Seafood Industrial Park Pasquotank River Basin, Broad Creek [PAS 51, 30 -21 -7; SA, HWQ] REQUEST FOR ADDITIONAL INFORMATION RETURN OF APPLICATION Dear Mr. Peele: On October 30, 2012 the Division of Water Quality (DWQ) received your application dated October 30, 2012, to impact 0.013 acres of open water for the purpose of constructing a floating dock. The DWQ has determined that your application is incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected waters on the subject property. Since this project was accepted into the Express Review Program this Office has opted to return your application as incomplete rather than placing it on Hold. If you want to carry out the proposed impact, you will need to reapply and provide the following information so that we may review your project. Additional Information Requested: During the review process of your application it was discovered that Shellfish Sanitation and Recreational Water Quality is proposing a closure of shellfish waters as a result of your proposed project. C. Seafood Industrial Park Page 2 of 2 cannot permit a project which shall affect water quality and/or remove existing use. It is therefore necessary that the applicant perform a "Use Attainability Analysis ". The information supplied by the permittee will then be reviewed and commented on by the appropriate agencies. Enclosed for your convenience is a copy of the Use Attainability Analysis form. Upon completion of review, this analysis would be the basis for the permit decision and future surface water reclassification. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
