As currently designed, it is possible that boats could dock along the outside of the docks beside slips
# 3 and 10, or along the backside of the T -head between slips # 1 and 2. It is requested that a
permanent fence or handrail be placed along the back side and outside of this facility to prevent the
use of any unpermitted spaces for docking. If at any time more than 10 boats make use of this
facility, an immediate shellfishing closure extending 100 feet in all directions would be necessary.
The layout as presented in the permit application maintains a proper separation between this 10 -slip
facility and the existing docks at the two surrounding properties. Thus, if built as designed, (taking
into account the comment above), this facility will not cause a shellfish closure. However, it should be
noted that if any of the slips in the final construction extend to within 100 feet of either of the
surrounding docks, a closure may be necessary.
