Robert Foy October 29, 2012 Page Two 9. PROJECT DESCRIPTION: The project site is located at 2216 Scotts Hill Loop Road, adjacent to the AIWW and Topsail Sound, in Wilmington, Pender County. To get to the site from Wilmington take US Hwy 17 N to Scotts Hill Loop Road (approximately 1.7 miles north of Porters Neck). Turn right onto Scotts Hill Loop Road and travel approximately 2.0 miles. The applicant's property will be located on the left hand side of Scotts Hill Loop Road, at house number 2216. The property is approximately 0. 83 acres with roughly 1 10 linear feet of shoreline frontage. The property extends from Scotts Hill Loop Road to the AIWW (which borders the site to the east). Existing man-made features on the property include a single - family residence, pier and docking system. The high ground portion is elevated approximately 8 -10 feet above the Normal High Water (NHW) level. Vegetation on the tract consists of lawn grasses, ornamental landscaping and shrubs. The high ground transitions to an area of high marsh consisting of Spikegrass (Distichlis Wicata), Salt Meadow Hay (Spartina patens), and sparse Black Needlerush (Juncus roemerianus). A 150' wide section of Smooth Marsh Cordgrass (Spartina alterniora) is located waterward of the high marsh, and completes the Wetlands transition down to the AIWW proper. The existing pier, located along the eastern property boundary, was authorized by CAMA General Permit #38955 on 6/06/12. The existing pier and docking facility extends toward the east, and terminates approximately 13S' beyond the outer edge of the marsh bordering the property. The existing docking facility includes a 16' x 18' "L- head" shaped platform, a 6' x 16' floating dock and a 12' x 12' boatlift. The width of the waterbody in this area of the AIWW is approximately 710' wide, as measured from the outer edge of marsh along the east side of the AIWW to the waterward edge of marsh along the opposing shoreline. Current water depths around the existing facility range from approximately -2.5' to -3.5', relative to Normal Low Water (NLW). The waters of the AIWW, adjacent to the project site, are classified as SA -ORW by the North Carolina Division of Water Quality. They ARE NOT designated as a Primary Nursery Area (PNA) by the North Carolina Division of Marine Fisheries; however, they are OPEN to the harvest of shellfish. The Pender County Land Use Plan classifies the surrounding high ground as Conservation and Resource Protection. PROPOSED PROJECT: The applicant proposes to expand and modify the existing docking facility (recently authorized under CAMA General Permit #38955) to allow mooring for up to five (5) vessels. As proposed, the existing access pier would be expanded in a landward direction approximately 28' (remaining 5' wide) to allow for a gentle slope up to the main run of the access pier, from the high ground. Additionally, the existing "L- head" shaped platform (16' x 18'), located at the terminal end of the access pier, would be partially covered by a 16' x 16' gazebo. A 5' x 17', elevated fixed finger pier (or "swim platform "), located along the northern side of the existing platform, would be the only other "permanent" structure added under this modified proposal. According to the applicant, the 5' x 17' "swim platform" would have two (2) tie pilings associated with it for mooring of water craft and water sports equipment. Lastly, the applicant proposes to remove the three (3) support pilings that are attached along the northern side of the existing 6' x 16' floating dock. As proposed, the floating dock would be anchored with pilings at opposite ends of the structure, thereby allowing use on both sides side of the dock (i.e. converting the floating dock from one slip to two). According to the application package, water depths in the immediate vicinity of the proposed dock expansion range from -2.5' to -3.5', relative to NLW. 10. ANTICIPATED IMPACTS As proposed, the planned development would incorporate approximately 373 sq. ft. of Public Trust and Estuarine Waters. The applicant has approximately 110 linear feet of shoreline allowing up to 880 sq. ft. of platform or docking space. As constructed, the total square footage of the existing facility (platform, finger piers and floating dock) equals approximately 288 sq. ft. and the addition would total 85 sq. ft. No impacts to Coastal or "404" wetlands would occur as a result of construction. Robert Foy October 29, 2012 Page Three As indicated in the application package, the planned development would encroach into the adjacent riparian corridor setback shared by the neighbor to the north (Moore); however, the applicant has obtained a written waiver (dated 9/23/12) allowing the encroachment. As designed, the proposed development would be located within 1/4 of the width of the waterbody (waterbody = 708' wide and the applicant's proposed project is to extend approximately 134' beyond the outer edge of marsh or 0.18% of the width of the waterbody). Additionally, all structures would be located outside of the U.S. Army Corp of Engineers Federal Channel Setback (100' from the edge of channel). Short term increases in turbidity could be expected due to piling installation.
