License, in order to qualify for Production Tax Credits (PTCs) potentially available due
to the higher capacity and energy production resulting from these more efficient

DWR was an active participant in the Catawba-Wateree relicensing process and
is a party to the CRA. DWR supports Duke's early, pre-relicense modification
proposal as it meets the spirit of the CRA and will timely benefit the Catawba Rivel

I need to follow up on the consultation request letter I sent to you on October 2. We reviewed the maximum hydraulic
capacity and authorized installed capacity numbers for the Rhodhiss and Oxford powerhouse modifications again
internally and wish to correct some the information contained in the consultation request letter you received. While
these are not major changes, we want to provide your agency with as accurate information as possible for your
consideration.

As we discussed yesterday, I am sending the attached letter requesting your agency's consultation on the subject non -
capacity amendment for the Catawba - Wateree Hydroelectric Project (FERC No. 2232). As you requested, I am also
mailing a hardcopy to the Mail Service Center. If you have questions or concerns with this request, please do not
hesitate to give me a call.
I have also attached to this e-mail two additional documents I hope will serve as useful background information in your
review of this consultation request.
1. A copy of the Catawba - Wateree Water Quality Certification (WQC) issued for the Catawba - Wateree
Hydroelectric Project by NCDENR in November, 2008 (this is a file I received from NCDENR — I don't know why it
begins with a blank sheet). Please note the WQC incorporates by reference Appendix L of the Catawba - Wateree
Comprehensive Relicensing Agreement.
2. A portion of the Catawba - Wateree CRA containing Appendix L, which documents our agreement to install new
aerating turbines at both the Rhodhiss and Oxford Developments.

Dear Mr. Barwick:
The North Carolina Wildlife Resources Commission ( NCWRC) has reviewed your letter of
October 1, 2012 requesting comments on Duke Energy's proposal to apply for a Non - Capacity
Amendment for the Catawba - Wateree Project. The amendment would consist of a change to the
authorized installed capacity due to the replacement of Rhodhiss Unit 3 and Oxford Unit 2. The
turbine replacements are consistent with the 2006 Comprehensive Relicensing Agreement (CRA)
and are designed to improve dissolved oxygen downstream of each development. The CRA calls
for the turbine upgrades to occur within 36 months of a new license for the Oxford development
and within 48 months for the Rhodhiss development. It was anticipated that a new license would
have been issued prior to now. The proposed amendment is required because it appears that the
turbine replacements will occur under the terms of the existing license.
The NCWRC has been involved throughout the Catawba - Wateree relicensing process and is a
party to the CRA. The NCWRC supports the proposed amendment, as it is consistent with the
terms of CRA, including provisions for minimum and recreation flows, and water quality
improvements, and will be implemented several years earlier than would otherwise be required.
