Dee Freeman Governor Director Secretary November 8, 2012 DWQ # 12 -0967 Durham County David Garrett 625 Hutton St., Suite 104 Raleigh, NC 27606 Subject: REQUEST FOR ADDITIONAL INFORMATION Garrett Driveway Dear Mr. Garrett: On October 18, 2012, the Division of Water Quality (Division) received your application dated October 4, 2012, requesting a 401 Water Quality Certification and Buffer Authorization from the Division for your project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. Please provide cross section details showing the provisions for aquatic life passage. 2. Please enumerate all riparian buffer impacts on the site plan and clearly label impacts (Buffer Impact 1, etc.). 3. Please locate all of the protected riparian buffers as overlays on the site plan, clearly showing Zone 1 and Zone 2. 4. This Office believes that the 4 pipes for this crossing are excessive and can be moved or reconfigured to minimize the impacts to the stream. Please revise the plans or provide additional information as to why 4 pipes are needed. 5. Please provide stream determination documentation on the site (upstream and downstream photos and DWQ stream ID forms). Pursuant to Title 15A NCAC 02H .0502(c) and Title 15A NCAC 02B .0233 (8), the applicant shall furnish all of the above requested information for the proper consideration of the application. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this letter by sending four (copies of all of the above requested information to the Wetlands, Buffers, Stormwater- Compliance and Permitting (Webscape) Unit, 1650 Mail Service Center, Raleigh, NC 27699- 1650. Please be aware that you have no authorization under Section 401 of the Clean Water Act or the Neuse Riparian Buffer Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
