According to the As -Built survey the subject site has generated 1,491,885.751 ft2 of buffer restoration credits, 6,824.342 ft2 buffer preservation credits, 118,089.653 lbs-Nitrogen nutrient offset credits and 7,605.887 lbs-Phosphorus nutrient offset credits. On July 17, 2020, DWR received a performance bond (#107255999) in the amount of $100,000 issued to Travelers Casualty and Surety Company of America. The term of this bond begins June 22, 2020 and ends June 22, 2021 or with the approval of the Year 1 Monitoring Report by DWR. It should be noted, that RS is responsible to provide supplemental planting over an area approximately 0.54 acres in size along Feature 6 prior to Spring 2021. A map of the area required to receive the supplemental plantings is attached to this letter for reference. Until the area is planted, DWR will hold back a 5% credit release with the approval of the Year 1 Monitoring Report and will issue the remaining 5% credit release upon confirmation that plantings have been completed. In accordance with the MBI, signed on February 17, 2020, the following Project Milestones have been met and the corresponding credits shall be released: Task/Milestones Credit 3) Monitoring Financial Assurance Posted and Approval of As -Built Report 10% By copy of this correspondence, DWR confirms that you have satisfied the above requirements for the above -referenced tract and 10% of your Nitrogen nutrient offset credits (0.10 x 118,089.653 lb-N = 11,808.965 lb-N) and 10% of your Phosphorus nutrient offset credits (0.10 x 7,605.887 lbs-P = 760.589 lb-P) are now available for sale. Please note that nutrient offset credits generated at this site must be used for impacts in HUC 03020103 of the Tar -Pamlico River Basin pursuant to 15A NCAC 02B .0703, which became effective on April 1, 2020 or pursuant to the MBI, whichever applies. Additionally, the riparian buffer credits must be used for impacts in the Tar -Pamlico River Basin in accordance with guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015.
