I am providing the following additional information with respect to the noted violation: Monthly Average Exceeded -Effluent Flow -Limit Value .45; Reported Value .503: 1) February with 28 days is, as you know, the shortest month of the year. If the "FEB month" had 30 or 31 days, then based on total million gallons (14.0084), the monthly average would have been .469 MGD and .454 MG, respectively. Still in excess, but not by as much. 2) We had above -normal rainfall in February, 2021. Please refer to the attached chart. From Weatherspark: "To show variation within the months and not just the monthly totals, we show the rainfall accumulated over a sliding 3-day period centered around each day of the year. Rose Hill experiences significant seasonal variation in monthly rainfall. Rain falls throughout the year in Rose Hill. The most rain falls during the 31 days centered around August 19, with an average total accumulation of 5.2 inches. The least rain falls around November 9, with an average total accumulation of 2.7 inches." Please also refer to the attached table showing average monthly rainfall. The average of these averages was .235766 MGD/month for the entire year, less than fifty percent (50%) of the permitted amount. Based on all the data I have provided, please consider February 2021 as an anomaly and not assess the Town of Rose Hill a civil penalty. We are making every effort to limit inflow and in filtration. You can witness from March 21, our monthly average was back down to normal-.3022645 million gallons. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) may be assessed against any person who violates or fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S. 143-215.1. If you wish to provide additional information regarding the noted violation, request technical assistance, or discuss overall compliance please respond in writing within ten (10) business days after receipt of this Notice. A review of your response will be considered along with any information provided on the submitted Monitoring Report(s). You will then be notified of any civil penalties that may be assessed regarding the violations. If no response is received in this Office within the 10-day period, a civil penalty assessment may be prepared.
