A severe failure of this system occurred during a February 2019 storm event that washed-out a section of Old Howard Gap Road. Though considerable time has passed, repairs of the drainage system are still considered urgent due to the potential for failures closer to or even under I-26. This letter is intended to apprise you of anticipated compliance of the project with the 4(d)Rule for Northern Long-eared bat (NLEB,Myotis septentrionalis)and to seek your concurrence with an effect determination and conservation measures for the project for white irisette (Sisyrinchium dichotomum,US Endangered). This letter constitutes a revision of the initial request made to your office on February 2, 2021. The revision updates population information gathered from additional survey and details the adjustments made to the plan to reduce the number of plants directly or indirectly affected by the project. NLEB As of December 22,2020,NLEB is listed by U.S. Fish and Wildlife Service(USFWS) (http://www.fws.gov/raleigh/species/cntylist/nc_counties.html)as"Current"in Polk County. According to current Natural Heritage data there are no NLEB records within 1 mile of the site. The project area does not fall within a"red huc"for NLEB (https://www.fws.gov/asheville/htmis/project_review/NLEB_in_WNC.html). For the proposed action,NCDOT has committed to the conservation measures listed below: • No alterations of a known hibernacula entrance or interior environment if it impairs an essential behavioral pattern, including sheltering northern long-eared bats(January 1 through December 31); • No tree removal within a 0.25 mile radius of a known hibernacula(January 1 through December 31); and • No cutting or destroying a known, occupied maternity roost tree,or any other trees within a 150-foot radius from the known, occupied maternity tree during the period from June 1 through and including July 31. Although obligations are fulfilled,NCDOT will also avoid to the extent possible any tree clearing from June 1 to July 31 to help ensure that pups of bats that are potentially remaining in affected trees are already volate and not incidentally harmed. Botanical Surveys The project area is situated on White Oak Mountain where white irisette have been documented previously. With prior written approval from the USFWS to survey for white irisette outside of the appropriate survey window,the project area was thoroughly surveyed on September 14, 15, 21,24, and 30,2020 by Division 14 staff(Dave McHenry and Kevin Barnett)and Ryan Elliot with TGS Engineers. Presence of white irisette at a nearby reference location on Skyuka Mountain Road(SR 1136)was confirmed before surveys were undertaken. Additional areas adjacent to the project area were surveyed on October 15 and November 4, 2020, again after confirming that white irisette were still detectable nearby. Three population groups or clusters were found during surveys (Fig. 1). The most exhaustively surveyed"population"is situated within a southern"dog-leg"of the study area where a drainage line is proposed(Fig. 2A) The drainage line must be located in this general location in order to avoid transfer of stormwater between watersheds while also avoiding an unstable slide area immediately to the west(see red cross-hatched areas in Fig. 2A and on Roadway Plan Set)and extremely steep rocky terrain to the east. The two other population clusters are situated near the periphery of the study area and are not anticipated to be affected by the project. Additional irisette plants were found in the "dog-leg"area on March 2 and 8, 2021 during right-of-way and easement staking for the project. So, additional intensive survey work was completed on March 22, 2021 with assistance of NCDOT Central Natural Environmental Unit staff(Anne Burroughs and Jared Gray) to better ascertain the overall population here and help determine if project redesign should be undertaken further. While small-whorled pogonia(Isotria medeoloides, SWP) is not currently known to occur in Polk County, it was included in visual surveys for the sake of a thorough review of the site. SWP grows in secondary growth deciduous forests or deciduous-coniferous forests,with an open canopy,open shrub layer, and sparse herb layer. It prefers acidic soils. Dwarf-flowered heartleaf (Hexasytlis naniflora,DFHL) is known to occur in some forested areas of Polk County,mostly in the piedmont region. The survey windows for white irisette, SWP, and DFHL were not optimal when surveys were conducted. Nevertheless,no SWP or hexastylis species were observed during the surveys. Much of the project area,particularly on and near the fill slopes below 1-26 and/or near the transmission line corridor,has dense overstory and shrub vegetative covers which are typically inhibitive of all three species. SWP and DFHL plants also prefer acidic soils versus the more neutral to alkaline soils that white irisette prefers,as are commonly found in the project area on White Oak Mountain. Consultation History NCDOT staff correspondences with USFWS staffs(Rebekah Reid,Janet Mizzi, and/or Holland Youngman)concerning the project included, in part,the following: • September 9,2020 emails regarding the need for white irisette survey for the project and permission from the USFWS to survey for the species outside of the appropriate survey window; 3 • September 23,2020 emails regarding evaluation of a drainage design shift to avoid white irisette; • October 30,2020 emails regarding possible directional boring and construction access from the south to avoid white irisette; • December 8,2020 emails which followed-up a phone discussion concerning arising access and technical limitations; and • December 10,2020 tele-conference regarding the overall project status and the constructability problems, access limitations, and white irisette conservation considerations; • January 27,2021 email and follow-up coordination on relocation and monitoring plan. • February 2, 2021 email transmittal of project Section 7 concurrence request. • March 3, 2021 email informing USFWS about discovering more plants during right-of- way staking. Avoidance and Minimization Efforts for White Irisette. As noted previously, a portion of the new drainage line needs to be constructed through a portion of the largest population cluster of white irisette that was found in surveys (initially tallied n=118+individuals; increased to approximately 228 individuals in March 2021 surveys). This line must extend approximately 1000 feet down the grade from Old Howard Gap Road in order to divert stormwater from an unstable slope(see southern"dog-leg"in Fig. 2A). Furthermore,the drainage must also then be routed back to the stream below this unstable slope in order to avoid introducing additional stormwater into an adjoining watershed where it would likely induce stream erosion and potentially cause hydraulic trespass concerns. Avoiding all direct impacts with the southern drainage line extension was not possible with the original design, so a directional bore was evaluated to install a section of the drainage line under the white irisette(plants). On November 20,2020,NCDOT staffs, design engineers, and qualified contractors evaluated the constructability of this option in the field,as well as evaluated other aspects of the drainage design. Due to extremely steep grades(average 30%)it was determined from this meeting and subsequent conversations that directional boring would be impractical and very impactful in this situation,particularly if it had to be accomplished by bringing equipment downslope from Old Howard Gap Road. In addition to the constructability issue,the landowner where the southern drainage line terminates recently declined to allow construction access to the proposed drainage line through their property from the south. Access from adjoining properties from the southeast is prohibitive as well because the population of white irisette apparently extends further in that direction than initially documented. To prevent stream scour below the drainage line, a substantive rock-lined scour pool is required. Therefore,the access limitation imposed by the landowner and the inability to disturb the unstable slide area dictates construction of a road from Old Howard Gap and downslope through some portion of the white irisette population. As noted above, exhaustive efforts to completely avoid direct impacts to any white irisette on the project were undertaken but have ultimately proven prohibitive or impractical. However, direct and indirect impacts have been extensively minimized by minor drainage line alignment shifts. The initial plan(before additional plants were noted in March 2021)would require directly impacting only two plants and possibly a 3rd unrecorded plant(see Fig. 2A). In addition to direct impacts,there were only 5 plants believed to be within 20 feet and about 22 plants within 20-40 feet of the proposed clearing limits that may be exposed to increased light conditions due to the canopy clearing within the easement. However, the number of individual plants was markedly higher than first accounted. This included the discovery of three more dense "clusters"of plants, 4 two of which combined represent 42 plants and that were within the initially proposed clearing limits. Therefore, the project was redesigned further to minimize to the extent practical the direct and indirect impacts of the project on individual plants (Figure 2A). Based on the revised plant numbers and redesign the drain line, the project will impact 12-15 irisette plants and potentially indirectly affect 35 plants within 20 feet and about 90 plants within 20-40 feet of the proposed clearing limits. Although the project area already contains invasive plant species(primarily Sericea lespedeza, kudzu, and Japanese stilt grass),the project could introduce more invasive plant material, either through hydroseeding or contaminated construction equipment. Conservation and Mitigative Measures for White Irisette NCDOT is committed to the following measures to mitigate or help conserve white irisette: • Plants directly impacted in the construction easement will be relocated onto suitable habitat near the existing population(i.e. on same or adjoining ridge lines),but beyond any areas of future maintenance of Old Howard Gap or the drainage line or areas of potential indirect impacts from forest clearing and associated light changes. NCDOT staffs will determine a suitable site in coordination with USFWS and perform relocation of the plants. Directly affected plants will be transplanted in March or April 2021. If plants cannot be immediately replanted into their final locations in spring 2021,they will either be temporarily placed in pots or transplanting will be delayed until October 15, 2021 or later. Any potted plants will be held at a suitable facility such as the UNC Botanical Garden, Chimney Rock Park, or similar facility until they can be planted during the next appropriate time. • Relocated plants,plants potentially indirectly impacted, and other plants within NCDOT PDE(approximately 2-7 170 plants)will be monitored for 5 years. Plants will be checked quarterly the first growing season and then annually each growing season thereafter with annual reports provided to USFWS. Invasive and/or competing vegetation near the relocated plants (12-15) and plants that may be indirectly affected by the project will be assessed(see monitoring area on Fig. 2A). If plants are found to be impacted, a plan to address invasive or other encroachment will be submitted to the Asheville USFWS office along with the annual monitoring report. • Stumps along the edges of the cleared areas will remain in the ground wherever possible to accelerate reforestation. • Heavy equipment accessing the southern drain line, or other portions of the property held by the Conserving Carolina Land Trust,will be pressure-washed before coming on-site to reduce the potential for further introductions of invasive plants. • Safety fence will be erected between all land disturbing activity and environmentally sensitive areas that may harbor white irisette. • A preconstruction meeting,including follow-up in-field meeting immediately before clearing,will be held with the contractor to ensure familiarity with protective measures. USFWS will be invited to these meetings at least 2-weeks in advance. • Erosion control will be accomplished in accordance with the attached plan that was adopted in part from a plan for invasive and/or competing vegetation types on a nearby NCDOT project with white irisette(SR 1136 Skyuka Mountain Road). After USFWS approval,invasive plants sprouted in the disturbed areas will be controlled with herbicides within 2 years of project completion by currently licensed NCDOT applicators. NCDOT Division 14 and/or Central staffs familiar with the plants will survey any application areas in advance for white irisette plants and conspicuously,but temporarily,mark their locations. Cardboard or other barriers will be used as needed to block drift of herbicide treatments that are in proximity to irisette. Foliar treatments will 5 be completed with handheld or backpack sprayers that are adjusted to deliver large droplets that help avoid drift/overspray. Conclusion A small number of plants will be directly affected by the project. However,these effects involve transplanting a few plants to nearby suitable habitats where they will be monitored for a period of five years. Similarly,plants that are not directly affected by the project will also be monitored and receive care such as removal of fallen limbs that may shade the plants and control of encroaching invasive plants to help avoid competition. Directly impacted and potentially indirectly affected plants are part of an apparently robust local population center in the project area. The project is likely to impact white irisette plants and,therefore,we request formal consultation from USFWS on this project. The stream bank of the stream relocation shall be seeded by a method that does not alter the typical cross section of the stream bank. Native Grass Seeding and Mulching shall also be performed in the permanent soil reinforcement mat section of preformed scour holes, and in other areas as directed. The kinds of seed and fertilizer, and the rates of application of seed, fertilizer, and limestone, shall be as stated below. During periods of overlapping dates, the kind of seed to be used shall be determined. All rates are in pounds per acre.
