Mr. Mike Padgett is requesting a minor modification of State Permit No. 85 -12, which was issued on July
25, 2012, for construction of a docking facility and bulkhead at 1015 1" StreetJn Surf City, Onslow County
CAMA Major Permit No. 85 -12 is scheduled to expire on December 31, 2015.
Mr. Padgett is requesting that the permit be modified to allow for construction of a boat basin (dug out
of high ground), reconfiguration of the docking facility to include the construction of a 12' x 18' uncovered
platform, 14' x 26' boathouse (with lift beneath), an additional 10' x 12' lift and 3' x 16' catwalk around the
uncovered lift. Lastly, the applicant is requesting approval to re -align the bulkhead to conform with the basin
design.

As proposed, the high ground basin would be dug along the northern side of the property
approximately 6' from the common property line of Mr. Padgett and Mrs. Lee. The basin would be cut
approximately 11' back into high ground and would measure approximately 14' in width, dredged to a depth
of -2' below the Normal Low Water (NLW) level. The high ground surrounding the basin, and the remaining
shoreline, would be stabilized by a vinyl bulkhead, which has already received approval under CAMA Major
Permit #85 -12. Excavated material, taken from the basin, would be staged on -site and used to backfill the
bulkhead. Following excavation of the basin, the applicant would install a 14' x 26' boat house, partially
within the footprint of the basin.
In addition to the proposed boat basin and boat house, the applicant proposes to reconfigure the
permitted docking facility. As proposed, a 12' x 18' uncovered platform would be constructed side -to the
proposed bulkhead near the center of the shoreline. A 5' x 10' access pier would extend- from - the - proposed..-.-. ----
deck (along the northern side) to a 3' x 16' catwalk. The catwalk would extend out be nd'the(liropbsed,l.0' x
12' boatlift, allowing access to the outer side of the boatlift.

Currently, the applicant has 55 linear feet of shoreline which is not enough to allow for the
construction of a boat house. However, if a permit modification is granted (for construction of a boat basin
created from high ground) the applicant would have approximately 77 linear feet of shoreline, thus allowing
for the construction of a boat house. The waterbody in which this activity is being proposed, is approximately
117' in width Therefore, the applicant may extend approximately 29.5' into the waterbody. As proposed, the
applicant has requested approval to extend approximately 25' into the waterbody which is less than what
would be allowed under current Rule. The applicant has received waivers from both adjacent riparian property
owners allowing encroachment into the 15' riparian corridor setback. As indicated on the work plan drawing,
the proposed bulkhead re- alignment (approximately 77') would not impact any wetlands.
The agent has submitted a money order (MO #323123788) in the amount of $100 00 for the
modification request.
This Office has no objection to the permit modification request.

This permit, issued on July 25.2012 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action, or may cause the permit to be null and void.

Shoreline Stabilization
1) The authorized bulkhead shall adhere to the alignment depicted on the attached workplan drawing.
2) The aligmnent of the authorized bulkhead shall be staked by the permittee and approved by a
representative of tl;e Division of Coastal Management within a maximum of 30 days prior to the start
of any construction. Failure to initiate construction within 30 days, or erosion of the shoreline by
adverse weather conditions shall require the alignment to be restaked by the pennittee and re-
approved by DCM within a maximum of 30 days prior to the new expected start of construction.

This permit action may be appealed by the permittee or
other qualified persons Nviihin twenty (20) days of the issuing
crate. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
nersonnel when the project is inspected for compliance
s Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2015
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.
