DANIEL SMITH Director NORTH CAROLINA Environmental Quality August 5, 2020 Barrett Jenkins Restoration Systems, LLC 1101 Haynes Street, Suite 211 Raleigh, NC 27605 (via electronic mail: bjenkins@restorationsystems.com ) DWR ID# 2017-1122v2 Pitt County Re: GUC Buffer Mitigation & Nutrient Offset Mitigation Banking Instrument (MBI) GUC Bank Parcel Credit Release — Tasks 1 & 2 Dear Mr. Jenkins - On February 8, 2020, the Division of Water Resources (DWR) approved a Bank Parcel Development Package (BPDP) from Restoration Systems, LLC (RS) for the above -referenced site under the terms and conditions of the GUC Buffer Mitigation & Nutrient Offset Mitigation Banking Instrument (MBI). On May 5, 2020, the DWR received a recorded conservation easement and corresponding plat for the subject site. On May 5, 2020, DWR also received documentation from RS that the subject site had been constructed in its entirety and monitoring plots had been installed. On June 17, 2020, Katie Merritt with DWR, with assistance from Raymond Holz with RS, inspected the site and confirmed that most of the subject site had been completely planted, all monitoring plots were installed, sufficient conservation easement placards had been installed along the entire easement boundary, and all underground utilities were installed. On March 5, 2020, DWR issued correspondence acknowledging that the Piedmont Natural Gas Line 439 Replacement Project within this site's easement boundary was in compliance with GC #4133 and corresponding buffer authorization. Lastly, above -ground utilities had been relocated, old paths seeded and planted, and applicable culverts were removed with stream banks seeded and stabilized. On July 17, 2020, DWR received a performance bond (#107255999) in the amount of $100,000 issued to Travelers Casualty and Surety Company of America. The term of this bond begins June 22, 2020 and ends June 22, 2021 or with the approval of the Year 1 Monitoring Report by DWR. Additionally, 40% of your Neuse buffer Restoration credits (0.40 x 1,491,885.751 ft2 = 596,754.300 ft2) and 40% of your Neuse buffer Preservation credits (0.40 x 6,824.342 ft2 = 2,729.740 ft2) are now available for sale. Please note that the credits being released reflect those provided in the draft As -Built Report and corresponding As -Built Survey provided by RS on July 17, 2020. This As -Built Report has not been reviewed in its entirety, but credits appear to be compliant with the As -Built Survey with the exception of approximately 358 ft2 (18.692 lbs N, 1.204 lbs P) where riparian widths were less than fifty feet adjacent to ditches 5 and 6A. Please note that nutrient offset credits generated at this site must be used for impacts in HUC 03020103 of the Tar -Pamlico River Basin pursuant to 15A NCAC 02B .0703, which became effective on April 1, 2020. Additionally, the riparian buffer credits must be used for impacts in the Tar -Pamlico River Basin in accordance with guidelines in the Consolidated Buffer Mitigation Rule, 15A NCAC 02B .0295, which became effective on November 1, 2015. Please use the Credit Ledger Templates provided on our website at: http://portal.ncdenr.org/web/wq/nutrientbuffertemplates to track and report credit availability for the GUC Mitigation Bank. Upon receiving this correspondence, please submit four (4) credit ledgers to DWR reflecting the available credits released for each mitigation type (Buffer Restoration, Buffer Preservation, Nitrogen Nutrient Offset, Phosphorus Nutrient Offset).
