On behalf of Rockingham County, we are requesting authorization from the USACE to use NWP
39 for 0.066 acres of permanent wetland impacts, 0.009 acres of temporary wetland impacts,
0.052 ac (139 If) of permanent stream impacts and 0.017 ac (52 If) of temporary stream impacts
for construction of an access road (Diesel Drive) and utilities (water & sewer) for the Reidsville
Rural Ready Site.

Reidsville Rural Ready Site consist of three parcels owned by Rockingham County. The proposed
project is specifically located on the following four parcels:

The project is in the Roanoke River basin and onsite waters drain to Jones Creek (Lake Wade).
The Water Quality Classification for Jones Creek is C, and the Stream Index Number is: 22-50-3.
The cataloging unit for the site is 03010104.
Proposed Project
The purpose of the proposed project is to construct an extension of Diesel Drive, which will
provide access and water/sewer infrastructure to the 127-acre Reidsville Rural Ready Site to
facilitate economic development within Reidsville and Rockingham County. Reidsville and
Rockingham County have high unemployment and have a need to make as much
industrial/commercial land available as possible to attract investors who could bring jobs to the
area. While this site is located within a prime area for industrial/commercial development, the site
has been passed up by companies looking to expand or build in Reidsville area due to a lack of
utilities and road infrastructure. The proposed project will allow the Reidsville and Rockingham
County to proactively market the site for industrial development. The Reidsville Rural Ready Site
could potentially attract employers that would invest an estimated $50 million in private capital
investment and possibly create upwards of 250 local jobs. There are numerous opportunities for
potential employers who are interested in this site to become engaged in the workforce initiatives
and provide opportunities to local students and those being retrained to fulfill recruited positions
in the community. These jobs and economic development are desperately needed in
Reidsville/Rockingham County.
The construction of Diesel Drive and water and sewer infrastructure are the first steps in allowing
the site to be proactively marketed to attract potential businesses to relocate or expand within the
area. Diesel Drive will provide direct access to the US 29 interchange without having to go through
residential communities. The proposed construction of Diesel Drive and the water/sewer
infrastructure is being funded through a "Rural Ready Site" grant through the NC Department of
Commerce. A "Rural Ready Site" grant can only go to Cities/Counties which own a 50-acre or
greater tract of land that could be used for industrial development. The funds are available to
make the site ready for development by providing utilities and roads for the site. Without the
grant, Rockingham County would not be able to pay for the proposed infrastructure, making it
extremely difficult to market the site and bring needed economic development to the area.
Please note that the lots shown adjacent to the proposed Diesel Drive are conceptual only, as the
actual lot sizes and configurations will be dependent on the ultimate investors who purchase and
develop the lots for their specific needs. The project area for the proposed project has been limited
to only the ±9.0 area needed for construction of Diesel Drive and the water/sewer infrastructure,
as this is an economic development project, intended to attract businesses to the 127-acre
Reidsville Rural Ready Site. Due to funding constraints and the inability to anticipate the ultimate
needs for potential businesses, no additional impacts are proposed as part of this application. Any

impacts for specific businesses building within the Reidsville Rural Ready Site will be permitted in
the future as the need arises.
The proposed project consists of the construction of ±2,700 If of road (Diesel Drive), 2,930 If of
12" water line, 1,530 If of 8" waterline, 3,120 If of 8" gravity sewer, 3,144 If of 4" force main and
one sewer lift station. Diesel Drive will be extended north to the proposed sewer lift station,
stubbing short of Stream 3 and will not result in impacts to Stream 3. Diesel Drive is not proposed
to connect to Drum Road for several reasons, including lack of grant funding to pay for
construction, as well as there being no need to provide access to Drum Road as all traffic for the
site will be funneled to US 29 and not Drum Road.
The project will be constructed using traditional commercial construction equipment and
techniques.
Project History
WithersRavenel delineated the wetlands within the project area in May 2019. Please note that
we are not requesting issuance of a Jurisdictional Determination in conjunction with issuance of
the NWP 39. An exhibit depicting the delineation completed for the project area and
wetland/upland data forms have been provided as an attachment to this application.
WithersRavenel previously submitted a NWP 39 application on 8/27/2020 for the proposed
project. Dave Bailey (USACE) issued a request for additional information in an email dated
9/21/2020. In the email, Mr. Bailey specified that due to the reasonably foreseeable cumulative
impacts for future development within the industrial park exceeding the typical compensatory
mitigation threshold under a NWP 39, compensatory mitigation would be required for the
proposed 139 If of permanent stream impacts for the construction of the Diesel Drive stream
crossing. The proposed project is being fully funded by the Rural Ready Grant, and at the time of
submittal of the previous application there was not sufficient funding in the approved grant to
cover the cost of the stream and wetland mitigation. Therefore, the proposed project was revised
to eliminate the road crossing entirely, install the sewer force main at the stream crossing via bore
and jack to avoid stream impacts and to provide construction access from Pickrel Road entirely
within uplands. In an email dated 11/25/2020, WR notified the USACE and NCDWR of the
modifications of the project design which would eliminate the need for 404/401 permits and
formally withdrew the application. A copy of the 11/25/2020 email withdrawing the application
has been provided as an attachment to this application. In an email dated 11/27/2020, Mr. Bailey
(USACE) confirmed withdrawal of the NWP 39 application which has been provided as an
attachment to this application. Additionally, Ms. Homewood (NCDWR) issued a letter of
acknowledgement of withdrawal of the 401 WQC application dated 11/30/2020 which has been
provided as an attachment to this application.
The applicant has successfully secured additional "Rural Ready Site" funding from the NC
Department of Commerce to cover the cost of the stream mitigation. Therefore, we are
resubmitting the NWP 39 application for the impacts associated with the Diesel Drive stream
crossing and installation of the sewer force main.
Please note that WithersRavenel coordinated with Sue Homewood (NCDWR) via phone calls and
email correspondence during the review of the previously submitted 401 WQC application. A
copy of the email correspondence with the Ms. Homewood dated 9/21/2020 in response to the
USACE email requesting additional information and the NCDWR letter acknowledging withdrawal

of the previous 401 WQC application has been attached as documentation that coordination with
NCDWR was conducted more than 30-days prior to submittal of this application. Therefore, the
requirement for requesting a pre -filing meeting under 40 CFR Part 121 for 401 Certifications in
accordance with the federal Clean Water Act have been satisfied.
Proposed Impacts
The proposed impacts consist of 0.066 acres of permanent wetland impacts, 0.009 acres of
temporary wetland impacts, 0.052 ac (139 If) of permanent stream impacts and 0.017 ac (52 If) of
temporary stream impacts.
All proposed impacts are associated with the construction of access road (Diesel Drive), which has
been designed as a perpendicular crossing across Stream 1 and Wetland A. Due to the low velocity
of flow within Stream 1, a riprap dissipator is not proposed. The crossing has been designed with
a 48-inch RCP culvert, which will be buried 10-inches (20%) below the stream bed to allow for
aquatic life passage during periods of low flow.
Please note that the northern end of the access road (Diesel Drive) has been designed to stub
short of Stream 2, as a connection to Drum Road is not needed at this time and may never be
constructed. All traffic from future development will be directed to the US 29 interchange to the
southeast and not onto Drum Road.
There may be additional impacts needed for future development within the Reidsville Rural Ready
Site. However, it is impossible to anticipate and determine these impacts, as they will be
dependent on the specific users and configuration of the buildings and infrastructure specific to
their operations. Therefore, future impacts will be permitted as the need arises.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimized.
The project has been designed to minimize impacts to wetlands and streams by crossing the
stream/wetland perpendicularly. Retaining walls have been designed at the stream crossing to
stabilize road fill and minimize stream and wetland impacts. Additionally, the crossing has been
designed without a riprap dissipator as flows were determined to be at non -erosive rates, which
further minimized stream impacts.
During construction, work will be conducted "in the dry" through installation of temporary coffer
dams upstream and downstream of the work area, and flow will be pumped around the project
area during installation of the culvert. Additionally, installation of the culvert will be planned during
a period with no forecasted rain for 4-days.
After construction of the culvert and retaining walls are complete, the stream channel temporarily
impacted will be restored to pre -construction contours and the banks will be temporarily stabilized
with biodegradable matting and seeded with a riparian seed mix until natural recruitment of native
vegetation permanently stabilizes the banks. Temporary wetland impact areas will be restored to
natural grades and seeded with a wetland seed mix to provide temporary stabilization until natural
recruitment of native vegetation permanently stabilizes these areas.
Access during construction will occur from uplands. Silt fencing will be installed around all
disturbed areas to prevent Toss of sediment into adjacent waters.

Mitigation
The applicant proposes to mitigate for the 0.066 acres of permanent wetland impacts at a 2:1
mitigation ratio, resulting in provision of 0.14 acres of riparian wetland mitigation. Additionally,
the applicant proposes to mitigate for the proposed 139 If of permanent stream impacts at a 2:1
mitigation ratio, resulting in provision of 278 If of stream mitigation. There are no private
mitigation banks servicing the Roanoke 03010104 basin. Therefore, the applicant proposes to
provide the 0.14 acres of riparian wetland mitigation and 278 If of stream mitigation through the
purchase of credits from the NCDMS ILF program. A copy of the NCDMS letter of acceptance
has been provided as an attachment to this application.

All proposed impacts are associated with the construction of access road (Diesel Drive), which has been designed as a perpendicular crossing across
Stream 1. Due to the low velocity of flowwithin Stream 1, a riprap dissipator is not proposed.After construction of the culvert and retaining walls are
complete, the stream channel temporarily impacted will be restored to pre -construction contours and the banks will be temporarily stabilized with
biodegradable matting and seeded with a riparian seed mix until natural recruitment of native vegetation permanently stabilizes the banks.
E. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be
minimized.
The project has been designed to minimize impacts to wetlands and streams by crossing the stream/wetland perpendicularly. Retaining walls have
been designed at the stream crossing to stabilize road fill and minimize stream and wetland impacts. Additionally, the crossing has been designed
without a riprap dissipator as flows were determined to be at non -erosive rates, which further minimized stream impacts.
During construction, work will be conducted "in the dry" through installation of temporary coffer dams upstream and downstream of the work area, and
flowwtll be pumped around the project area during installation of the culvert. Additionally, installation of the culvert will be planned during a period with
no forecasted rain for 4-days.
After construction of the culvert and retaining walls are complete, the stream channel temporarily impacted will be restored to pre -construction
contours and the banks will be temporarily stabilized with biodegradable matting and seeded with a riparian seed mix until natural recruitment of native
vegetation permanently stabilizes the banks. Temporary wetland impact areas will be restored to natural grades and seeded with a wetland seed mix
to provide temporary stabilization until natural recruitment of native vegetation permanently stabilizes these areas.

The applicant proposes to mitigate for the 0.066 acres of permanent wetland impacts at a 2:1 mitigation ratio, resulting in provision of 0.14 acres of
riparian wetland mitigation. Additionally, the applicant proposes to mitigate for the proposed 139 If of permanent stream impacts at a 2:1 mitigation
ratio, resulting in provision of 278 If of stream mitigation. There are no private mitigation banks servicing the Roanoke 03010104 basin. Therefore, the
applicant proposes to provide the 0.14 acres of riparian wetland mitigation and 278 If of stream mitigation through the purchase of credits from the
NCDMS ILF program. A copy of the NCDMS letter of acceptance has been provided as an attachment to this application.

WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home, as well as NCNHP GIS data to identify if

occurrences of federally listed threatened or endangered species or critical habitat on the subject property or within 1.0 miles of the project, see
attached NCNHP project review letter. Furthermore, site reviews did not identify any potential habitat for any federally protected species known to
occur in Rockingham County. While Stream 1 is a perennial stream, it is not large enough to be considered potential habitat for Roanoke logperch or
green floater. Additionally, there is no potential habitat for smooth coneflower. Therefore, the proposed project will not adversely affect federally
protected species or their designated critical habitat.

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification within this time frame, this acceptance will
expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS receives a copy
of the permit(s) an invoice will be issued based on the required mitigation in that permit and payment must
be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by an applicant is
calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the

Cumulative Impacts
The proposed construction of Diesel Drive and water/sewer infrastructure for the 127-acre
Reidsville Rural Ready Site is intended to be a catalyst for future development for economic
development within the area. Therefore, the proposed project will have future phases associated
with the intended development of the property as portions of the property are subdivided as lots
and sold for construction of various businesses. The ultimate lot configurations, access alignments
and utility alignments cannot be determined as these design items will depend on what businesses
ultimate build within the Reidsville Rural Ready Site and what configuration is needed to support
their business operations. Therefore, the currently proposed impacts are those impacts necessary
to support economic development.
There may be future impacts to wetlands and streams needed for the future development of the
Reidsville Rural Ready Site. Future impacts will be permitted as the need arises as businesses buy
and construct within the Reidsville Rural Ready Site. Any future development will be required to
meet all local, state, and federal requirements for development and permitting, which will provide
assurance that potential impacts to nearby downstream water quality will be addressed at that
time.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database indicates that
there are no records for rare species, important natural communities, natural areas, and/or
conservation/managed areas within the proposed project boundary. Please note that although there
may be no documentation of natural heritage elements within the project boundary, it does not

Bald and Golden Eagle Protection Act (BGPA):
In the July 9, 2007 Federal Register( 72:37346-37372), the bald eagle was declared recovered, and removed (de-
listed) from the Federal List of Threatened and Endangered wildlife. This delisting took effect August 8,2007.
After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U.S.C. 668-668d) becomes the
primary law protecting bald eagles. The Eagle Act prohibits take of bald and golden eagles and provides a
statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle
Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid

Threatened due to similarity of appearance(T(S/A)):
In the November 4, 1997 Federal Register (55822-55825), the northern population of the bog turtle (from New
York south to Maryland) was listed as T (threatened), and the southern population (from Virginia south to
Georgia) was listed as T(S/A) (threatened due to similarity of appearance). The T(S/A) designation bans the
collection and interstate and international commercial trade of bog turtles from the southern population. The
T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part of
the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife
Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss.
Definitions of Record Status:
Current - Based on NC Natural Heritage Program information, this taxon is considered to be extant in the
county.
Historical - Based on NC Natural Heritage Program information, this taxon is considered to be historical in the
county, meaning that all recorded occurrences are either extirpated, have not been found in recent surveys, or
have not been surveyed recently enough to be confident they are still present.
Obscure - the date and/or location of observation is uncertain.
Incidental/migrant - the species was observed outside of its normal range or habitat.

I wanted to let you know that the project has been revised to eliminate all previously proposed impacts. The revisions
noted below are also noted in the attached plan. I have also attached the previously submitted impact plans for
reference only:
• The previously proposed culverted stream crossing for the extension of Diesel Road (Impacts 1, 2 & 3) will no
longer be constructed. The grading for the road bed will stop near the 750' contour on both sides of the stream
(see attached .
• The force main crossing of the stream will be constructed via jack and bore beneath the stream and wetlands,
completely avoiding impacts.
• The construction of the pump station and road grading in the northern portion of the site will occur only in
uplands, and no crossing of the stream is proposed.
Based on the revisions to the project, there will not be any impacts to jurisdictional wetlands or streams and the project
does not require authorization from the USACE or NCDWR. Therefore, we are formally withdrawing our application as it
is no longer needed. Please respond to this email confirming receipt of our withdrawal for our files.
When the applicant is able to secure the necessary funding to complete the stream crossing for Diesel Road, we will
submit 404/401 PCN for authorization of those impacts at that time.

Thank you for your PCN and attached information, dated 8/28/2020, for the above referenced project. I have reviewed
the information and need clarification before proceeding with verifying the use of Nationwide Permit (NWP) 39
(Blockedhttp://saw-reg.usace.army.mil/NWP2017/2017NWP39.pdf). Please submit the requested information below
(via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the
Nationwide Permit or consider your application withdrawn and close the file:
1) Thank you for your detailed information regarding the conceptual nature of the project. Based on our review of
the information provided and remotely sensed resources, it is likely that all current and future phases of this
overall commercial/industrial project could be constructed with cumulative impacts staying below the maximum
threshold allowed by the NWPs. Due to the preceding, and because it is our intention to be flexible with
permitting, it appears that the proposed crossing could potentially be permitted ahead of future phases.
However, a second stream/wetland crossing is reasonably foreseeable for future phases of the development
based on the Vicinity Map (which shows a "Future Road" crossing to connect to Drum Road), discussions with
local officials, and our experience with other commercial/industrial park developments and phased projects in
general. Based on the plans, no indication is given that the road would stub out prior to crossing the stream.
Given that reasonably foreseeable cumulative stream impacts would exceed the typical compensatory
mitigation threshold (NWP Regional Condition 3.2) for road crossings alone, uncertainty regarding future
proposed impacts for conceptual Lot end users, and to ensure that the overall development does not result in
more than minimal adverse effects on the aquatic environment, we are using our discretion (NWP District
Engineer's Decision) to require compensatory mitigation for currently proposed stream impacts. Please update
Section D.2 of the PCN accordingly, including any relevant compensatory mitigation acceptance letters;
2) Based on the PCN and plans it is unclear whether or not the culvert pipe is proposed to be buried. Please clarify
the project description and relevant project plans accordingly. We recommend providing a profile view along the
culvert showing the existing stream bed as a reference;

I wanted to let you know that the project has been revised to eliminate all previously proposed impacts. The revisions
noted below are also noted in the attached plan. I have also attached the previously submitted impact plans for
reference only:
• The previously proposed culverted stream crossing for the extension of Diesel Road (Impacts 1, 2 & 3) will no
longer be constructed. The grading for the road bed will stop near the 750' contour on both sides of the stream
(see attached .

• The force main crossing of the stream will be constructed via jack and bore beneath the stream and wetlands,
completely avoiding impacts.
• The construction of the pump station and road grading in the northern portion of the site will occur only in
uplands, and no crossing of the stream is proposed.
Based on the revisions to the project, there will not be any impacts to jurisdictional wetlands or streams and the project
does not require authorization from the USACE or NCDWR. Therefore, we are formally withdrawing our application as it
is no longer needed. Please respond to this email confirming receipt of our withdrawal for our files.
When the applicant is able to secure the necessary funding to complete the stream crossing for Diesel Road, we will
submit 404/401 PCN for authorization of those impacts at that time.
