The Stream Buffer Use Request Form that you submitted to the County on April 13, 2021 has been approved. Guilford County is the locally delegated authority for enforcing the Jordan Lake stream buffer requirements; please see the Guilford County Unified Development Ordinance Article 9.1.I Stream Buffer Width Requirements according to the Guilford County Unified Development Ordinance, 9.1.I Below are the impacts broken down for each use as described in your application, and associated mitigation, if required. According to Table 9.1.6 Table of Uses in the Guilford County Unified Development Ordinance, your impacts to Zone 1 and Zone 2 of the buffer for a Non-Electric Utility Perpendicular Stream Crossing, that disturbs less than 40 linear feet of riparian buffer, with a maintenance corridor greater than 10 feet in width; is Allowable. For detailed buffer impacts, please see attached plan. According to the Guilford County Development Ordinance 9.1.I.4.e.12.c The required area of mitigation shall be determined by applying the following multipliers to the impacts determined in Section 9.1.I.4.e.12.c of this Ordinance to each zone of the riparian buffer: (I) Impacts to Zone One of the riparian buffer shall be multiplied by three; (II) Impacts to Zone Two of the riparian buffer shall be multiplied by one and one-half; and (III) Impacts to wetlands within Zones One and Two of the riparian buffer that are subject to mitigation under 15A NCAC 2H .0506 shall comply with the mitigation ratios in 15A NCAC 2H .0506. According to Table 9.1.6 Table of Uses in the Guilford County Unified Development Ordinance, your stream buffer impacts for a Non-Electric Utility Other Than Perpendicular Crossing, for Zone 1 is Allowable with Mitigation, and for Zone 2 is Allowable. This approval is valid only for the purpose and design that was described in the application. If any modifications are made to the project a written notification describing the changes, must be submitted to the Guilford County Planning & Development Department, Watershed Protection & Stormwater Management Division. If the property is sold, the new owner must be given a copy of the certification and approval letter and is thereby responsible for complying with all conditions.
