We own residential property located at 140 Waters Lane, Gloucester, Carteret County, North
Carolina .
We have recently learned that an adjacent riparian property owner John Sikorski has submitted
an application to construct a 10 slip docking facility in the shallow waters of the Straits
immediately offshore of his undeveloped property at 610 Pigott Loop Road.
We would like to inform you that we strongly object to Mr. Sikorski's application. Below is a
list of the reasons for our objection.
1.) A quick aerial survey of the Straits reveals no other projects of this size. A 10 slip 126
foot wide dock with boat lifts would create an impact that seems excessive for a
single property owner. The docks that currently exist on the Straits generally service
one or two slips. I'm concerned that if this permit is granted as submitted it will set a
precedent for single property owners building ever larger docks without
demonstrating any need for such a facility. To my knowledge Mr. Sikorski owns one
lot on the Straits.
2.) The area of the proposed dock is in very shallow water which requires careful use
and stewardship. We use the dock on the adjoining property and in this same water
depth. We occasionally have to walk our skiff away from the slip in low water. The
installation of boat lifts with solid cradles and slips to accommodate boats up to 25 ft
as described in the application would require considerable and consistent "blowing
out" of the slips. My family and my neighbors enjoy oysters and clams collected in
the waters surrounding the existing docks. Concentrating 10 boats on one dock will
create a much greater impact on shellfish and SAV than the current structures on
the Straits.
3.) Mr Sikorski's application contains no information or plans demonstrating a need for
such a large facility. The dock will service a vacant lot as submitted. It wouldn't seem
possible to evaluate the reasonableness of the application or the environmental
impact without a great deal more information.
We would support Mr. Sikorski in applying for a 1 to 2 slip dock that would be in proportion to
the docks in the area.

8. PROJECT SUMMARY: The applicant is proposing to construct a 10 -slip docking facility
and highground grading, located on The Straits in Gloucester.
9 NARRATIVE DESCRIPTION:
The John Sikorski project is located at 610 Pigott Road in Gloucester, Carteret County. The
project site is found by traveling on Hwy. 70E into Smyrna. Turn south(right) onto
Marshallberg Road and travel 1.0 miles and turn west(right) onto Straits Road. Travel 0.75
miles on Straits Road and veer south(left) onto Pigott Road. Travel 1.2 miles on Pigott Road
and the site is located on the left, at the intersection of Pigott Road and Waters Lane.
The subject properties total 7.86 acres and average +4.5' in elevation above NHW. The
parcel is wooded with a majority of pines; the waterward half of the parcel has been cleared
of most woody growth. No structures exist on the highground. Presently, the shoreline is
stabilized by rip -rap. The shoreline, waterward of the rip -rap, consists of approximately 20-
25' of Spartina alterniflora. Located on the shoreline, at the center of the property, is a small
coastal /404 wetland feature which extends approximately 110' landward of the existing
shoreline alignment. This feature is approximately 110' in length and 20' in width. The
NHW contour follows this feature approximately 40' landward of the current alignment on
the shoreline and the coastal wetland extent lies approximately 16' landward of NHW. The
remainder of the feature is classified as Section 404 Federal Wetlands. A USACE
jurisdictional determination is on file for this feature, signed July 26, 2012 with USACE
Action ID #: 2012 - 00547. The Straits is approximately 4,600' across at this location and the
subject property has a shoreline of approximately 342'. There was a shellfish lease area
located approximately 140' offshore and to the west of the proposed facility. The lease area
is no longer active and has not been utilized in many years. The derelict shellfish bags can
still be observed onsite. Large areas of SAV are located from immediately waterward of the
shoreline to approximately 150' offshore, all slips are proposed waterward of the areas of
SAVs. Water depths at the location of the proposed slips are -2.5 to -3.0' NLW and located
waterward of the area of SAVs. The substrate at the location of the docking facility is sand.
There are presently residential piers on both sides of the proposed facility, at distances of
approximately 110' to the east and 130' to the west.
The Division of Water Quality classifies this area of the Straits as SA -HQW. This area is
NOT classified as a Primary Nursery Area by the Division of Marine Fisheries. The Carteret
County LUP Classification for this project is Conservation along the shoreline within the 75'
AEC. This portion of the Straits is open to harvesting of shellfish.
10. PROJECT DESCRIPTION:
The applicant is proposing to construct a docking facility to accommodate 10- slips. A 262' X
6' walkway connected to two 60' x 6' platforms extending east and west. To access the pier,
a proposed walkway would attach to the pier from the east and west. The eastern walkway
would be 48'x 6' and the western walkway would be 33'x 6'. Total length for the facility
would be approximately 212' as measured from the waterward edge of the marsh. Four 28' x
3' finger piers would be utilized to gain access to the boat slips. Proposed slips would be
located at a minimum depth of -2.5' NLW. Two slips are proposed at depths of -2.5' NLW
and eight are proposed at approximately -2.8 to -3.0' NLW. At the closest location, slips
would be located approximately 144' from the closest waterward extent of coastal wetlands
and 177' waterward of the NHW contour. The offshore slips would be located approximately
215' waterward of the NHW line. Above NHVi, 2,000 ft= of highground disturbance, would
occur in the form of grading, the area adjacent the 404 /Coastal 1, ;-etland feature would be
smoothed by machinery. The project would be outside of the 15' riparian setback. On the
east side, the Facility would be located 30' from th6 15' setback l!ne and 80' on the western
side. The facility would be for vessels of various sizes„ from 14* to 20' ir. length. Each slip is
proposed to include a 12.5' x 12.5' boatlift. No mooring piles are proposed in the slips.
11. ANTICIPATED IMPACTS:
The proposed docking facility would result in 26,460 ft2 of open water being incorporated
and 2,316 ft2 of shallow bottom shading impacts. A portion of the pier and access walkways
would cross an area of coastal wetlands causing 462 ft2 of coastal wetland shading impacts.
The project site consists of approximately 342' of shoreline. The docking facility would
provide mooring for 10 vessels. The minimum water depth at the proposed slips is -2.5'
NLW, with eight slips located in -2.8' to -3.0' NLW. Each slip is proposed with a boatlift.
With a lift in each slip, a boat is less likely to sit on the bottom during periods of low tide
as well as decrease any shading impact that would be expected from a boat in a slip. The
shallow bottom directly adjacent this project possesses large areas of SAV. The proposed
slips are located waterward of all areas of SAVs. Some temporary effects to the SAVs
would be expected during the construction of the pier. An increase in turbidity will occur
while setting pilings. On the highground, an area of 2,000 ft2 would be smoothed and
graded. If proper sedimentation and erosion control measures are implemented, then
sediment runoff into the adjacent wetlands and waters should be minimized. The waters
surrounding the structure are open to shellfish harvesting. No coastal or 404 wetland would
be filled or excavated during this project.

Introduction
John Sikorski is the owner of a tract of land located adjacent The Straits at 610 Pigott Road (SR 1343) in
Gloucester, Carteret County. He proposes to construct a 10 -slip dock with finger piers, platforms, and
boat lifts, and elevated walkways connecting the pier with highground. Mr. Sikorski also proposes to
level the area around the top perimeter of an old existing boat basin.
Site Description
The Sikorski tract consists of 8.13 acres. The approximate elevation of the property is 4.5' above Normal
High Water (NHW). The north portion fronting Pigott Road is densely wooded, while the vacant south
section was previously cleared. The southern section now consists of grass, shrubs, small trees, as well
as wetland vegetation along the shoreline. Vehicular access to the waterfront (southern) portion of the
site is via Waters Lane from Pigott Road.
At least one residence was previously located on the site, and components of two old septic systems are
also present. Rock riprap is found along the shoreline on either side of the mouth of the basin. The total
shoreline of the tract measures 342 feet. An old highground boat basin believed to have been dredged
in the 1950's is also on the property. One residence, the boat basin, and riprap appear on a 1963 survey
of the property prepared for a previous owner.
The basin has not been maintained and is no longer navigable. Both coastal and non - coastal wetlands
are found in and around the boat basin and shoreline. A copy of the jurisdictional determination
approved by the US Army Corps of Engineers in July 2012 is included with this submittal. Staff of the NC
Division of Coastal Management provided assistance with the delineation of coastal wetlands and the
locations of Normal High Water (NHW) as shown on project plans.
The width of The Straits at the project site is approximately 4600'. The edge of the channel is located
about 1650' from NHW.
Submerged aquatic vegetation (SAVs) was observed at the site in areas with less than -2.0' NLW. All
boat slips have been located in a minimum of — 2.5' NLW.
No shellfish were observed in the area surveyed for this project.

The property is unzoned, but under the planning jurisdiction of Carteret County T he area is subject to
the requirements of the Carteret County Downeast Conservation Overlay (DECO) district, although it
does not appear that DECO imposes any local requirements applicable to the proposed work.
Project Description
The project consists of the construction of a 10 -slip clock with elevated walkways connecting the pier
and highground and leveling of the top of the perimeter of the existing basin.
Project plans show the position of the proposed dock offset slightly west of the center of the mouth of
the basin. The pier measures 262' x 6' feet, with the structure extending 235' into The Straits from an
extension of the NHW line across the mouth of the basin.
Two elevated walkways (labeled as "boardwalks" on project plans) at the northern end of the dock
provide pedestrian access from the highground onto the pier, spanning wetlands. On the west the
elevated walkway measures 34' x 6', with the elevated walkway on the east measuring 48'x 6'. The
walkways will be elevated a minimum of 3' above the wetland substrate.
Two platforms measuring 60' x 6' extend from both sides of the dock near the waterward end, with four
finger piers measuring 28'x 3' extending from the platforms. Two boatslips are located behind the
platforms, with the remaining eight slips positioned in front of the platforms. The boatslips are located
in a minimum of -2.5' NLW.
Boatlifts measuring 12.5' x 12.5' are proposed for each slip, for a total of 10 lifts. Typical boat length to
be accommodated is 25' or less.
The proposed docking facility will be located 110' from the nearest dock on the east and 130' from the
closest dock on the west. It will be 45' from the adjacent riparian property lines on the east and 98' on
the west.
No wetlands will be impacted by the proposed work around the top perimeter of the basin. This project
component is described below under Upland Development.
Upland Development
A small amount of clean fill (approximately 30 cubic yards) will be brought to the site to level the top of
the perimeter of the basin. Areas to be leveled adjacent the basin are shaded on the enlarged project
plan.
No impervious or built -upon surfaces are proposed. Approximately 2000 square feet will be disturbed in
the construction of the pier walkways and leveling of the basin perimeter.

Construction Methods
One barge with pile- driving equipment will be used for construction of the docking facility. The barge
will be stored in deep water at night. Conventional equipment and methods will be used for
construction of the highground portions of the walkways associated with ; t,,e pier. This equipment will
be stored on highground.
A small tractor with box blade, one dump truck, and possibly a small front -end loader will be used for
leveling the perimeter of the boat basin. This equipment will also be stored on upland areas of the site.
Care will be taken during construction to avoid impacts to wetlands. Grading as indicated by the
finished contours shown on project plans will be followed immediately with permanent stabilization of
disturbed areas with sod or grass seed and mulch. No wetlands will be crossed in transporting
equipment to the project site.
Stormwater
No current plans for further development of the property have been prepared. Future project plans are
contingent upon the receipt of permits for the docking facility and other proposed improvements to the
basin and the final design of these components. The property owner is aware that future development
of the site will require stormwater permitting, but at this point it is not practical to prepare additional
plans until the outcome of this permitting process is known. Once permits for the current submittal are
finalized he will be able to proceed with plans for additional highground development, including
applicable stormwater permitting.
Summary
John Sikorski proposes to construct a 10 -slip pier with platforms, finger piers, and boatlifts at his
property located adjacent The Straits in Gloucester in eastern Carteret County. The pier will be located
at the mouth of an existing boat basin and will be accessed from the highground by walkways elevated
over wetlands. He also proposes to level the top perimeter of the basin. Due to lack of maintenance and
use, the basin originally dredged in the 1950's is no longer navigable. However, no dredging is proposed.
All boat slips are situated in minimum water depths of -2.5' NLW and beyond the extent of SAVs
observed at the site. No shellfish resource was observed.
Placement of fill and grading around the top perimeter of the basin are the only proposed
upland development. No impervious surfaces are proposed. Future development plans for the
tract are dependent upon the outcome of the current permitting process and the final design of
the dock and other improvements. Approximately 2000 square feet will be disturbed by this
project.
