WATER QUALITY SECTION This letter will serve r., : a request from_.he City of , Statesville to the Environmental Management Commission to stop proceedings to issue the above referenced order as we feel it is no longer needed and will serve no useful par -pose. The proposed order addresses a problem that no longer exists. As of October 1990 the City of Statesville has met all the conditions in the Draft Order to request a rescission. The Fourth Creek Facility has located the source of toxicity (Nickel and Zinc) and thtough the_insinzIseatment ro ram h controlled the discharge of these metals. This has resulted in passing toxicity October 1990 at 36% and 46% to the present. We have reduced Nickel and Zinc loadings by 62% and 40% respectively. In January dilutions (5) were ran ranging from 36% to 60%. All passed. Lab results show these were passes by relatively wide margins. We feel we -have shown the problem no longer exists and that we have control over what metals are coming into the facility. As the intent of the Order is to correct an environmental problem and we feel we have shown the problem no longer exists, we respectfully request the Commission consider not issuing the Order.
