AccordiTigly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant! to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). This final permit includes following changes from the draft sent to you on October 21, 2009. • Limits for BOD and COD were recalculated (increased) to provide the facility full allocation in accordance with 40 CFR 410.70 Subpart G Stock and Yarn Finishing Subcategory. The Division is ' unable to grant your request to increase the Total Suspended Solids (TSS) limit. The receiving steam is impaired due to high turbidity. According to current EPA policy, Y, facilities discharging to streams impaired for turbidity cannot increase their TSS load. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. (3) CHRONIC TOXICITY MONITORING/LIMIT — 0.5-MGD The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 0.62%. The permit holderishall perform at a minimum, quarterlu monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -Februarys 1998) or subsequent versions. The tests will be performed during the months of January, April, July and October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revis d-February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentraayy ion having no detectable impairment of reproduction or survival and the lowest concentration th4 does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, exposure regimes, and further statistical methods are specified in the "forth Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised - February 1998) oif subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity (AT) test form indicating t}j a facility name, permit number, pipe number, county, and the month/year of the report with the notation of "No Flow" in the comment area of the form. The report shall be submitted to the Environmental Sciences Branch at the address cited above. Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will brequired during the following month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. If the Permittee monitors any pollutant more frequently than required by this permit, the results of such monitoring shall be included in the calculation .86 reporting of the data submitted on the DMR 86 all AT Forms submitted. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. TOTAL NITROGEN AND PHOSPHORUS MONITORING The Permittee shall calculate the annual mass loading of total nitrogen as the sum of monthly loadings, according to the following equations: (a) Monthly Mass Loading (pounds/month) = TN/TP x Q x 8.34 where: TN = the average total nitrogen concentration (mg/L) of the composite samples collected during the month at the outfall TP = The average total phosphorus concentration (mg/L) of the composite samples collected during the month at the outfall Q = the total wastewater flow discharged during the month at the outfall(MG/mo.) 8.34 = conversion factor, from (mg/L x MG) to pounds (b) Annual Mass Loading (pounds/year) = (Monthly Mass Loadings) for the calendar year The Permittee shall report the total nitrogen and total phosphorus concentration for each sample and 4.1e monthly mass loading in the appropriate self -monitoring report and the annual mash loading of total nitrogen and total phosphorus in the December self - monitoring report for the year. A. (6) Color Permitting Requirements for Tier 1 Facility This facility has been classified as a Tier 1 color discharger. The permittee will conduct color monitoring of instream stations (upstream, downstream) on a monthly basis during summer season (April -October) . The permittee will record whether a color plume was observed around the ouifall pipe during the monthly instream sampling events, and include that information on the monthly discharge monitoring report. Effluent samples Will be collected monthly for color on a year-round basis. Color samples will be analyzed for ADMI color at natural pH. Effluent samples will consist of 24-hour composites, while instream samples will be collected as grabs. Samples will be analyzed by a state certified laboratory. If data show that water quality standards for color are being violated by the discharge permitted by the terms of this permit, then the Director may reopen this permit for the purpose of imposing additional requirements pursuant to 15A NCAC 2H.0114. Alternatively, if future conditions change and color is no longer a component of the influent wastestream, then the permittee may request a permit modification to remove color permit requirements. I do have one concern. It appears the TSS limits in the final are an increase above those in the draft permit. I believe the receiving stream is on NC's 208 303(d) list as impaired for turbidity. If that is correct, this permit should not increase the TSS loading. Do you agree? WWTP treats industrial waste created at the McAdenville facility as well as domestic waste from three Pharr Yarns plants (including the McAdenville plant). The domestic waste from the three Pharr Yarns plants constitutes the majority (73%) of the waste stream, the remainder is process wastewater from the yam dying that occurs at the McAdenville plant. As a discharger to the South Fork Catawba River, the facility is subject to the nutrient limits and special monitoring requirements pertaining to color in an effort to improve water quality in that receiving stream. TECHNOLOGY 113ASED EFFLUENT LIMIT DEVELOPMENT Reasonable measure of actual production for the facility was established based on the EPA policy (21,619 lb/day). BOD5, COD, and TSS are based on effluent guidelines (40 CFR 410.70 Subpart G Stock and Yarn Finishing Subcategory) and have been recalculated to reflect the most current data available (See attached spreadsheet). COD allocation for domestic wastewater component was calculated using the formula 2.2 X BOD. The 2.2 multiplier was established during the previous permit renewal using site -specific factors and Best Professional Judgment. The results of these calculations are slightly different than the limits in the current permit. Since the facility has no plans to expand production in the foreseeable future (per the facility), it is recommended that the new limits be implemented. Fact Sheet NPDES NC0004812 Renewal Page 1 Pharr Yarns has had operator and equipment issues and problems with slug loads (with high BOD) being discharged into the plant's influent. They have changed over to a liquid chlorination system but fecal violations continued. They requested a technical assistance visit, which was performed during the summer of 2009. They have hired an engineering firm to go through the entire plant and discussed making modifications to the plant. MRO has previously met with Pharr Yarns staff to discuss these issues and the numerous limit violations. INSTREAM MONITORING The facility is required to conduct self -monitoring of the South Fork Catawba River at one location upstream of the discharge and one location downstream of the discharge. The instream self -monitoring includes: fecal coliform, temperature, conductivity, color and dissolved oxygen. An analysis of DO, temperature and conductivity for the period from 01/01/2006 through 08/31/2009 showed that the facility have negligible negative impact on the receiving stream. During the review period, the dissolved oxygen fell below 5 mg/L only once. On 07/05/07 dissolved oxygen downstream of the discharge was measured at 3.0 mg/L, measurement upstream of the discharge was also 3.0 mg/L. REASONABLE POTENTIAL ANALYSIS Reasonable potential analysis was conducted for Chromium and Phenols at 0.5 MGD and 1.0 MGD. Based on RPA, no water quality based limits are recommended. PROPOSED CHANGES • Monitoring Frequencies: No changes are proposed. • Limits: Limits for BOD, COD, TSS, Sulfide, Phenols, and Total Chromium have been recalculated based on the most recent production data in the permit application. PART IV - EVALUATION AND RECOMMENDATIONS Pharr Yarns is requesting renewal of the subject Permit. There have been no changes to the existing WWT facility or the NPDES permit since the permit was last renewed. Pharr Yarns and EPA had a Show cause on November 10, 2009 regarding non-compliance issues at the WWT plant. It should be noted that Pharr Yarn has been in non-compliance with its permit for several months during the past year. It is our understanding that the non-compliance issues at the plant are due mainly to lack of operation and maintenance. Pharr Yarn is contributing the non-compliance issues to many factors including the large volume of high strength batch wastewater releases from the dying process to the WWTP, the loss of filter media from one of the three (3) pressure filter, inconsistency in chlorine solution concentration as the tablets dissolved. Also, in order to address the forgoing violations, Pharr Yarns has increased the frequency of effluent sampling and analysis to provide a better representation of monthly average effluent quality, minimize normal analytical variations and provide an earlier indication of WWTP process problems to allow proces's adjustments. Also, as indicated in letter to the U.S. Environmental Protection Agency dated l41ay 13, 2009, Pharr Yarns is planning a preliminary evaluation of wastewater treatment operator practices and staffing for the facility. During the investigation on October 22, 2009, new media filters were placed at the facility but not yet connected to the WWTP. Sludge generated in the plant is controlled by doing daily settleability tests on the aeration basin and sludge depth tests on the clarifiers.
