Good afternoon Kim,
On March 1, 2021, the Division of Water Resources received your application requesting a 401 Water Quality
Certification for the development of Lot 13 at the Sparrow's Bend subdivision in Pender County. The project has been
assigned DWR #20170118v2. The DWR has determined that your application is incomplete and cannot be processed.
The application is on -hold until all of the following information is received:
The proposed permanent impacts to wetlands detailed in the ePCN application are not consistent with the impacts
shown on the submitted plan. Specifically the ePCn indicates 0.08 acres of impacts and drawing states 2,060 sq. ft. =
approx.. 0.05 acres of impacts. Please clarify this and the proposed mitigation for the impacts.
A site visit was made by DWR and USACE staff on March 30, 2021 to evaluate the proposal. It was determined that the
site is in non-compliance with the DWR 20170118v1 GC 4139 that was issued for the development of the
subdivision. Specifically Lot 13 and the Lots located at the end Road "E" are not shown on the DWR approved plan. The
platted and filled lots not shown on the DWR approved plan should be included with this request. Wetland fill that has
resulted from the slope failures at the rear of these lots should also be included as part of this request.
Your application asserts the permanent wetland fill on Lot 13 is necessary based on County requirements to relocate
the road, please provide any correspondence from the County that supports this claim. Please provide a statement of
purpose and need for the proposed wetland fill beyond the relocated retaining wall and beyond the toe of slope of the
adjacent Lots. It may be necessary to remove the proposed wetland fill located beyond the retaining wall in an effort to
demonstrate avoidance and minimization of impacts. Please contact me if you have any questions or I may be of
