An existing sewer line crosses the north end of the property and will be utilized for the proposed subdivision. An existing single family residence is located in the southeastern corner and will be removed. Land use in the vicinity is agricultural to the east and south, and residential to the west and north. 4b. Replace existing 60-ft long 36" CPP with a new 36" RCP. 20 linear feet of Class B riprap will be added at the culvert outlet to dissipate flow (Stream Impact #1 - 2OLF). Pioneer Drive will cross a wetland drainageway (Wetland Impact #1 - 1033sf), and a culvert will be installed under the roadway. Subdivision road (Beta Court) will cross a drainageway (Stream impact #2 - 110LF, Wetland Impact #2 - 1850 sf), where a 18" RCP will be installed in the stream with bury depth 4", 10 linear feet of Class B riprap will be installed at the outlet of the culvert. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Wetlands and streams were excluded from lots. The road format and lot configuration was designed to maximize lot count while considering site constraints such as topography, building ordinances, and accessibility. The roads were sited perpendicular to the drainageways to minimize stream and wetland impacts. Detention basins and other stormwater controls were sited completely outside of all regulated wetland areas. The culverts will be buried in streams to maintain aquatic passage and to maintain passage during drought or low flow conditions. Shoulder slopes at road crossings are 3:1 Utilities were grouped in the road right-of-way where possible to minimize impacts. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Sediment and erosion control measures will be used, such as silt fencing, to protect water quality. JURISDICTIONAL DETERMINATION (JD) TYPE (Select One) I am requesting that the Corps provide a preliminary JD for the property identified herein. A Preliminary Jurisdictional Determination (PJD) provides an indication that there may be "waters of the United States" or "navigable waters of the United States"on a property. PJDs are sufficient as the basis for permit decisions. For the purposes of permitting, all waters and wetlands on the property will be treated as if they are jurisdictional "waters of the United States". PJDs cannot be appealed (33 C.F.R. 331.2); however, a PJD is "preliminary" in the sense that an approved JD can be requested at any time. PJDs do not expire. A landowner, permit applicant, or other "affected party" (33 C.F.R. 331.2) who receives an AJD may rely upon the AJD for five years (subject to certain limited exceptions explained in Regulatory Guidance Letter 05- 02).
