On September 11, 2012, the Division of Water Quality (Division) issued a 401 Water Quality Certification
for your project. This project is covered by General Water Quality Certification Number(s) 3884
(GC3884). Please note that Condition 20 of this certification states:
"If an environmental document is required under the National or State Environmental Policy
Act (NEPA or SEPA), then this General Certification is not valid until a Finding of No
Significant Impact ( FONSI) or Record of Decision (ROD) is issued by the State Clearinghouse."
It is our understanding that neither a FONSI nor a ROD has been issued, so the 401 is not currently valid.
When a FONSI or ROD is issued, please send two (2) copies to the Wetlands, Buffers, Stormwater-
Compliance and Permitting (Webscape) Unit, 1650 Mail Service Center, Raleigh, NC 27699 -1650. After
reviewing the FONSI or ROD, the Division may determine that the 401 Water Quality Certification will be
modified [pursuant to 15A NCAC 02H .0507(d)].
