The Existing License was issued by the Federal Power Commission, the Federal Energy Regulatory Commission's (FERC or Commission) predecessor agency, in 1966 and is set to expire on August 31, 2016. Duke Energy is following the Integrated Licensing Process (ILP) as outlined in FERC regulation 18 C.F.R. Part 5 to relicense the Project. Duke Energy filed a timely Notice of Intent (NOI) and Pre-Application Document (PAD) with the FERC on March 11, 2011, as required by the ILP. As part of the process, Duke Energy developed Proposed Study Plans in consultation with agencies and other stakeholders. Comments and recommendations obtained during the review period, study plan meetings, and subsequent resource committee meetings were incorporated into the Revised Study Plan (RSP), which was filed with the FERC on December 22, 2011. The FERC issued its Study Plan Determination letter on January 27, 2012. Since then, Duke Energy has been implementing the approved study plans. The attached Study Progress Report contains a brief summary of activities completed to date. Page 2 Duke Energy is providing this letter to the parties shown on the attached distribution list. The parties may view the Study Progress Report on the Project public relicensing website's online library at www.duke-energy.com/lakes/keowee-toxaway-relicensing.asp. Please note the Initial Study Meeting required by 18 C.F.R. §5.15 (c)(2) will be on February 7, 2013, at Duke Energy's Wenwood Operations Center in Greenville, SC. The Project consists of two developments the Jocassee Development and the Keowee Development. The Project is located in the Upstate area of South Carolina primarily in Oconee County and Pickens County with a small portion of Lake Jocassee extending into Transylvania County, North Carolina. The Project, originally licensed in 1966, was conceived, licensed, and developed as two hydroelectric facilities. Today the Project's primary purposes include hydroelectric and thermal electric generation. Other beneficial uses include recreation and public water supply. The generated power helps meet the power requirements of Duke Energy's service area and the SERC Reliability Corporation (SERC). The Project's Existing License expires August 31, 2016, and the Integrated Licensing Process (ILP) as defined under FERC Regulations (18 CFR Part 5) is being used for relicensing. As required by 18 CFR §5.11, Duke Energy prepared and filed a Proposed Study Plan (PSP) on August 26, 2011. Duke Energy held the Initial Proposed Study Plan Meetings in accordance with 18 CFR §5.11(6) (e) on September 13 and 14, 2011. Agency recommendations obtained during these and other meetings and formal comments to the FERC were integrated into the Revised Study Plan (RSP). The RSP was filed with the FERC on December 22, 2011, and approved and modified per the FERC's January 27, 2012, Study Plan Determination letter. Duke Energy is currently implementing the FERC- approved studies detailed in the Study Plan Determination letter. Duke Energy submitted its first Study Progress Report on June 15, 2012, and respectfully submits the following Study Progress Report in accordance with 18 CFR §5.15 (b). This report summarizes actions and progress for the period June 15, 2012, through October 31, 2012. The draft report was provided to the study team for review and comment on November 1, 2012. Duke Energy began fixed hydroacoustic monitoring of fish entrainment at Jocassee Pumped Storage Station on July 12, 2012. Installation and calibration of the monitoring equipment proved to be challenging, but the equipment is now collecting continuous data. Variance from Approved Study Plan The study is proceeding in accordance with the approved study plan. 2 Duke Energy Carolinas, LLC Keowee- Toxaway Project FERC 2503 Study Progress Report 3.0 HYDRO STRUCTURES NATIONAL REGISTER OF HISTORIC PLACES (NRHP) ELIGBILITY ASSESSMENT Completed Activities Duke Energy provided the draft study report with NRHP eligibility recommendations to the study team on August 20, 2012. Duke Energy received comments from the South Carolina Department of Archives and History and FERC staff. Duke Energy will address these comments in the final study report. Duke Energy will file the final study report with the Commission with the Initial Study Report pursuant to 18 C.F.R. §5.15 (c) in January 2013. Variance from Approved Study Plan Upon completion of the study report, Duke Energy determined none of the information or figures included in the report are privileged. Therefore, the report will not be submitted with the privileged designation as described in the Study Plan. 4.0 RECREATION USE AND NEEDS STUDY Completed Activities Duke Energy's consultant for the Recreation Use and Needs (RUN) Study has completed all fieldwork for the RUN Study, is currently analyzing the collected data, and developing the draft report for Study Team review. The recreation user and provider survey efforts ended on October 31, 2012. Approximately 1,350 public recreation area visitor exit interviews were conducted and 400 web -based survey responses have been received to date. Seven flyovers to support the boating density assessment have been conducted. Early results indicate most people feel safe or very safe while recreating at the Project and the majority responded the volume of boats on the water and /or the number of access area users is well within acceptable levels. Variance from Approved Study Plan The study is proceeding in accordance with the approved study plan. 3 Duke Energy Carolinas, LLC 5.0 SHORELINE EROSION STUDY Completed Activities Keowee - Toxaway Project FERC 2503 Study Progress Report Duke Energy's consultants for the Erosion Study have completed all data collection efforts for the Erosion Study. The draft study report is currently being developed for study team review and comment. Duke Energy will provide the draft study report to the study team in mid - November 2012. Variance from Approved Study Plan The deadline for providing the draft study report to the study team was October 15, 2012. Due to the amount of analysis required, issuance of the draft study report to the study team has been delayed approximately one month. This will result in an approximately one -month delay in the issuance of the final study report. 6.0 SHORELINE MANAGEMENT PLAN (SMP) SHORELINE CLASSIFICATION MAP UPDATE STUDY Completed Activities Draft versions of the updated SMP shoreline classification maps were posted to the study team's SharePoint site in August 2012. As anticipated in the study plan, the SMP Resource Committee is identifying and evaluating potential modifications to the Shoreline Management Guidelines (SMG) that may require additional revisions to the shoreline classification maps. In addition, the results of other relicensing studies like the wetlands and botanical studies may identify additional resources needing protective shoreline classifications. Variance from Approved Study Plan The study is proceeding in accordance with the approved study plan. 7.0 JOCASSE FOREBAY AND TAILWATER WATER QUALITY STUDY Completed Activities Data collection ended on October 31, 2012. Preliminary results indicate dissolved oxygen (DO) levels in both the forebay and tailwater remained well above the state standard of 5 parts per n Duke Energy Carolinas, LLC Keowee- Toxaway Project FERC 2503 Study Progress Report million (ppm) daily average and 4 ppm instantaneous reading throughout the monitoring period. Duke Energy is currently drafting the study report for study team review and comment. Variance from Approved Study Plan The data collected with the monitor on forebay intake structure A have been declared invalid due to erratic readings collected over the monitoring period. It is suspected sediment has been collecting in the standpipe that houses the DO monitor. For this reason, the Water Quality Resource Committee (WQRC) has agreed to use only the data collected in the forebay on intake structure B. 8.0 KEOWEE RESERVOIR WATER QUALITY MODELING STUDY Completed Activities Duke Energy's water quality model consultant has calibrated and validated the model and has run several scenarios and sensitivities to model DO in the Keowee Hydro Station flow releases and other interests of WQRC members. Variance from Approved Study Plan The study is proceeding in accordance with the approved study plan. However, it is likely the Stakeholder Team will identify the final proposed operating scenario after the final study report is due. (See discussion in Section 10.0, below.) If that is the case, Duke Energy will use the Keowee Reservoir water quality model to evaluate water quality interests, including DO levels in flow releases from Keowee Hydro Station, and document the results in the Application for New License. 9.0 RESERVOIR LEVEL AND PROJECT FLOW RELEASES STUDY Completed Activities Duke Energy has provided the draft study to the study team for review and comment. The final study report will be included in the Initial Study Report submitted to the FERC in January 2013 Variance from Approved Study Plan The study is proceeding in accordance with the approved study plan. 5 Duke Energy Carolinas, LLC Keowee- Toxaway Project FERC 2503 Study Progress Report 10.0 OPERATIONS MODEL STUDY Completed Activities Relicensing stakeholders are using CHEOPS® to evaluate potential operating scenarios at the Proj ect. The hydrology dataset for the model has been adjusted based on input from the study team. The model has also been revised to incorporate the United States Army Corps of Engineers' (USACE) revised Drought Contingency Plan (DCP) implemented in July 2012. Accordingly, Duke Energy reissued the model to the study team in October and will be issuing an addendum to the Model Verification Report included in the June 2012 Study Progress Report. This addendum will be included in the Initial Study Report submitted to the FERC in January 2013. Variance from Approved Study Plan The study is proceeding in accordance with the approved study plan with minor modifications. As discussed above, Duke Energy will submit an addendum to the Model Verification Report included in the June 2012 Study Progress Report. This addendum will address the use of adjusted hydrology dataset for the model and the incorporation of the USACE's revised DCP into the model logic. Study team members and other relicensing stakeholders are currently using the CHEOPS® model to evaluate potential operating scenarios and the modeled effects of these operating scenarios. Duke Energy will issue a draft Scenario Documentation Report by February 15, 2013, as stipulated in the approved study plan. However, Duke Energy anticipates relicensing stakeholders may identify additional operating scenarios to model with CHEOPS® after both the draft study report and the final study report deadlines. Additional operating scenarios developed by stakeholders and subsequently modeled using CHEOPS® after the issuance of the draft study report will be documented separately in the Application for New License. Duke Energy Carolinas, LLC 11.0 WATER SUPPLY STUDY Completed Activities Keowee - Toxaway Project FERC 2503 Study Progress Report The final study report was provided to the study team in October 2012 and will be submitted to the Commission with the Initial Study Report in January 2013. Variance from Approved Study Plan The study is complete and the final report has been distributed to the study team. However, the Water Quantity & Operations RC has requested additional analysis of the water yield at Lake Keowee above and beyond the scope of the water yield analysis in the FERC- approved study plan. Duke Energy will perform this additional water yield analysis and document the results in an addendum to the final study report by early 2013. Further, because the proposed operating measures have not yet been finalized and the Stakeholder Team is still evaluating potential operating scenarios, the Water Supply Study does not include a water yield based on the preferred operating proposal. When a final proposed operating scenario is selected, a water yield for the Duke Energy and USACE reservoirs will be calculated and these data will be appended to the final Water Supply Study report or included in the License Application. 12.0 WETLANDS STUDY Completed Activities All fieldwork has been completed and the draft study report has been provided to the study team for review and comment. The final report will be included in the Initial Study Report submitted to the FERC in January 2013.
