Classification: UNCLASSIFIED Caveats: NONE 20120218 M iIN11 US Army Corps PUBLIC NOTICE Of Engineers Wilmington District Issue Date: February 28, 2012 Comment Deadline: March 28, 2012 Corps Action ID #: SAW- 2012 -00286 The Wilmington District, Corps of Engineers (Corps) has received an application from the Town of Holden Beach seeking Department of the Army authorization to dredge approximately 1,300,000 cy of material from a borrow area located 1.8 to 3.0 miles offshore of Oak Island and to place this material onto approximately 22,000 feet of shoreline in Holden Beach, Brunswick County, North Carolina. Specific plans and location information are described below. This Public Notice and all plans are also available on the Wilmington District Web Site at http: / /www.saw.usace.army.miI /Wetlands /. Box 20336 Charleston SC 29413 Authority The Corps will evaluate this request and a decide whether to issue, conditionally issue, or deny the proposed modification pursuant to applicable procedures of Section 404 of the Clean Water Act (33 USC 1344) and Section 10 of the River and Harbors Act. Location The project site is located on the shoreline of Holden Beach, Brunswick County, North Carolina. Holden Beach is a 9 mile long transgressive barrier island bounded on east side by Lockwoods Folly Inlet and by the west by Shallotte Inlet. The geographic coordinates of Holden Beach are Latitude 330 54.8516'N ; Longitude 780 16.0674'W . The proposed borrow areas are located 1.8 to 3 miles offshore of Holden Beach. Version 12/12/05 Background On February 15, 2006, the Town of Holden Beach was issued a permit to place upland borrow material in two sections along the town's ocean front. The original DA permit (Action ID SAW- 2005- 00935) authorized the placement of 500,000 cubic yards of beach fill along two shoreline reaches of Holden Beach. On July 7, 2006, the permit was suspended due to the incompatible material that was placed on the beach. Shortly thereafter, the town satisfactorily removed all the incompatible material that had been placed. On October 1, 2007 the DA permit was re- instated to the town. In the spring of 2009, the town continued with its project but did not complete it. The total remaining volume of upland beach fill material that can be placed under this permit is approximately 64,000 cy. The DA authorization for this subject permit will expire on December 31, 2014. Applicant's Stated Purpose According to information provided by the applicant, the proposed project is to provide beach restoration along eroding sections of shoreline sufficient to maintain the island's restored protective and recreational beachfront and natural dune system. Project Description The proposed plan includes dredging, via a hopper dredge, approximately 1,300,000 cy of material from an offshore borrow area located 1.8 to 3.0 miles offshore of Oak Island and to place this material onto approximately 22,000 feet of shoreline in Holden Beach, Brunswick County, North Carolina. The proposed area of beach fill is between Stations 40 +00 and 260 +00 and will taper (approximately 1,500- 2,000 ft) at each end of the beach fill. The proposed project design consists of a dune that is 9.5 ft high by 25 ft wide that will transition to a beach berm at an elevation of 7.0'. The beach berm width will vary from 140 ft to 190 ft. All heights and elevations are relative to NGVD29. Borrow Area Locations The applicant has identified a 509 acre borrow area located between 1.8 and 3.0 miles offshore of Oak Island and Holden Beach. Water depths within the borrow area range from 33 ft to 39 ft (NGVD2). The estimated volume of beach compatible sand ranges from 1.9 mcy (for a cut depth of 2.0 ft) to 3.3 mcy (for a cut depth of 3.5 ft). A shallow cut (less than 3.5 feet) is proposed due to the presence of unsuitable material below this depth. The proposal includes using a Hopper Dredge for this project. Project Impacts The proposed project will remove approximately 1,300,000 cy from approximately 509 acres of ocean bottoms and place this material onto approximated 38 acres of dry beach and intertidal areas located along the Holden Beach shoreline. Version 12/12/05 Other Required Authorizations This notice and all applicable application materials are being forwarded to the appropriate State agencies for review. The Corps will generally not make a final permit decision until the North Carolina Division of Water Quality (NCDWQ) issues, denies, or waives State certification required by Section 401 of the Clean Water Act (PL 92 -500). All persons desiring to make comments regarding the application for certification under Section 401 of the Clean Water Act should do so in writing delivered to the North Carolina Division of Water Quality (NCDWQ), 1650 Mail Service Center, Raleigh, North Carolina 27699 -1650 Attention: Mr. Ian McMillan by March 21, 2012. Coastal Zone Management Program The applicant has applied for a development permit through the North Carolina Division of Coastal Management ( NCDCM) in compliance with the North Carolina Coastal Zone Management Program. Generally, the Corps will not issue a Department of the Army (DA) permit until the NCDCM notifies the Corps that it concurs that the proposed work is consistent with their regulations. Essential Fish Habitat This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson- Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project may adversely impact EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. The proposed dredging and beach fill activities may adversely impact nesting sea turtles and EFH habitat along the Holden Beach intertidal shoreline and proposed offshore borrow area. Cultural Resources The Corps has consulted the latest published version of the National Register of Historic Places and is not aware that any registered properties, or properties listed as being eligible for inclusion therein are located within the project area or will be affected by the proposed work. Presently, unknown archeological, scientific, prehistoric, or historical data may be located within the project area and /or could be affected by the proposed work. Endangered Species The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined pursuant to the Endangered Species Act of 1973 (ESA), that the proposed project may affect federally listed endangered or threatened species or their formally designated critical habitat. The proposed dredging and beach fill construction activities may adversely impact nesting sea turtles and birds. Version 12/12/05 Consultation under Section 7 of the ESA will be initiated and no permit will be issued until the consultation process is complete. Evaluation and Commenting Information The Corps of Engineers is soliciting comments from the public; Federal, State and local agencies and officials, including any consolidate State Viewpoint or written position of the Governor; Indian Tribes and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, flood plain values (in accordance with Executive Order 11988), land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership, and, in general, the needs and welfare of the people. The Corps has reviewed the proposal and has examined all information provided by the sponsors. Preliminary review of this proposal indicates that an environmental impact statement (EIS) will not be required. Written comments pertinent to the proposed work, as outlined above, will be received by the Corps of Engineers, Wilmington District, until 5pm, March 28, 2010.
