9. PROJECT DESCRIPTION:
The project site is located at 1324 Harbour Watch SW, in the Ocean Harbor Estates Subdivision,
adjacent to the Atlantic Intracoastal Waterway (AIWW), in Calabash, Brunswick County. To locate the
property from US 17 S near Shallotte, travel south to NC Highway 904 turn left and travel
approximately 2.2 miles to NC Highway 179/Old Georgetown Road SW, turn right and travel
approximately 3.8 miles to Beach Drive SW. Turn left onto Beach Drive SW and travel approximately
1.6 miles to Ocean Harbor Golf Club Road SW. Turn right onto Ocean Harbor Golf Club Road SW and
travel approximately 0.8 miles. Take the second left onto Harbor Gate North Drive SW and make an
immediate left onto Harbor Watch SW. The property is located within a gated subdivision; the
applicant's agent can be contacted for access to the gate. The property will be located on the left
hand side of the road.
The property consists of a 0.64 acre lot, with an approximate shoreline length of 101 feet. The
highground portion of the property ranges from approximately 4 feet to 25 feet above mean high
water (MHW) and is primarily vegetated with native trees, shrubs and grasses. The high ground has
been cleared for the construction of a single family residence with pool and retaining wall, this
development has been authorized by CAMA Minor Permit Calabash # 2012 -01. The authorized
retaining wall has been constructed landward of the wetlands and the residence construction is
underway. The high ground of the property transitions to an area of mixed coastal and 404 -type
wetlands, which ranges from approximately 15 feet to 50 feet in width to the Normal High Water
(NHW) boundary. Wetland vegetation consists of: Cattails (Typha sp.), Spike Grass (Distichlis spicata),
Sea Lavender (Limonium spp.), Sea Oxeye (Borrichia frutescens), Groundsel -bush (Bacchorus
halimifolia) and Wax Myrtle (Myrica cerfera). The property then transitions, from the NHW boundary
water ward, to an area of low marsh consisting of Smooth Cord Grass (Spartina alterniflora). The
Spartina extends approximately 400 feet to edge of vegetation and the Mean Low Water (MLW)
contour is located approximately 100 feet water ward of the edge of vegetation (see drawing 1 of 2).
The Town of Calabash Land Use Plan classifies the upland areas of the project site as undeveloped. The
waters of the AIWW are classified SA by the Division of Water Quality. The project area is designated
as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is OPEN to the harvest of
shellfish.
10. PROPOSED PROJECT:
The applicant proposes to construct a private pier with a gazebo, floating dock and boat house with
lift. As proposed, the access pier would measure approximately575 feet in length, of which 535 feet
would extend beyond the NHW boundary. The proposed access pier would measure 6 feet in width
and would extend to the south from the retaining wall towards the AIWW. The access pier would then
begin to span the wetlands, consisting primarily of Smooth Cord Grass and would extend water ward
approximately 40 feet to the NHW boundary. The proposed 6 feet wide pier would then extend
approximately 415 feet to the water ward edge of vegetation. The proposed access pier would
continue approximately 120 feet over open water toward the AIWW channel approximately 120 feet
in length. The pier would then terminate at a covered L -head platform measuring approximately 16
feet in width by 16 feet in length, as measured from the roof drip line. The proposed gazebo would
be connected by an access ramp to a proposed 14 feet wide by 14 feet long floating dock that would
extend to the northeast and would be oriented parallel to the AIWW channel. A boatlift, measuring

approximately 12 feet in' length by 12 feet in width, would be installed along the southwest side of the
docking facility. As proposed the boatlift would be covered by a 12 feet wide by 24 feet long
boathouse, as measured from the drip line dimensions. The proposed boathouse would be oriented
perpendicular to the channel. The applicant states that the existing water depths in the location of the
proposed floating dock and boatlift range from approximately -1.25 feet to -0.05 feet at Normal Low
Water (see drawing 1 of 2). The applicant has stated that the facility would be constructed with
timber stops approximately 2 feet above the bottom substrate to prevent disturbances to the shallow
bottom habitat (see drawing 2 of 2). As proposed, the structure would provide docking space for two
(2) vessels; one lift slip and one slip on the outboard edge of the proposed floating dock. The
applicant has stated that handrails would be constructed on the east and north sides of the floating
dock that would prevent vessels from mooring on the landward side and east side of the floating dock.
The applicant states the width of water body in this location of the AIWW is approximately 542 feet.
As proposed, the docking facility would extend approximately 535 feet water ward of Mean High
Water and approximately 135 feet water ward of the edge of marsh. As proposed, the docking facility
would be aligned to meet the quarter width of the water body distance and as proposed, would
extend to within 8 feet of the 80 foot AIWW setback line.
11. ANTICIPATED IMPACTS
The proposed pier system construction would incorporate approximately 1,460 sq. ft. of Estuarine
Waters and Pubic Trust Area and would shade approximately 2,730 sq. ft. of Coastal Wetlands,
consisting primarily of Smooth Cord Grass. The proposed access pier would result in the disturbance of
approximately 240 feet of high marsh. Minor increases in turbidity should be expected during
construction. The proposed docking facility would extend a total distance of approximately 535 feet
into the water body as measured from the mean high water boundary of which approximately 135
feet would extend into open water within a water body which measures approximately 542 feet in
width. This distance would conform to the 1/4 width rule. The structure, as proposed, would not
encroach into either of the adjacent 15' riparian corridor setbacks or the 80 foot federal channel
setback.

PROJECT: This application is for the proposed construction of a 6' wide
575' long pier leading to a 14'x14' covered fixed dock. Adjacent to the fixed
dock will be a14'x16' floating dock on one side and a 12'x24' boat house
with a 10,0001b boat lift on the other. The pier will begin at a newly
constructed retaining wall and extend 575' @ 9' elevation to the fixed dock.
All proposed construction will remain within the riparian corridors and will
not encroach on the USACE right of way or the quarter width of the water
body, [ ICW ).
CONSTRUCTION MEATHODS: The proposed pier and dock structures
will be constructed according to the prepared drawings by Kenneth H. Lacy
of Cape Carteret, NC, 252 - 393 -2747 and consistent with the building codes
of the Town of Calabash and Brunswick Co. Pier and dock pylons will be of
marine grade 8" diameter an driven with a hydraulic hammer to a depth of
8' or refusal. All lumber will be 2" thick marine grade, all fasteners will be
hot dipped galvanized or stainless steel. Fixed dock and pier will be
constructed to carry a live load of 100lbs PSF. The floating dock will be of
typical construction and carry a standard live load of 40lbs PSF and will be
secured with 4 pylons 10" in diameter. The boat lift will be installed as per
manufactures instructions. A 16' manufactured aluminum walk way will be
installed as per directions leading from the fixed dock to the floating dock.
All construction will be done by NC Boat Yard LLC, Jeffery N. Simmons,
910 - 842 -8888 and with an estimated time of completion of 60 days,,;

This letter is being sent to you as notification that a CAMA permit
has been applied for the construction of a 575' pier leading to
docking facilities along the ICW adjacent to your property.
Mr. Gibby Lepsig and his wife Tina are in the process of building a
new home in Ocean Harbour and have applied for this permit.
The process for obtaining this permit requires notification of all
adjacent property owners of this permit request and to include a
copy of the completed application. Upon receiving this letter of
notification you will have 10 days to contact the Division of
Coastal Management should you have any objections. We are not
requesting for you to waive any setbacks at this time, all proposed
construction will be within the established riparian setbacks. If you
have no objections to this permit you may keep this notification for
your records and you will not need to return the enclosed form.

16'x16' roof, on one side of the fixed dock a 14'x14' floating dock is proposed, accessed by a 4'x16' aluminum ramp, on the
other side a 12'x24' boat house with a 10,OOOIb lift is proposed. The floating dock will have handrails on the east and north
side to prevent dockage on those sides. The floating dock and the boatlift will have stops to prevent substrate disturbance.

Proposed construction of 575'x6' wide pier beginning at a new retaining wall on the waterward side of the property and leading
to a 14'x14' fixed dock with a 16'x16' roof, on one side of the fixed dock will be a 14'x14' floating dock accessed by a 4'x16'
aluminum walkway, the floating dock will have hand rails on north and east side to prevent dockage on those sides, on the
other side will be a 12'x24' boat house. The floating dock and the boatlift will include 4x6 stops to prevent disturbance of
substrate.
