Based on the results of this analysis, the Stormwater Permitting Unit determined that a permit was not needed for stormwater at this time. However, Mr. Sephen Timm is now requesting permission for Kings Mountain Venture to discharge the 75,000 gallons of stormwater that was collected for this analysis from the equalization basin. Mr. Timm has requested permission to discharge the stormwater to the South Fork Catawba River, classified WS-V waters, via the channel Outfall 001 uses as specified in Kings Mountain Venture's NPDES permit. According to Mr. Timm, no process wastewaters are contained in thi wastestream nor will any be mixed in the proposed temporary discharge. Analytical results show no contaminants of concern in the stormwater. Since this stormwater is to be discharged using the channel for Outfall 001, Kings Mountain Venture will be expected to adhere to its permit conditions and shall monitor the discharge as specified in Section A (1.) of its NPDES Permit. Kings Mountain Venture may proceed to discharge the 75,000 gallons of stormwater and hall report the discharge on its monthly Discharge Monitoring Reports. At least twenty-four hou}s prior to discharge the Mooresville Regional Office, Surface Water Protection Section, should be notified (704-663-1699) as to when the discharge will occur. It is our understanding that the equalization basin will then be proposed to treat the remaining process wastewaters inside the facility. Until adequate information is received, this permit can not be renewed. At a minimum, and prior to any discharge, Kings Mountain Venture is expected to submit a request to discharge the wastewaters which includes analytical test results on the quality of the wastewaters, the treatment that is to be provided and the discharge rate(s). To accurately characterize the process wastewaters contained in the tanks representative samples from different tank depths should be taken. In addition, the request should address how the sludge will be handled and disposed including the treatment/disposal of the filtrate. Additional information may be needed. The results don't indicated a problem, and I'd say we feel comfortable forgoing any stormwater requirements for an NPDES permit here. They should be okay to redirect stormwater from the WW treatment system. The only parameter that came anywhere close was a BOD measurement of 28 mg/I from sampling point 1, but even that is below the threshold of our 30 mg/I SW benchmark (that value's based on secondary treatment quality). I'll be out all day tomorrow, but we can talk more on Thursday. Let me know if I need to write up anything else to document our evaluation or correspondence to the company. Since you all are still working on an NPDES permit, I think it's probably sufficient too note it in that file and your correspondence. There shouldn't be a need to require an NPDES SW permit in this instarce because the site is no longer operating, and evidence does not indicate significant pollution from past industrial activities. From: Bell, Wes Sent: Tuesday, December 15, 2009 9:53 AM To: Georgoulias, Bethany; Grzyb, Julie Subject: RE: Kings Mountain Venture Bethany, I've talked with the on -site KMV personnel yesterday (I've left a message for Stephen to call me) and they can divide the site in three drainage areas and will hopefully be able to sample Thursday if we get another rainfall event. I told them to do volatiles and semi-volatiles at each drainage area. They had no problems with this sampling. They are in the process of placing all orange rectangular totes inside a building (previously cleaned). Once this is completed, they will have no containers outside...everything will be inside. A majority of the drums/containers have been removed off -site (venders, TSD facilities, etc.) and they are working with an outside vender who may also take these orange totes (which some have granular dyes still in them). 1 e Julie, the KMV personnel informed me that they are still getting bids for the treatment/disposal of the remaining wastewater in the tanks. No final treatment option has been decided. I may go out to the KMV site this Friday to check things out. He was going to investigate it and try to plan a sample from a representative storm event (so there's a dry period before the rain). The tank discharge is still the fourth outfall, so I told him there was no need to sample that again. That means samples from drains that are representative of what would flow to A, B, and C after the modifications. Also, I advised the 624/625 methods and other parameters that they sampled for the first time. I think it's reasonable considering the state of the site in the past. He'll probably get in touch with you soon if he hasn't already. Julie, I'll drop by to see if you're in today. The sample results they provided was taken from the equalization basin, but it might be more helpful for us to see data from points where the current drainage areas are feeding into that (since there will be multiple discharge points). I'll discuss the possibility with the consultant. Wes, do you know how the SW is routed to the equalization basin now? Is any of it collec ed and piped, or just all flowing by the grade (that they plan to re -grade to redirect runoff)? Julie was pretty impres ed by the previous state of things in the pictures, so I think it might be worth asking for a bit more info. to characterize what will be discharged. I'm going to call and talk more with the EPA rep about the agreement they came to and get some info. They don't need a stormwater permit unless the region thinks the discharges are contaminated enough from past activities to warrant it. Even though the stormwater was previously covered under a wastewater permit, there should not be the need for a separate stormwater permit once those are diverted, unless activities resume (or there is a concern about past activities). I looked at the data they provided in Stephen Timm's letter, and none of the constituent levels raised a concern for me. Venture and the old permit which was under the name. Yorkshire. I explained the case to Brian and hopefully he can give you the quick basics. Stephen Timm, their consultant, does not believe a permit is needed for the newly created stromwater outfalls since no industrial activity is occurring. This is true (the facility is being closed — it's a Brownfield site) and the site has been cleaned up — contact Wes Bell for more details. They have some old process wastewaters the former company left behind (2 MG) and they will eventually have to treat each vat,chemically, and then discharge it through the 001 outfall (which formerly was used for all stormwater and process wastewaters, however, Wes asked them to separate out the stormwater so they could treat and discharge the process wastewaters which have to pass through the equaliization basin) I do not believe they are discharging from the new storm outfalls yet — at least they were told not too. Anyway, Stephen is going to call you around 4 PM on Friday to see if you had a chance to look at this and determine if they need a permit for the stormwater outfalls. I am out at the Branch party till 3 and will stop by afterwards to answer any questions you might have. The site was broken down into three areas as outlined and highlighted on the . a . ched drawing (Area 1, 2 and 3). The exact contaminants to be analyzed from each area was ed by the Department thorough various emails between myself and the Department in the month of December. Once this information was received, Prism Laboratories was contracted to prepare the necessary bottle ware and perform the analysis of the storm water from a defined EPA storm event. On January 17, 2010, a defined storm water event occurred at the site and was sampled by site personnel. The storm event et the definition of a storm water event by the EPA. There was sufficient absence of precipitation for r 72 hours, plus the storm event that was sampled exceeded the 0.10 inch requirement. The actual storm event on the 17th generated approximately 1.linches of precipitation. Once the sampling was completed, the samples were picked up by a Prism Field Technician. The results of the sampling are summarized in the attached spreadsheet in addition to the actual laboratory analytical results and the corresponding QC data. Based on this information, King Mountain Ventre LLC feels that there is no contamination to the storm water leaving the site and is requesting formal authorization from the Department to divert all storm water from the existing wastewater treatment operation. In addition to this request for diversion, Kings Mountain Venture LLC is also requesting that no further analysis be performed on the associated storm water from this site. Once authorization is received from the Department concerning this matter, Kings Mountain Ventre LLC site personnel will start closing and blocking off all storm water basins that are associated with the existing wastewater opertion. This action will prevent any futher storm water from entering the existing wastewater operation. Upon completion of this task, Kings Mountain Venture LLC will submit a supplemental completion letter to the Department.
