4a. Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:*
Existing conditions onsite consists primarily of forested land with a 25' wide existing sanitary sewer easement to the west, an existing 70' wide sanitary sewer easement to the south and
an existing structure and drive in the center of the properties. Additionally, there is one (1) perennial stream (SA), one (1) intermittent stream (SC), one (1) wetland (W1) located on the
property. 'SA' is located along the western property boundary. 'SC' is located at the far northern portion of the property along with adjacent features 'W1'. General land use in the
vicinity of the project is predominately rural residential with some wooded land. Umstead Road bounds the property to the north.

The purpose of this project is to construct a single-family residential development and its necessary infrastructure.

The overall project consists of the construction of a single-family residential development including but not limited to; roadway infrastructure, residential lots, utilities and an SCM.
Specifically, there is one (1) road crossing that impacts a wetland and a stream. There is also a perpendicular entry buffer impact to the west connecting to an existing sanitary sewer
(Zone 2 Impacts only), but considered "deemed allowable". Equipment typically used for construction and earthwork such as backhoes, bulldozers, excavators, graders, pavers etc. will
be utilized for this project.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
S&EC completed a wetland delineation and Neuse River Buffer evaluation for the entire property in order to identify natural resources so that impacts
could be avoided & minimized to the maximum extent practicable. Impact A is a proposed road crossing. Proposed impacts include permanent stream
and wetland impacts. This road crossing is necessary to provide access to the development from Umstead Road. Specifically, the shape of the
property limits where the road crossing is proposed, the conservation of tree save area, and the horizontal design criteria prevents the relocation of
the road crossing. Additionally, these impacts cannot be avoided due to the proposed pavement and sidewalk abiding by Durham typical street
sections. The position of the roadway was selected to allow for grade to be as steep as possible, and for proposed grade to tie back to existing grade
as soon as possible. Note: Zone 2 Riparian Buffer impacts that require a sanitary sewer connection to an existing manhole to the west is a deemed
allowable activity. This sanitary sewer connection will not cross a stream and the vegetation will be allowed to regenerated.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Silt fence with silt fence outlets will be installed in areas downstream of these disturbed area to help mitigate any impacts during construction of the
project. Grading will be done around these impacts to keep the proposed finished grade as close to existing as possible to limit the extents of
disturbed area.

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated Wetlands Programs" document
prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that many private developments are unlikely to cause
cumulative impacts, including projects such as urban in -fill, most residential subdivisions and small commercial developments as well as agricultural
and silvicultural operations. The Umstead Grove project is a residential development. Additionally, the project is located within the City of Durham ETJ,
therefore the adjacent properties that have potential for development will have the following regulations to protect downstream waters: 1) the Neuse
River Basin Riparian Buffer Protection regulations, these regulations require limited development within the riparian buffer area, in addition Best
Management Practices may be required that control nitrogen if diffuse flow cannot be achieved; 2) the Phase II NPDES Stormwater Permit Program,
this program includes permitting requirements for Municipal Separate Storm Sewer Systems (MS4s) in addition to post -construction stormwater
management requirements; and 3) the Water Supply, Watershed Protection Program which limits development densities as well as requires protective
riparian buffers. We anticipate that the DWR will advise us if any additional information is needed.

within 1-mile of the project boundaries. It was determined based on the search that there is one (1) elemental occurrences that are listed as federally
Threatened/Endangered within or within 1-mile of the project boundaries. This species is the Atlantic Pigtoe (Fusconaia Masoni), which is a freshwater
