Hi Dave – not a problem….I’m here to help on anything….
DMS states in our letters that we will accept mitigation responsibility and provide the mitigation for the impacts
associated with a project in the amount specified by the USACE and NCDWR in the 404 permit and/or 401 water quality
certification. It is not DMS’ role to prescribe the amount of mitigation required to offset stream, wetland and/or buffer
impacts. The USACE and NCDWR determine the mitigation ratio and the final mitigation amounts based on the size and
quality of the impacts during the permitting process. In the past, DMS did state in the acceptance letters the amount of
impacts and the amount of mitigation that would be provided which made us appear to have regulatory authorities
which we do not. So, DMS no longer states the amount of mitigation in its acceptance letters and refers only to the
impacts, thus allowing the USACE and NCDWR to make their mitigation determinations based on the applicable rules
and regulations.

Just checking on mitigable impacts presented in DMS letter. It’s been forever since I’ve dealt with one of
these.

Bridge plans show that actual mitigable buffer impacts in Zone 1 are 6,207 ft and 6,783 ftfor Zone 2 as
accurately reflected in letter from DMS. However, those impacts are to be tripled (3:1) for Zone 1 and (1.5:1)
for Zone 2 per 15a ncac 02b.0295. So, the question is, should the letter reflect actual impacts or mitigable
impacts after zonal mitigation ratios are applied or is that accomplished later?
