Authorization of Tar - Pamlico River Buffer Rule (15A NCAC 02B .0259) and
Session Law 2011 -394) Authorization Certificate
Dear Mr. Geewax:
You have our authorization, in accordance with 15 A NCAC 02B .0259 and
Session Law 2011 -394 any conditions listed below, to impact approximately
2,762 ftz of Zone 2 of the protected riparian buffer for the purpose of
constructing a driveway, parking area and single - family dwelling with open
slatted decks on the subject property as described in your application dated
October 17, 2012. In addition, you should obtain or otherwise comply with any
other required federal, state or local permit before you go ahead with your
project including (but not limited to) Erosion and Sediment Control, Non -
Discharge, 404 and CAMA regulations.
This approval is for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be
required to send us a new application. If the property is sold, the new owner
must be given a copy of this Certification and approval letter and is thereby
responsible for complying with all conditions. If total fills for this project (now
or in the future) exceed one acre of wetland or 150 linear feet of stream,
compensatory mitigation may be required as described in 15A NCAC 2H
.0506 (h). This approval requires you to follow the conditions listed in the
attached certification and any additional conditions listed below.

The following impacts are hereby approved as long as all of the other
specific and general conditions of this Certification (or Isolated Wetland
Permit) are met. No other impacts are approved including incidental
impacts:
2. Stormwater Management
5tormwater generated off the residential dwelling must be collected and
treated. This may be accomplished through the use of gutters and rain
barrels or by collecting and directing to a residential rain
garden /biotention area. An Operation and Maintenance Agreement (O &M
Agreement) will be required when utilizing the above - mentioned Best
Management Practices (BMPs). A bioretention cell consists of a
depression in the ground that supports various types of water - tolerant
vegetation. The surface of the BMP is depressed in bioretention cell to
allow for ponding of runoff that filters through the soil. Ponding depth
shall be 12 inches or less. No dimension (width, length, or radius) can be
less than 10 feet. This is to provide sufficient space for plants. A final
plan for stormwater treatment must be provided and approved by the
Division, including an O &M Agreement.
3. Diffuse Flow
An additional condition is that all stormwater shall be directed as diffuse
flow at non - erosive velocities through the protected stream buffers and
will not re- concentrate before discharging into the stream as identified
within 15A NCAC 2B . 0259(5).
4. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality
Certification or applicable Buffer Rules, and any subsequent modifications,
the applicant is required to return the attached certificate of completion to
the 401 Oversight /Express Review Permitting Unit, North Carolina Division
of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699 -1650.
Any disputes over determination regarding this Authorization Certificate
(associated with the approved buffer impacts) shall be referred in writing to
the Director for a decision. The Director's decision is subject to review as
provided in Article 3 and 3 of G.S. 150B. This Authorization Certificate shall
expire five (5) years from the date of this letter.

This letter completes the review of the "No Practical Alternatives"
determination under 15A NCAC 2B .0259 and Session Law 2011 -394. This
letter does not authorize any impacts to either Waters of the United States or
Waters of the State. Please contact the US Army Corps of Engineers (USACE),
Division of Coastal Management (DCM) or Division of Water Quality (DWQ) if
any impacts are proposed to either of these waters. If you have any
