This permi.t•shall be effective from the date of issuance until August 25, 1991, and shall be subject to the conditions and limitations as specified therein. If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing before a hearing officer upon written demand to the Director within thirty (30) days following receipt of this permit, identifying the specific issues to be contended. Unless such demand is made, this permit shall be final and binding. You are cautioned not to proceed with construction until the Authorization - to -Award package, EEO, and MBE documentation/certification have been reviewed and you are in receipt of our approval. NORTH CAROLINA ENVIRONMENTAL MANAGEMENT COMMISSION DEPARTMENT OF NATURAL RESOURCES & COMMUNITY DEVELOPMENT RALEIGH A r R M T T For the Discharge of Sewage, Industrial Wastes, or Other Wastes In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules, and Regulations PERMISSION IS HEREBY GRANTED TO Town of Garner Wake County FOR THE • construction and operation of a new 1.54 MGD land application waste- water treatment system to consist of dual 25-acre stabilization/storage lagoons with a minimum 30-day detention and an additional storage capacity of 46 days, a lagoon liner of natural clay material with a minimum thickness/compaction of one (1) foot and a minimum permeability of 1 X 10-6 cm/sec chlorination facilities, spray irrigation pump station housing four (4) pumps at 2750 gpm and one (1) pump at 100 gpm, spray irrigation line and spray risers (solid set) covering 298 acres of wetted area, and seven (7) monitoring wells to serve the Town of Garner with no discharge of wastewater to the surface of the state, pursuant to the application received November 27, 1985, and in conformity with the project plans, specifications, and other supporting data, subsequently filed and approved by the Department of Natural Resources and Community Development and considered a part of this Permit. 0 This Permit shall be effective from the date of issuance until . July 11, 1991, and shall be subject to the following specified conditions and limitations: 1. This Permit shall become voidable unless the facilities are constructed in accordance with the approved plans, specifica- tions and other supporting data. 2. This Permit is effective only with respect to the nature and volume of wastes described in the application and other support- ing data. 3. The wastewater facilities shall be properly maintained and operated at all times. 4. This Permit shall become voidable in the event of failure of the soil to adequately absorb the wastes, and may be rescinded unless the facilities are installed, maintained and operated in a manner which will protect the assigned water quality standards of the surface waters, and prevent any con- tamination of the ground waters which will render them unsatis- factory for normal use. 5. In the event the facilities fail to perform satisfactorily, the Permittee shall take such immediate corrective action as may be required by this Department. 6. If any nuisance condition arises concerning this land application/ spray irrigation facility, including the creation of an odor problem, the Permittee shall take such immediate corrective action as may be required by the Division. 7. Solids, sludges, or other pollutants removed or resulting from the wastewater treatment process shall be contained and disposed of in such manner as to prevent any contamination of the surface or groundwater of the State. 8. Diversion or bypassing of the untreated wastewater from the treatment facilities is prohibited. 9. The application rate shall not exceed 1.4 inches/acre/week or 0.30 inches/acre/hour. 10. In the event it is necessary to remove solids from the waste stabilization lagoon, the appropriate Permit must be obtained from the Division of Environmental Management. 11. This Permit may be rescinded if a suitable year round vegetative cover is not properly maintained and managed. 12. No root or leaf crops for direct human consumption shall be raised on the irrigation site. • 13. Irrigation shall not be performed during inclement weather or . when the ground is in a condition that will cause runoff. 14. Freeboard in the lagoons shall not be less than 2 feet at any time. 15. No other type of wastewater than described in the application and other supporting data shall be disposed of on this site., 16. The Permittee shall employ a State certified wastewater treat- ment plant operator to be in responsible charge of the wastewater treatment facilities. Such an operator must hold a valid State Certificate of the grade at least equivalent to the classification assigned to the wastewater treatment facilities by the Certification Commission. 17. The issuance of this Permit does not relieve the Town of -Garner of the responsibility for contamination of surface or groundwater resulting from the operation of this facility. 18. Construction- of the facilities shall be so scheduled so as not to interrupt service by the existing utilities nor result in an overflow or bypass discharge of wastewater to the surface water of the State. • 19. A minimum separation from the spray irrigation wetted area shall be maintained as follows: a. 50 feet from any public road right-of-way b. 50 feet from any free , f lowing stream. C. 25 feet from any wet weather ditch. d. 100 feet from any potable well. e. 150 feet from property line for new construction of habitable residence. f. 400 feet from any existing habitable residences. 20. Adequate facilities shall be provided so as to prevent any surface water runoff from entering the spray field or carrying any land applied waste material into the surface waters of the State. 21. The Permittee, at least six (6) months prior to the expiration of this Permit, shall request its extension. Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if indicated, will extend the Permit for such period of time and under such conditions and limitations as it may deem appropriate. 22. During the construction of the proposed additions/modifications, the Permittee shall continue to properly maintain and operate the existing wastewater facilities at all times. • 23. The facility shall be constructed, operated and maintained in a manner such that the assigned groundwater quality standards will not be contravened. 24. Groundwater monitoring wells shall be constructed as located and approved by the Raleigh Regional Office, and shall be monitored in the months of March, July, and November for the following, parameter: Measurements of water levels (this measurement is to be made prior to any pumping/bailing for taking groundwater samples), No3, Ammonia (total), TDS, TOC, Ph, fecal coliform, CL conductance. 25. An annual soils report should be submitted to the Raleigh Regional Office with the Town's plans for correcting any deficiencies. The wastewater treatment plant operator should keep records of the amount of wastewater applied to each zone and corresponding nutrient loading. 26. Rainfall should be recorded and its effect on the spray field documented. 27. Normal operation and maintenance of the spray irrigation land • application system shall include regrading and reseeding to prevent runoff as determined by the Raleigh Regional Office. 0 28. A minimum separation distance of three (3) feet should be pro- vided between the bottom of the lagoon waste and the seasonal high water table. 29. All existing wells and/or boreholes located within the property boundary which will not be maintained or adequately buffered from the proposed disposal operation should be properly abandoned in accordance with the requirements of the "Well Construction Standards", 15 NCAC 2C.0113(2).
