Director, Division of Environmental Management From: Ken Eagleson Assistant Water Quality Section Chief, for Environmental Sciences Subject: Recommendation of the Hearing Officer regarding Issuance of NPDES No. NC0020664 for the Spindale Waste Water Treatment Plant Background The Town of Spindale has applied for a new NPDES permit which will allow continued discharge of 6.0 MGD extended aeration wastewater into Hollands Creek and after receiving an Authorization to Construct to relocate the outfall to Catheys Creek. Both Creeks are located in the Broad River Basin in Rutherford County and both are classified as Class Five Water Supply Watersheds. Hollands Creek, which now includes the Spindale discharge, is a tributary to Catheys Creek. The proposed alternative discharge point is immediately below the confluence of these two creeks. This means that the point of the proposed discharge already includes the Spindale wastewater. The wastewater travels approximately 2.5 river miles until it reaches the Second Broad River. These discharge locations may be viewed in Figure One. The Town of Spindale has intermittently failed to meet the Whole Effluent Toxicity Limitation within its current permit. In March of 1992, this Division sent a letter to the Town suggesting that the pending NPDES permit renewal include the request for a second outfall discharge option to Catheys Creek. The new location would have a higher low flow stream volume and therefore have less stringent effluent limitations. Most effluent limitations proposed for the existing discharge point would be increased by slightly more than two times in the Catheys Creek location. Flow volumes would be 6 MGD at both locations. This indicates that total loadings would be significantly increased although the limits were derived to protect water quality as required by regulation . A review of Whole Effluent Toxicity (WET) reduction efforts indicates that the Town of Spindale is currently meeting the requirements under its NPDES for WET. The sudden ability to comply with the WET limits coincides with Tultex removing its discharge to the WWTP. The wastewater is comprised of approximately 85% domestic and 15% industrial. Industrial contributors are classified as textile and metal finishing. *****. check this out as fact sheet and WLA fact sheet are contradictory. While reviewing the proposed NPDES Permit I identified an additional issue that was not directly addressed by the concerned citizens who requested the Public Meeting. The Second Broad is the source for several drinking water withdrawals. This use competes with its use as the receiving stream for wastewater discharge. The permit as currently drafted does not reflect the true stream volume at the proposed point of discharge. The true low flow stream volume was not know until the Water Quality Sectiqn reviewed as Environmental Assessment on a Water Treatment Plant Expansion for Forest City. In mycapacity as Hearing reat p Y P Y Officer, I asked that a new wasteload allocation be prepared using the actual 7Q10 value for the Second Broad River. DEM's models predict Water Quality Violat'ons for Dissolved Oxygen within the Second Broad under the proposed permit. On ******* you assigned me as Hearing Officer with regard to the issuance of this proposed permit. The hearing was held on February ******* in the ******* in the Town of Spindale. This memorandum summarizes t e public comment and provides my recommendation. Public Hearing There were 29 people in attendance at the Public Hearing. Five people spoke and 6 written comments were received. Most individuals who spoke were concerned with what they described as an overall deterioration of the water related environments not only in the waste receiving tributaries but also and in some instances more importantly the Second Broad River itself. While there were only a limited amount of speakers, most emphasized the issues of degraded fish populations (including frequent presence of sores on the flesh) , color, foaming and bacterial pop lations. The Textile Manufacturing Association was present and did offer comments. Their comments indicated support for the proposed NPDES permit as Drafted. I have also received letters of support from the foll wing industries located near the Town of Spindale: Stonecuter M Its Corporation, The New Cherokee Corporation, Spring Ford Knitting Co., Elmore -Pisgah Inc. and Mastercraft Corporation. At the earing I was presented with photographs that were labeled as Holland Crieek below the WWTP discharge. The photographs were presented to demonstrate problems with foaming and color. My inspection of the photographs clearly identified heavy foaming but I was unable to clearly see a color problem from the photographs although this is very difficult to capture in a photograph. My inspection of Hollands Creek on the day of the hearing. at the first road crossing below the WWTP did not identify a foaming condition. The residents presented this condition as frequent but intermittent, however. My Brapch performed a biological survey on the stream above and below the Spindale WWTP discharge in April, 1988. At this time, we had documented a decline in water quality as reflected by benthic macroinvertebrates with downstream conditions being rated as Poor while upstream conditions were rated as Good/Fair. Field notes at that time indicated that the water was very dark with lots of suspended solids. Since that study a pretreatment program has been put in place by the Town. I do of have any biological information on the drainage since that time. During he public meeting, Steve Reid of the Asheville Regional iv Office presented an overview of the objectives and responsibilities that this agency holds with regard to managing the many, and sometimes conflicting uses of this small but heavily utilized watershed. • Most speakers tha opposed the relocation, also acknowledged that there should be a compromise solution that protects the natural resources without penalizing the local economies. Recommendations of the Hearing Officer In my review of this permit issuance, it is my finding that the permit should be issued as drafted with the following modifications: 1.) Based on the new information regarding 7Q10 stream flows in the Second Broad the parameters of BOD5 and NH3-N should be reduced. The new limits for Summer should be: BOD5 19.5 25.5 MG/L NH3-N 1 2 10 MG/L Do ` -37( These revised limits are predicted to cause a minimum Dissolved Oxygen level of 5.08 MG/L, 1.6 miles below the J.C. Cowan's outfall. Winter limits might also bei calculated but the Winter 7Q10 was not available at the time of this report. The request for this data has been made and will be available in the near term. A review of he compliance monitoring information for the period 92/08 to 93/07 (attached) indicates that the facility should be able to comply with these limitations. 2.) The permit should be issued with all parameters as proposed, exclusive of recommendation #1. These components, by my review have been allocated in accordance with our water quality standards. 3.) The Environmental Sciences Branch should conduct a comprehensive assessment of conditions both biological and chemical as requested by, and in cooperation with the Asheville Regional Office. This study would be designed to characterize the existing environmental conditions so that this regulatory agency and the concerned citizens and environmental groups will be able to discuss the sometimes conflicting uses of the Second Broad River basin resources with a complete and accurate description of existing conditions. 4.) Future water withdrawals as have already been proposed from areas of the Second Broad basin should be carefully addressed so that other uses of the watershed for wastewater discharge may be appropriately considered. The Spindale NPDES Permit contains a Limitation Reopener Condition that allows the DEM to alter the limits for oxygen consuming wastes should water quality standard violations be documentede U Pr-)— 1 5.) All interacting WWTP discharges within the segments where 7Q10 estimates have been revised should be reallocated at the new 7Q10 when their permits come up for renewal. You should be aware that the assimilative apacity for oxygen consuming wastes within this Second Broad basin is at or very near levels capable of meeting water quality standards for dissolved oxygen. Industrial and Municipal Officials within the basin should also be aware that when assimilative capacities are at a maximum then the actions of one Permit holder are often influenced by the requirements of another. Future expansions or modifications of NPDES permits or water withdrawals must be addressed by this agency in a comprehensife manner. It is imperative that these issues be well documented and analyzed in the Basinwide Planning document to be developed in the 1995 management proposal. Nowell 41114\ SUBJECT: Rescission of Monitoring Requirement for Tetrachloroethylene Town of Spindale NPDES Permit No. NC0020664 Rutherford County The Instream Assessment Unit has reviewed the request from the subject facility. The monitoring requirement for tetrachloroethylene was recommended in the wasteload allocation completed April 2, 1990. The Environmental Defense Fund had submitted data to EPA showing Stonecutter Mill as the source of this chemical, with a loading of 32,000 - 51,000 lbs/year. The data from Spindale's 1990-93 APAMs indicates that tetrachloroethylene is no longer present in detectable levels. In addition, Stonecutter Mills states that the chemical is longer used in their textile process. After consultation with Tom Poe of Pretreatment on whether other dischargers may have the chemical in their wastewater, we recommend that effluent monitoring for tetrachloroethylene be discontinued. Nowell UWr SUBJECT: Updated Limits for the Town of Spindale WWTP Rutherford County Tle Instream Assessment Unit has reevaluated the effluent limits for the subject facility based on the revised 7Q10 flows of the Second Broad River. The stream flow used inprevious Level B modeling analyses have been lowered due to existing and proposed withdrawals of the Forest City water treatment plant. A preliminary modelling analyses was done for Spindale at the proposed relocation into Catheys Creek to determine effluent limits to protect the DO standard of 5 mg/1 in the Second Broad River. Because there is interaction of the discharge waste from Spindale and Forest City, the two municipalities were modeled together. It should also be noted that the wasteflow for the Forest City discharge has been revised. Forest City has submitted documentation to the Division that the design capacity has been upgraded from 4.25 MGD to 4.95 M D. The tentative limits for the Spindale WWTP under the two water plant scenarios are as follows At the existing water plant withdrawal of 8 MGD: BOD5 19.5 mg/1 NH3-N 12 mg/1 DO 6 mg/1 Fecal 200/100m1 TSS 30 mg/1 pH 6-9 SU or BOD5 25.5 mg/1 NH3-N 10 mg/1 DO 6 mg/1 Fecal 200/100m1 TSS 30 mg/1 pH 6-9 SU With Forest City receiving equivalent limits to Spindale, the model predicts a DO minimum df 5.08 mg/1 occurring 1.6 miles below J.C. This expansion is predicted to result in reduced steam flow in the Second Broad River. This reduction in flow may result in more stringent effluent limitations at your wastewater treatment plant in the future. Of particular concern is the potential for instream dissolved oxygen standard violations.
