Amendment Number 1
Ladies and Gentlemen:
We hereby amend our Irrevocable Standby Letter of Credit SB93770 in your favor as
follows:
The following paragraph is added.
"The undersigned hereby certified that the North Carolina Department of
Environment and Natural Resources- Division of Water Quality has the right to
draw down the amount of $100,000 against Letter of Credit No. SB93770, in
accordance with the Umbrella Mitigation Banking instrument (UBMI) entitled,
Greene Environmental Services Neuse River Riparian Buffer and Nutrient
Offset UMBI, to provide for the completion of construction implementation and
monitoring activities as authorized and required by the UMBI as Greene
Environmental Services, LLC has failed to perform such activities as required
and is in default."
This amendment is to be considered a part of Irrevocable Standby Letter of Credit Number
SB93770 and must be attached thereto. All other terms and conditions remain the same.
