On February 15, 2012, DWQ advised you that a Public Hearing would be conducted with respect to the application for 401 Water Quality Certification. Subsequently, on April 12, 2012, you gave DWQ permission to delay the 401 Public Hearing until such time that it could be conducted simultaneously with a Public Hearing for the NPDES Permit, also administered by DWQ. On March 2, 2012, DWQ requested additional information necessary for the technical and administrative review of the 401 application. We have received your responses dated September 18 and October 16,2012, in which you addressed questions posed in our correspondence. Item 2 of our letter related to modeling necessary to evaluate the effects of process water discharges on the biochemistry of receiving waters. The final report on your evaluation addressing effects on fish, benthos and aquatic vegetation was being finalized by your technical consultants throughout this past year. This report was also necessary in order to prepare a draft NPDES Permit, a necessary component of the NPDES Public Hearing process. The Public Hearing process for the NPDES Permit requires thorough technical review of your NPDES application as well as publication of a Draft NPDES Permit, and at least 30 days advance Public Notice of the hearing date and location. The administrative time necessary to follow that process will exceed the one- year timeframe for processing the 401 application; therefore, by copy of this letter,we are returning your application for 401 Certification. We understand that you intend to re-apply for the 401 Certification prior to the Public Hearing, so that both hearings can be conducted simultaneously. In order to conserve resources, we will retain the existing file materials so an additional application fee is not necessary.
