Closure of Enforcement Cases

LV-2002-0152
The above referenced enforcement cases were closed based on file review and
conversations with the Wilmington Regional Office. The violations associated with these
cases were deemed "beyond their control." I've provided the dates below for some
clarification.
April 12, 2002
May 3, 2002
May 17, 2002
November 5, 2002
The region enforced for a violation in November 2001
SOC signed (Covered enforcements April — Sept. 2001)
The region enforced for a violation in December 2001
Memo from Steve West (WiRO) to Bob Sledge through Rick Shiver
recommending waiver of penalty.
Guilford Mills Inc. also requested remission of these enforcement actions but I was
unable to show that the Division approved or denied their request. Remission requests
were not entered in BIMS either.
It appears that these two enforcement actions were the result of an oversight given the
details of the SOC and their efforts to come into compliance.
Based on these facts, it seems appropriate to close these cases. Please let me know if you
