The temporary rules proposed for impacts to wetlands and waters recently excluded from Clean Water Act jurisdiction
by the Navigable Waters Protection Rule are critical to the regulated public. The current permitting gap has existed for
over nine months already. Without these temporary rules, the regulated community will continue to experience
uncertainty that makes environmental compliance more difficult and expensive than necessary. Due to the length of
time required for permanent rulemaking, please adopt the proposed temporary rules to provide regulatory relief while
the permanent process proceeds.
