to the odd /even watering schedule cited in the Town of Apex
Code of Ordinances.
• No portion of the wet detention basin shall be fertilized after the first initial fertilization
that is required to establish the plants on the vegetated shelf.
• Stable ground cover shall be maintained in the drainage area to reduce the sediment
load to the wet detention basin.
• The flushing of the sediment through the emergency drain shall be minimized to the
maximum extent practical.
After the wet detention basin is established, Owner shall inspect it once a month and within 24
hours after every storm event greater than 1.0 inches. Owner shall keep records of inspection
and maintenance in a known, set location and will be made available upon request.

FILTER STRIP, RESTORED RIPARIAN BUFFER, AND LEVEL SPREADER OPERATION &
MAINTENANCE AGREEMENT
This Operation and Maintenance Agreement ( "Agreement ") is established this 18 day
of December , 2012, by Lufkin Leased Fee LLC
( "Owner "), who is the owner of the Property (hereinafter defined), on behalf of the Owner, the
Association (if applicable), and all successor Owners of the Property and the Town of Apex
( "Town ").
The "Property" is that certain property known as
Lufkin Leased Fee LLC L02 and which is more
particularly described in that certain deed recorded in Book _1-4-251-., Page 2628 , Wake
County Registry.
Owner represents, warrants, and agrees that Owner is financially responsible for the
construction, maintenance, repair and replacement of all stormwater control structures,
appurtenances and vegetation, including the impoundment, located on the Property. Owner
agrees to perform the maintenance as outlined below and as may be applicable or required as
part of the regulations set forth in Section 6.1.12 of the Town of Apex Unified Development
Ordinance. A Home Owners Association or Property Owners Association shall not be the
financially responsible party unless more than 50% of the lots or units have been sold and a
resident of the subdivision has been named the president.
Owner shall keep a maintenance record for maintenance performed related to
stormwater Best Management Practices on the Property ( "BMP Maintenance Record "). The
BMP Maintenance Record shall be kept by Owner in a log in a known, set location and made
available upon request. Any deficient BMP elements noted in the inspection shall be corrected,
repaired or replaced immediately by Owner. These deficiencies can affect the integrity of
structures, safety of the public, and the pollutant removal efficiency of the BMP.

A filter strip is a section of land capable of sustaining sheet flow and is either forested or
vegetated with turf grasses or other plants. Restored riparian buffers are natural or
constructed low- maintenance ecosystems adjacent to surface water bodies with trees, grasses,
shrubs, and herbaceous plants. Level spreaders do not remove pollutants by themselves, but
they are crucial in assuring the effectiveness of certain BMPs and in protecting the function of
riparian buffers. A level spreader consists of a concrete linear structure constructed at virtually
zero percent grade. One of the main purposes of a level spreader is to disperse concentrated
stormwater flows over a wide enough area to prevent erosion of the BMP or filter strip where it
outlets.
Inspection and maintenance procedures:
• Immediately after the filter strip is established, any newly planted vegetation shall be
watered twice weekly if needed until the plants become established (commonly six
weeks). The watering shall take place on designated days according to the odd /even
watering schedule cited in the Town of Apex Code of Ordinances.
• Once a year, the filter strip shall be reseeded to maintain a dense growth of vegetation.
• Stable groundcover shall be maintained in the drainage area to reduce the sediment
load to the vegetation.
• Two to three times a year, grass filter strips shall be mowed and the clippings harvested
to promote the growth of thick vegetation with optimum pollutant removal efficiency.
Turf grass should not be cut shorter than 3 to 5 inches and may be allowed to grow as
tall as 12 inches depending on aesthetic requirements.
• Once a year, the soil shall be aerated and lime will be added if necessary.
• Weeds or shrubs growing on level spreader or in swale shall be removed.
• The level lip shall be inspected for settling, erosion, or concentrated flow.
After the filter strip /buffer /level spreader is established /installed, Owner shall inspect once a
quarter and within 24 hours after every storm event greater than 1.0 inches. Owner shall keep
records of inspection and maintenance in a known, set location and will be made available
upon request.

A wet detention basin is a stormwater management facility that includes a permanent
pool of water for removing pollutants and additional capacity above the permanent pool for
detaining stormwater runoff. The wet detention basin system is defined as the wet detention
basin, outlet structure, pretreatment including forebays, grassed swales, and the vegetated
filter if one is provided.
