The corridor st arts in the southern portion of the City of Salisbury and ends in the northern portion of the City of Kannapolis. The study area associated with this project consists of the area within 100 f eet of the center of the existing and within the footprints of multiple proposed grade-separated railroad crossings and roadway improvements, which are irregularly-shaped areas generally located adjacent to , or extending outward from, the railroad (Figures 1 and 2A through 2K). The study area for this project encompasses approximately 959.2 acres The P-5206 project has been split into two com ponents that have each been determined to demonstrate independent utilit y: a track work component of the project and a safety improvements component of the project (per a meeting between the Rail Division, the U.S. Army Corps of Engineers [USACE], and the N.C. Division of Water Qu ality [NCDWQ] held on April 5, 2012).   This permit application is requesting authoriz ation for Section 404 juri sdictional area impacts associated with the safety improvements componen t of the project (P-5206A ). P-5206A consists of the realignment of P eeler Road (SR 2538) to a new two-lane bridge over the rail and closure of the existing at-grade crossings of Peel er Road and Peach Orchard Road (SR 2539). Information within this package has been prep ared to support the application for a Nationwide Permit (NWP) 14 (Linear Transportation Project s) and NWP 33 (Temporary Construction, Access, and Dewatering), along with the associated NCDWQ Water Quality General Certifications 3886 and 3893, respectively. The Environmental Assessment (EA) document for this project was finalized in October 2011 and was submitted to the appropriate regulator y agencies for review. A Finding of No Significant Impact (FONSI) was approve d on July 18, 2012 and is attached. Water resources in the projec t area are located within NC DWQ sub-basin 03-07-04 of the Yadkin River basin (U.S. Geological Survey [USGS] Hydrologic Unit [HU] 03040103). Figures 2A through 2K depict the project area, and Figures 3 and 4A through 4N depict jurisdictional and isolated area locations and extent s within the project area. Jurisdictional areas in the vicinity of the P-5206A portion of the project are depicted on Figure 4E. The Rail Division is requesting an approved ju risdictional determination for streams and wetlands within the project area in co njunction with this permit application. Surface waters impacted by the P-5206A project drain to Town Creek, which is listed on the North Carolina 2012 Final 303(d) List of Impaired Waters. Town Creek is listed due to “Fair” fish and benthos bioclassificati on ratings. Stormwater Management plans have been designed to treat stormwater runoff through Best Management Practices (BMPs) as detailed in the most recent version of NCDOT’s Stormwater Best Management Practices to minimize further impairment of downstream water resources. Table 1 and the attached Wetland Impact Permit Summary summarize the total impacts to jurisdicti onal areas, and each impact site is described below and depicted on the at tached permit drawings. This results from the closure of the existing Peeler Road at- grade crossing of the rail and th e realignment of Peeler Road to cross the rail with a grade- separated crossing approximately 1700 feet east of the existing crossing. Approximately 221 linear feet of the existing intermittent stream (Stream SF on the attached jurisdictional area delineation figures) will be placed within a pr oposed 48-inch reinforced concrete pipe (RCP) under the realignment of Peeler Road. Approxi mately 0.09 acre of wetland (Wetland WJ on the attached jurisdictional area delineation figures) will be filled by the proposed roadway slope. The remainder of this wetland area (approximately 0.01 acre) will also be lost due to the piping of Stream SF and the resultant removal of wetl and hydrology. This result s in a total wetland loss of 0.10 acre. Approximately 0.01 acre of Wetland WI will also be lost due to mechanical clearing for the roadway slope. Wetlands WI and WJ are both NC We tland Assessment Method (NC WAM) Headwater Forest wetlands with overall functional ratings of High. Temporary impacts associated with dewateri ng the site for constr uction will occur to approximately 52 linear feet (less than 0.01 acre of surface water). Alternatives considered for th e location of the proposed driveway include positioning of the proposed stream crossing of Peeler Road east and to the west of th e proposed crossing. Placement of the crossing in its current location is intended to minimize impacts to jurisdictional streams and wetlands by crossing the intermittent Stream SF in a location that lacks an existing   stream channel for a distance of approximately 100 linear feet and also impacts as little wetland area as possible. The piping of Stream SF effectively remove s the hydrology for Wetland WJ. Therefore, placement of the crossing to the nor thwest of the proposed crossing by a sufficient distance to avoid impacts to Wetland WJ would im pact a larger area of jurisdictional wetlands WH and WI and a greater length of Stream SF, as the crossing would necessarily be at an oblique angle to the stream in order to avoid the industrial build ing located immediately to the south. Placement of the crossing to the so utheast of the proposed crossing by a sufficient distance to avoid impacts to Wetland WJ would require sharper, less ideal curves leading to each approach to the crossing and is anticipated to impact approximate ly 100 additional linear feet of Stream SF. Mitigation for this project is proposed at a 1:1 ra tio for impacts to the intermittent Stream SF and at a 2:1 ratio for impacts to Wetlands WI and WJ. The following table details proposed mitigation requirements for this project. Table 2.
