RE: CAMA Permit Application submitted by John Sikorski
Dear Mr. Davis,
We own residential property located at 140 Waters Lane, Gloucester, Carteret County, North
Carolina .
We have recently learned that an adjacent riparian property owner John Sikorski has submitted
an application to construct a 10 slip docking facility in the shallow waters of the Straits
immediately offshore of his undeveloped property at 610 Pigott Loop Road.
We would like to inform you that we strongly object to Mr. Sikorski's application. Below is a
list of the reasons for our objection.
1.) A quick aerial survey of the Straits reveals no other projects of this size. A 10 slip 126
foot wide dock with boat lifts would create an impact that seems excessive for a
single property owner. The docks that currently exist on the Straits generally service
one or two slips. I'm concerned that if this permit is granted as submitted it will set a
precedent for single property owners building ever larger docks without
demonstrating any need for such a facility. To my knowledge Mr. Sikorski owns one
lot on the Straits.
2.) The area of the proposed dock is in very shallow water which requires careful use
and stewardship. We use the dock on the adjoining property and in this same water
depth. We occasionally have to walk our skiff away from the slip in low water. The
installation of boat lifts with solid cradles and slips to accommodate boats up to 2S ft
as described in the application would require considerable and consistent "blowing
out" of the slips. My family and my neighbors enjoy oysters and clams collected in
the waters surrounding the existing docks. Concentrating 10 boats on one dock will
create a much greater impact on shellfish and SAV than the current structures on
the Straits.
3.) Mr Sikorski's application contains no information or plans demonstrating a need for
such a large facility. The dock will service a vacant lot as submitted. It wouldn't seem
possible to evaluate the reasonableness of the application or the environmental
impact without a great deal more information.
We would support Mr. Sikorski in applying for a 1 to 2 slip dock that would be in proportion to
the docks in the area.

My understanding is that you have or may have jurisdiction over some aspects of
possible development of areas lying along the northerly edge of the Straits, in Carteret County,
N.C. for which Mr. John Sikorski has applied for a permit to erect 10 slip boat facility with 10
boat lifts. As owner of a nearby site I have written Mr. Braxton Davis, Director of NC Division
of Coastal Management noting my objections to Mr. Sikorski's application, a copy of which is
enclosed for your information.
I would be pleased to elaborate should it be helpful in your considerations.

Mr. Larry Page, on behalf of the Page family LLC at 620 Pigott Loop Road,.
Gloucester, N. C. kindly shared with me his recent letter to you objecting to John Sikorski's
application for construction of a 10 boat slip dock with 10 boat lifts adjoining the Page
properties on the Straits. My properties immediately adjoin the Page family property on the east
which, together with the Sikorski property on Page's west side, lie in a sheltered cove on the
northern bank of the Straits. I am writing to share and strongly indorse Mr. Page's objection to
Mr. Sikorski's application.
I first acquired my site in 1978 after taking refuge from a hurricane when I first
discovered the unspoiled natural ambiance of the community. Having sold my family cottage at
Pine Knoll Shores shortly before to escape the commercialization and congestion on the beach.
it has afforded me multiple recreational facilities and the serenity of unbridled privacy which
has become increasingly difficult to realize in recent years. I became alarmed a few years ago
when the local newspaper published an article describing an effort by the Coree Indians to
develop a resort community on Browns Island, before finally recognizing it to be an "April's
Fool" spoof . More recently I was pleased to note another news article suggesting that a
conservation organization had received a gift to acquire and preserve a portion of Brown's
Island from commercial development, tending to protect and preserve the community..
So protective I have become of the qualities of the neighborhood and concerned
about possible commercialization that in 2007 when I learned that the acreages adjoining me
had been surveyed for development and subdivision, I struggled to acquire the site to preserve
and protect it from development, without any specific plans of my own..
The overwhelming impression is that Mr. Sikorski, whose property has no structure
on it at this time, is developing a plan to convert the cove into a recreational marina, drastically
transforming the area into commercial operations of the sort I have take such pains over the

years to escape. If he succeeds, I may be relegated to abandoning the retreat I have cultivated
for so many years..
I therefore write to lodge my objection to Mr. Sikorski's efforts to establish a multi
unit boat dock with 10 separate boat lifts which will inevitably morph into a commercial
operation. with all the traffic and activity such marina would entail.

Dear Mr. Davis:
My family owns residential property located on the Straits at 620 Pigott Loop Road in
the community of Gloucester, Carteret County. We have recently been notified as an
adjacent riparian property owner to an application by John Sikorski to construct a 10 slip
docking facility in the shallow waters of the Straits immediately offshore of his
undeveloped property located immediately to the west of our property at 610 Pigott
Loop Road. This letter is to inform you that our family strongly objects to Mr. Sikorski's
project and believes it should not be processed or permitted for a number of reasons.
First, I believe it's important to note that no details were provided in his application to
any associated upland development. The project narrative which accompanied the
application states: "Future project plans are contingent upon the receipt of permits for
the docking facility and other proposed improvements to the basin and the final design
of these components ". In other words if I built it, they will come! There has been no
demonstrated need for this number of slips much less proposing a project that will
minimize impacts to the environment.
Since this property is not zoned, it is reasonable to assume that this 10 slip docking
facility will be commercial in nature and will have a much higher use and resultant
negative impacts on the habitat and resources of the area. No mention or provisions
have been made for such things as parking, vehicular access, lighting requirements,
etc. What impacts will storm water runoff have from built upon areas that may not
require a CAMA permit because of their locations?
The waters adjacent to this property are classified as SA and are open to the harvesting
of shellfish and it is very important that any future development be done in a responsible
manner. Allowing the piecemeal development of this property is not responsible. The
Division of Coastal Management should demand that Mr. Sikorski disclose his
development plans before processing this application. This way direct and cumulative
impact can be evaluated.
Perhaps the most important reason to deny this application is the adverse impact this
project will have on the shallow water habitat and estuarine resources of the Straits
(which is the public's resource). To help us understand the project's impact on the
environment, we engaged Charles Jones of Jones Coastal Consulting to conduct an "in
the water" analysis of the project and its impacts. As you most likely know, Mr. Jones
has an extensive knowledge of the estuarine resources in this and similar areas along
the coast of North Carolina and in particular Carteret County. Mr. Jones knows the
potential impacts of development projects like this one can have on these resources.
Mr. Jones had scheduled a site meeting last week with Mr. Barry Guthrie of your staff to
further clarify and identify the parameters of Mr. Sikorski's docking facility but Mr.
Guthrie had to postpone at the last minute. Mr. Jones and Mr. Guthrie will be
rescheduling their meeting in the near future but I requested Mr. Jones to go ahead and
make his observations so that I could respond to you in a timely fashion.
While not knowing precisely the exact location of the boat slips, Mr. Jones feels he was
able to identify their general location. Mr. Jones had scheduled his site visit to coincide
with low tide but feels that because of the influences of the wind, there was no normal
low water on that day. Even with the lack of a true normal low water, Mr. Jones
measured the area within the presumed boat slip area and found the majority of his
soundings to be 2 Y2' deep with only a few being at a depth of 2'8 ".
Mr. Jones also found that a significant portion of the area within and offshore of the
proposed boat slips to be covered with clam bags which were evidently used and
abandoned by the individual who had a shellfish lease in this area. Mr. Jones was
unable to conduct much of a shellfish or submerged aquatic vegetation (SAV) survey
because of the presences of these bags but was able to rake some clams and some
scattered but rooted SAV. As noted on the permit drawings, just inshore of the boat
slips a significant bed of SAV covers the bottom. It can be assumed that with the
existing shallow water depths in the boat slip area and with the presence of scattered
SAV in the area not covered with clam bags, this is clearly a SAV habitat area.
These impacts will be magnified not only in normal low water conditions but in periods
of raising and falling tides. These impacts are further magnified because of the depths
the boat lift cradles need to be in to properly operate. The submitted plans clearly show
the additional limitations that the cradle beam and wood bunk boards will impose. This
will most likely encourage boat owners to kick -out their boat slips so that they use their
boats during unfavorable tidal conditions.
I think it's also important to note that we do not have an objection to Mr. Sikorski
exercising his riparian rights and constructing a pier with 1 or 2 boat slips for this
property. We feel that the limited use of this type of docking facility would not have the
type of negative impacts to the environment nor to the enjoyment and value of our
property as his present proposal has.
In summary, our family is in complete opposition to this 10 slip docking project. We feel
Mr. Sikorski has not picked the proper location, design nor demonstrated any need for
this facility. We further believe that the operation of this 10 slip facility will have direct
and secondary impacts to shellfish and SV resources in the areas. We further believe
that Mr. Sikorski should be required to fully disclose his development plans for this
property prior to permit processing so that it can be properly evaluated for direct and
cumulative impacts and consistency with the local land use plan and applicable county
ordinances.
