Information on .file with the.Division of Environmental
Management indicates that one significant industrial user
(Nabisco), as defined by 15NCAC 2H.0903(b)(9), is proposing to
discharge into the Town of Garner wastewater treatment system.
Therefore, the Town must develop a pretreatment program. This
requirement is based on State regulation 15 NCAC 2H .0900.
Objectives of the pretreatment regulations are ... :(a) to
prevent the introduction of pollutants into POTWs which will
interfere with the operation of a POTW, including interference
with its use or disposal of municipal sludge; (b) to prevent the
introduction of pollutants into POTWs which will pass through
the treatment works or otherwise be incompatible ..."
July 1, 1983, was the regulatory date by which publicly owned
treatment works (POTWs) were required to have an approved
pretreatment program. However, because the Town did not
previously have a Significant Industrial User, the Division has
established a date of May 1, 1989 for the final approval and
implementation of a complete program.

In conjunction with the requirement to develop a pretreatment
program, we are forwarding herewith a modification to the Town
of Garner's nondischarge permit number 13378. The modification
(attached) reflects the deadline dates for submission of a
complete program. All other terms and conditions contained in
the original permit remain unchanged and in full effect. If any
parts, measurement frequencies or sampling requirements
contained in the permit modification are unacceptable to you,
you may request a waiver or alteration pursuant to Regulation 15
NCAC .0508(b) by written request to the Director identifying the
specific issues to be contended. Unless such request is made
within 30 days following receipt of this permit modification,
this modified permit shall be final and binding. Should your
request be denied, you will have the right to request an
adjudicatory hearing.
Enclosed herewith are copies of the EPA. pretreatment program
development and local limits development manuals, as well as the
Division's three pretreatment implementation guidance manuals.
The Division's manuals cover pretreatment permit writing,
enforcement and POTW.monitoring & .reporting procedures. These
documents..should be -helpful in the development and
administration of your local pretreatment program. The Raleigh
Regional Office has indicated that: instructional assistance:.will
be made available to the -Town. through Judy Garrett at (919)

Please note the manual concerning local limits is not
included. Local limits are applicable to discharging
facilities with toxic pollutant whereas the Town of Garner
facility is a nondischarge facility with conventional
pollutants.

30. Pretreatment Program Development
The permittee is hereby required to develop a DEM-approved
pretreatment program. This program must contain the following
items:
1. An industrial user survey as required by 40 CFR
403.8(f)(2) (i-iii) and 15 NCAC 2H.0905, including
identification of all industrial users and the character
and amount of pollutants contributed to the POTW by these
industrial users.
2. An evaluation of legal authorities to be used .by the
permittee to apply and enforce the requirements of Sections
307(b) and (c) and 402(b)(8) of the Clean Water Act,
including those requirements outlined in 40 CFR 403.8(f)(1)
and 15 NCAC 2H.0905.
3. Technical information (including specific analytical
data) necessary to develop a headworks analysis.
4. Specific POTW pretreatment standards for prohibited
pollutants (as defined .in 40 CFR 403.5(a) and (b) and 15
NCAC 2H.0909) contributed to the POTW by industrial users
and a headworks analysis which shows the technical basis
for these standards.
5. The- design of a monitoring program which will implement
the requirements of 40 CFR 403.8(f) and 403.12, and 15 NCAC
2H .0905 and .0908.
6. .A list of monitoring equipment required by the POTW to
implement the pretreatment program and a description of
municipal facilities to be constructed for monitoring and
analysis of industrial wastes.
7. An evaluation of the financial programs and revenue
sources as required by 40 CFR 403.8(f)(3) and 15 NCAC
2H.0905, which will be employed to implement the
pretreatment program.
8. Procedures for approving the construction of
pretreatment facilities by industrial users and for
permitting industrial users for' the operating and
discharging wastewater from these facilities as required by
NCGS 143-215.1.

9. Draft pretreatment permits for all significant
industrial users identified through the industrial waste
survey required in item one above.
10. An enforcement management strategy for identifying
violations of and enforcing specific local limits as
required by and specified in 40 CFR 403 and 15 NCAC 2H.0900.
11. A request for pretreatment program approval as required
by 40 CFR 403.9 and 15 NCAC 2H.0906.
The permittee shall submit three copies of the above
program to the Division of Environmental Management. The
program shall be submitted in two phases. Phase I shall
consist of items 1-3 above and Phase II shall consist of
items 4-11. The program shall be submitted according to
the following schedule
Phase I September 15, 1988
Phase II February 15, 1989
