NC0026611 Morehead City WWTP Carteret County Dear Mr. Hamilton: The Division rFceived your letter of November 2, 2007 concerning the permit issued on October 12, 2007, specifically questioning the appropriate sample type for mercury. The issued permit required a composite sample but in the past the requirement was a grab sample. The Division agrees that this was an error and the sample type for mercury should be grab instead of composite. Enclosed find a corrected page for the Effluent Limitations and Monitoring Requirements Please replace this page in your permit. You also inquired about the water quality standards or limits the facility would be aiming for when testing for cyanide, mercury, copper, and zinc. Since the facility discharges into tidal waters the standards are applied without dilution. The applicable standards are 1 µg/1 for cyanide, 0.025 µg/1 for mercury, 6 µg/1 for copper, and 67 µg/1 for zinc. If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699- 6714). Unless such demand is made, this decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Quality or permits required by the Division of Land Resources, the Coastal Area Management Act or any other Federal or Local governmental permit that may be required. The Division shall consider all cyanide values reported below 10 µg/1 to be "zero" for compliance purposes. Hovever, Discharge Monitoring Reports (DMRs) shall record all values reported by a North Carolina-certif ed laboratory (even if these values fall below 10 µg/1.) 6. Effluent moni oring may be deleted in the future upon written notification of the Division, if the permittee pro des updated effluent data (at least 12 data points) that shows no reasonable potential to exceed applica b le state water quality standards. 7. First, in the past, the low-level mercury testing was done on a grab sample; the new permit specifies a composite sample, is this correct? Second, can you provide us with the water quality standards, goals or limits we are aiming for with the cyanide, mercury, copper and zinc testing?
