3a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this
application: The existing conditions on the site are wooded with some rural residential. There is a large jurisdictional,
pond with a wetland system above and wetland and stream system below. The pond was determined to be non - buffered
by the NCDWQ. The surrounding land use is a mix of wooded, rural residential tracts and residential developments.

The purpose of the project is to construct a single- family residential development. In order to construct, a road crossing is
necessary to access the useable upland portions of the property. In addition, two utility impacts are necessary to provide
the site with water and sewer.

The proposed project is a single- family residential development. Specifically, there will be one road crossing and two
utility impacts proposed. All impacts are to jurisdictional wetlands. Heavy equipment typical to grading, excavating and
land disturbance will be utilized for this project.

Mr. James Lastinger (USACE) visited the subject property on June 11, 2012 to confirm the wetland and stream
delineation. We have included wetland data forms with this application so that a Jurisdictional Determination can be
issued along with the anticipated Nationwide Permit Verification. Ms. Lauren Witherspoon (NCDWQ) visited the site on
October 23, 2007 to conduct a Buffer Determination for the streams located on the property. Please see attached
NBRRO 07 -254.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The project site is bisected by a jurisdictional pond and wetland system, with additional wetlands and a buffered
stream below the pond. A perpendicular road crossing (Impact Area #1) has been proposed on the north side of
the pond, therefore avoiding the wetland and buffered stream system to the south. This perpendicular road
crossing was designed with retaining walls to minimize impacts. Impact Area #2 proposes temporary impacts on
both sides of the road crossing. These impacts are necessary for construction and a sanitary sewer easement on
the west side of the crossing. Per the project engineer, the Town of Apex will not allow the sanitary sewer to be
within the road right -of -way. Impact Area #3 proposed temporary impacts necessary for a sanitary sewer outfall
and easement. The temporary impacts associated with the sanitary sewer (Impact Areas 2 & 3) will be temporary
but will have a loss in function (wooded to herbaceous wetland) and therefore compensatory mitigation has been
proposed. Impact Area #4 proposes permanent impacts necessary for a sanitary sewer easement. This area is
proposed as permanent because it is within the fill slopes of the road.
The applicant is also aware of the regional conditions associated with the Nationwide Permits 29. With respect to
residential development conditions (Regional Conditions section 4.1) the applicant does not anticipate any impacts
to streams or wetlands associated with stormwater facilities, there are no proposed single- family recreation
facilities, and there are no permanent wetland or stream fills proposed within the floodway and the stream
classification for this project is C (i.e. not Outstanding Resource Waters or High Quality Waters).

We have reviewed the "DRAFT Internal Policy, Cumulative impacts and the 401 Water Quality Certification and
Isolated Wetland Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2 1.
The draft states that most residential subdivisions are unlikely to cause cumulative impacts. This project does not
meet any of the three criteria of private projects that can clearly result in cumulative impacts. Colvin Park project is
a residential development. It is important to note that the project is located within The Town of Apex's ETJ,
therefore the adjacent properties that have potential for development will have the following regulations to protect
downstream waters: 1) the Phase 11 NPDES Stormwater Permit Program, this program includes permitting
requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post- construction stormwater
management requirements; and 2) the Neuse River Basin Riparian Buffer Protection regulations, these regulations
require limited development within the riparian buffer area in addition to "diffuse flow" requirements at a minimum
and could require Best Management Practices that control nitrogen if diffuse flow cannot be achieved We
anticipate that the DWQ will advise us if any additional information is needed.

of the NC National Register Points shows that the closest structure (the Utley- Council House) is almost 3.5 miles away

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program ( NCEEP) is willing to accept
payment for compensatory mitigation for impacts associated with the above referenced project as indicated in the table below. Please
note that this decision does not assure that participation in the NCEEP will be approved by the permit issuing agencies as mitigation
for project impacts. It is the responsibility of the applicant to contact these agencies to determine if payment to the NCEEP will be
approved. You must also comply with all other state e&deral or local og vernment permits regulations or authorizations associated
with the proposed activity including SL 2009 -337• An Act to Promote the Use of Compensatory Mitigation Banks as amended by
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit1401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In-
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you in your request to use the NCEEP, the impacts that may require compensatory mitigation are
summarized in the following table. The amount of mitigation required for this impact is determined by permitting agencies.
