The request for a modification of DCM 191 -05 permit will need to apply for a new 401 with monies. The original 401
issued December 9, 2005 for the damages done by hurricane Ophelia was written for a one -time event (condition # 6).
If the project stays above the high tide line then the DWQ will have no objection. If they need to work below the high
tide line, they will need to reapply for a 401 with monies.
