Guidelines for Access: The staff of Wilmington Regional Office is dedicated to making public records in our custody readily
available to the public for review and copying. We also have the responsibility to the public to safeguard these records and to carry
out our day-to-day program obligations. Please read carefully the following guidelines signing the form:
Due to the large public demand for file access, we request that you call at least a day in advance to schedule an
appointment to review the files. Appointments will be scheduled between 9:00am and 3:00pm. Viewing time ends at
4:45pm. Anyone arriving without an appointment may view the files to the extent that time and staff supervision
is available.
You must specify files you want to review by facility name. The number of files that you may review at one time will
be limited to five.

$500.00. No briefcases, large totes, etc. are permitted in the file review area.

an offsite location at your expense. Large plan copies needed should be attached on top of the file. Allways Graphics

I went searching for these because no one seemed to have them. They were hidden in a stack near your
door. @ Anyway, I had a random call from XavierTondour who lives in the subdivision and was interested in getting a
copy of the permit for his HOA because they don't have it already. I explained to him that it looks like there is some
work to be done to work through some issues but that we would be back in touch with him when this eventually gets
resolved. (I explained that it may be a while, too. (9 ) 910.620.9070.

Our office is involved in litigation concerning a disputed beach access in old Hanby
Beach, North Carolina. In the process of researching that matter, we discovered a situation we
would like to bring to your attention and have you investigate. The matter is in regards to the
allowable built upon area of a lot in the Kure By the Sea subdivision.
The lot in question is lot number 22 which has a postal address of 830 Ft. Fischer
Boulevard North, Kure Beach, North Carolina 28449. Lot 22 is subject to "all of those rights,
easements, and obligations set forth in Declaration of Articles, Covenants, Conditions, and
Restrictions for PHASE I, KURE BY THE SEA." (Please see Exhibit A attached hereto.) This
includes those conditions and restrictions contained in the storm water permit for storm water
project number 890508. Lot 22 is restricted to a thirty percent (30%) built upon area or 4,007
square feet. However, the Certificate of Compliance for the house built on lot 22 is lacking in
significant data for the purposes of determining the true built upon area. (Please see Exhibit B
attached hereto.)
The Certificate of Compliance lacks the following information: 1) the total land area in
square feet; 2) the total square footage of impervious surfaces, which includes driveways,
porches, and sidewalks; and 3) a plot plan showing the exact structure location on the lot. The
Certificate of Compliance indicates that the total of impervious surface is not to exceed seventy
percent (70%) of the total square footage of the lot. This is in contradiction to the 30% allowable
built upon area required in the storm water permit for this specific lot. Furthermore, the attached

plot plan shows not the proposed structure but the lot itself and the pedestrian easement to the
beach. Thus a footprint of the house, driveways, porches, and sidewalks on lot 22 is lacking and,
therefore, the true percentage of the impervious surfaces existing on lot 22 in Kure By the Sea
cannot be calculated.
We are requesting that DENR conduct an investigation on lot 22 to determine whether it
meets the Storm water regulations as required by the permit issued for Kure By the Sea. More
specifically, does the house and other impevious surfaces exceed the 30% allowable built upon
area? We also ask that you send us a copy of the investigation, notes and any other relevant
documentation, including, but not limited to, notices of violation and other correspondence.
We appreciate your time and attention to this matter. I know you will agree that it is in
the public's best interest to see that Storm water regulations are followed and enforced. Should

Dear Mr. Wright:
I spoke to Dave Adkins concerning the types of materials suitable for construction of driveways
within the subject subdivision in order to reduce the built -upon area. The type of construction you
specifically inquired about was called turfstone. Unfortunately, this material cannot be used as a pervious
alternative to concrete. Over time, the material inside and under the pavers becomes impervious. The
only real and viable alternative is the use of 3' wide paved or. concrete wheel strips, or paving a driveway
that is only 10' wide vs. 25' wide. Because of the nature of a driveway, which endures long-term weight
and frequent wheel loads, even grassed driveways can become impervious over time.

I represent the N.C. Division of Environmental Management
(DEM). DEM administers and enforces the State's stormwater
program. Recently it has come to my attention that you represent
Mr. and Mrs. Tom Lund. In 1992 the Lunds received a Notice of
Violation (NOV) for problems associated with their residential
construction project at Kure by the Sea in New Hanover County. The
NOV was for violating the allowable "built -upon" area specified in
the deed restrictions applicable to Kure by the Sea. The deed
restrictions were based upon State stormwater regulations. NOV's
were also simultaneously sent to six other homeowners at Kure by
the Sea. These six other homeowners have since resolved their
violations. Unfortunately, your clients have been very reluctant
to rectify their violations.
On July 23, 1993, at the request of my clients, I wrote a
_letter.to the Lunds and other co -owners of the lot in question. A
copy of this letter is enclosed for your file. My purpose in
writing the letter was to review the history of the site and to
request that they immediately initiate action to resolve the
violation. Prior to the August 13, 1993 deadline set by my letter,
the Lunds and Neil Meissner met with myself and several individuals
from DEM regarding the site. At that time, options were discussed
which would resolve the problem. Your clients assured us that they
wanted to avoid DEM having to take enforcement action against them.
With my client's approval, I agreed not to immediately file any
type of enforcement action on the 13th and your clients indicated
that they would by that date or "shortly" thereafter, communicate
with us regarding their preferred method of resolution.
Since that time, no progress has been made on abating the
violations at Kure by the Sea and DEM is on the verge of
authorizing me to initiate enforcement action in the nature of an
injunction compelling compliance with the stormwater regulations.

While I realize that your clients feel that Thomas Wright is
responsible for their problems and that they have retained you to
explore his potential liability to them, DEM looks toward the lot
owners themselves as being responsible for correcting the problem
today. In your letter to Mr. Wright of August 23, 1993, you agree
that "the State's NOV is well founded." It is my `hope that perhaps
your conclusion will persuade your clients to resolve the violation
with DEM immediately then look toward contribution from Mr. Wright.
In light of the age of this case, DEM has little choice but to
initiate prompt enforcement action against the Lunds and other
co -owners in the event significant progress has not been made
within the very near future. Please assist me in resolving this
matter without DEM having to take enforcement action. I may be
reached at the above address at your convenience and I look forward
to an easy resolution to this problem.

Dear Mr. & Mrs. Lund:
I represent the N.C. Division of Environmental Management's
Water Quality Section. This Section administers and enforces the
State's .stormwater statute and regulations found at G.S.
§143-214.7 and 15A North Carolina Administrative Code 2H.1000 et.
seq.
On September 3, 1992, you and the co -owners listed below
(who will also receive a copy of this letter) were issued a
Notice of Violation (NOV) for exceeding the built -upon area
limitation specified in the recorded deed restrictions applicable
to your residence at lot 29 of Kure By the Sea. The owners of
seven other lots also received NOVs for non-compliance on their
lots but have since met with personnel from DEM's Wilmington
Regional Office and have resolved the violations. To date, the
only response from you has been a letter dated May 21, 1993
indicating that a survey had been completed "which indicated
approximately 280 square feet of impervious surfaces." DEM has
not received a copy of this survey. Additionally you stated an
intent to discuss your legal liability with an attorney.
On July 20, 1993, personnel from DEM's Wilmington Regional
Office inspected lot 29 to determine the extent of the impervious
coverage. Based on this survey and the resulting calculations
therefrom, your lot exceeds by 329 square feet, the area allowed
to be built upon.
Due to the lack of substantive response to the September
1992 NOV and an apparent unwillingness to voluntarily comply with
the State stormwater regulations, DEM has referred your case to
the Attorney General's Office for enforcement. It is generally
the policy of this office to advise violators that unless they
take immediate steps to comply with the law, enforcement action
will be initiated. . In this case, the enforcement action wiil

the primary purpose of this letter is to request.that you contact

As the developer -contractor, you determined the development
patio of Llat 29 regarding conciate area tau natural land
space. I realize that in using the Lund's residence as the
model in your brochure you thought their lot was in compliance
when in fact there was a mistake. The Lunds, et al, simply
want the error corrected. It is my suggestion that you develop
a plan in accordance with 3c of the restrictive covenants
to deal with. bringing the concrete-to-landY-surfaoe-ratio
of Lot 29 into DEM compliance as well as determine overall
devaluation of the development regarding all lot surface
alterations.
it is true as you stated at the bottom of page 2 of your
letter of September 18, 1992, that the advent of litigation
is likely. It is my opinion that any action (pursuant to
the NOV or the courts) involving the Lunds would result
in ultimate liability to you even if a subsequent legal
action were necessary. Although my clients are not poised
to demand damages for the decrease in market value of Lot
29 at this time, they do request that you rectify the surface
problem to the end that the whole matter is quickly concluded.
To facilitate this matter, 1 have directed my clients to
secure an estimate for the removal of the requisite amount
of concrete from Lot 29.
It is my hope that you will expedite your obligation to
my clients regarding the law and the covenants and thereby
avoid, for all parties, the necessity of litigation,
attorney's fees and protracted negotiations. Please contact
Mr. Lund immediately at 1213 Maury Court, Raleigh, North

be concluded within the DEM time frame..

I represent the N.C. Division of Environmental Management's
Water Quality Section. This Section administers and enforces the
State's stormwater statute and regulations found at G.S.
§143-214.7 and 15A North Carolina Administrative Code 2H.1000 et.
seq.
On September 3, 1992, you and the co -owners listed below
(who will also receive a copy of this letter) were issued a
Notice of Violation (NOV) for exceeding the built -upon area
limitation specified in the recorded deed restrictions applicable
to your residence at lot 29 of Kure By the Sea. The owners of
seven other lots also received NOVs for non-compliance on their
lots but have since met with personnel from DEM's Wilmington
Regional Office and have resolved the violations. To date, the
only response from you has been a letter dated May 21, 1993
indicating that a survey had been completed "which indicated
approximately 280 square feet of impervious surfaces." DEM has
not received a copy of this survey. Additionally you stated an
intent to discuss your legal liability with an attorney.
On July 20, 1993, personnel from DEM's Wilmington Regional
Office inspected lot 29 to determine the extent of the impervious
coverage. Based on this survey and the resulting calculations
therefrom, your lot exceeds by 329 square feet, the area allowed
to be built upon.
Due to the lack of substantive response to the September
1992 NOV and an apparent unwillingness to voluntarily comply with
the State stormwater regulations, DEM has referred your case to
the Attorney General's Office for enforcement. It is generally
the policy of this office to advise violators that unless they
take immediate steps to comply with the law, enforcement action
will be initiated. In this case, the enforcement action will

likely be in the nature of a complaint for injunctive relief to
compel comp3iance with the stormwater regulations. Accordingly,
the primary purpose of this letter is to request that you contact

Raleigh at (919)-733-5083 to seek an amiable resolution of this

This project has been under a Notice of Violation since September 3, 1992 for exceeding the built -
upon area limitation as specified in the recorded deed restrictions for both phases 1 and IA. A total of
eight lots were cited in the violation. In order to reslove the situation, the gazebo lot (#18) was restricted
to zero allowable built -upon area and the available 2,610 square feet from this lot was distributed among
the offending lots. In addition, seven of the lot owners met with Wilmington Regional Office Staff to seek
solutions by removing existing impervious areas (excessive driveways and stone patios). The net result
being that seven of the lot owners are now in compliance with one lot owned by Mr. and Mrs. Tom
Lund, Mr. Neil Meissner, and Mr. Bob Orkis, (Lot 29), refusing to cooperate. This Office sent a letter
dated March 8, 1993, and made several phone calls to our primary contacts, Mr. and Mrs. Lund,
advising that they were in violation of the built -upon area limitation, and they were urged to contact us
to discuss their options. The response to date has been a letter stating that a survey has been completed
(no copy received) showing that they are 250-300 square feet over, and they are consulting with a lawyer
concerning their liability in this matter, and will make a decision in the near future.. To date, no attempt
to schedule a meeting with personnel from the Wilmington Office to discuss the options available has
been made by any of the lot's owners.
On July 20, 1993, Regional Office Personnel inspected lot 29 to determine the extent of the
impervious coverage. Based on field measurements, there are 1,110 square feet of house covering the
ground and 1,370 square feet of concrete sidewalk and driveway, for a total of 2,480 square feet of
impervious surface. The deed restrictiogAr the subdivision allows a maximum of 2 square feet,
therefore, the overage is approximately W square feet. Since no copy of the survey has been received,
the Lund's numbers cannot be compared to the field measurements.

A few particulars concerning the approval of this subdivision: The projects for both phase 1 and
lA were received on May 12, 1989. Phase 1 deed restrictions were recorded May 26, 1989, and Phase
lA on April 14, 1989. Mr. T. D. Wright was issued Certifications of Compliance, Numbers 890508 for
Phase I and 890519 for Phase lA on June 21, 1989. A site inspection conducted on March 6, 1992
revealed the built -upon area violations. The first Notice of Violation was issued on September 3, 1992,
with followup Notices on October 2, 1992 to include Lot 67 in Phase II, and on October 27, 1992 to
verify the plan of action to bring the subdivision into compliance. Mr. Wright has been very cooperative
and has attended several meetings with WiRO staff to discuss options. This Office has received surveys
and/or drawings of seven of the eight offending lots and has judged them to be in compliance. Revised
deed restrictions were recorded on November 20, 1992, governing the new impervious area for each of
the eight lots.

On September 3, 1992, a Notice of Violation was sent to you concerning the project, Kure By

On September 3, 1992 a Notice of Violation was issued to Mr. Tom Wright for non-compliance
with the restrictive covenants limiting the allowable built -upon area at Kure by the Sea Subdivision. Eight
lots, including yours, were cited for exceeding the allowable built -upon area. Lot 29 is allowed a built -
upon area of 2,151 square feet. Seven of the homeowners have taken corrective action and are now in
compliance with the Stormwater Certification issued by this Office. Your lot is the only violator
remaining.
This Office may recommend revocation of the Stormwater Certification if action to correct the
exceedance of impervious surfaces on your Lot #.29 is not initiated in a timely manner. Once the
Certification is revoked, Kure by the Sea will be in violation of NCGS 143-215.6A (a)(2) because it will
not have all required permits and certifications. Failure to have all required permits and certifications may
also be grounds for the Building Inspector to withhold the Certificate of Occupancy for dwellings in the
development.
Please make arrangements to meet with personnel from this Office and/or Mr. Wright as soon as
possible. We will be happy to provide you with all available opportunities to arrive at a mutually
beneficial solution. Compliance will not necessarily demand a high expenditure on your part, however
doing nothing may cost more. We urge you to give this matter your immediate attention.

Per our telephone conversation earlier today, you have permission to construct a second story deck
on your home without adding to your existing impervious area total. The reasoning behind this is the
State feels that as long as the ground beneath the deck is pervious, (ie., sand, other decking) and allows
rain to filter through, then the impervious total of your lot is not affected. Generally, we go by the first
story footprint to determine impervious area, as well as any concrete walks, patios, etc.

put back 239 square feet of concrete in the form of four runners 2
feet wide. My net impervious coverage is now 2104 square feet, well
within the 2151 square feet of impervious coverage permitted for
lot #37 by the First Amendment To The Restrictive Covenants of Kure

The following information references the status of the
Notice of Violation issued to you for Kure by the Sea on
September 3, 1992 and October 2, 1992, regarding excess built
upon area on lots numbered 19, 20, 24, 27, 29, 37, 38, and 67.
Lots numbered 19 and 20 are considered by this Office to
have complied with a buildable allowance of 30% per lot. Surveys
and existing built upon square footage (of lots 19 and 20) have
been provided to this Office. Lot 67 may be considered in a
compliance status per receipt of revised restrictive covenants
which incorporate the gazebo lot (lot number 18) thus allocating
additional built upon square footage for lot 67.
The following is this Office's understanding of our
telephone conversation which took place on October 22, 1992:
Lot 24: following revised restrictive covenants incorporating
the gazebo lot (number 18), lot 24 remains in violation
of allowable built upon square footage by approximately
75 sf. The actual built upon area on this lot must be
reduced by approximately 75 sf. Options to meet
restrictive requirements by other means will be
considered by this Office.

Lot 29: is not attempting to meet buildable area restrictive
requirements. What is the action which you are taking
to effect this?
Lot 27 and 37:
following revised restrictive covenants incorporating
the gazebo lot (number 18), these lot owners have
agreed to remove concrete driveways and replace with
narrow strip pavers. The strip pavers are considered
by this Office as built upon material and thus will
need to be included as such upon a new survey of built
upon area.
Lot 38: following revised restrictive covenants incorporating
the gazebo lot (number 18) this lot will meet the
revised buildable allowance.
Please note, revised Deed Restrictions and documentation
(i.e surveys, etc.) remains needed for lots numbered 24, 27, 29.
37, 38, and 67. This information and your assessment of action
to be taken to obtain compliance for Lot 29 must be received by
this Office by November 6, 1992.

Please note that the survey indicates that the total area of

Pursuant to a copy of a letter received by Mrs. Lynn C.
Masterson, I enclose herein a copy of a Quitclaim Deed and survey
by Jack G. Stocks, which shows that the property and improvements
thereon owned by Lynn C. Masterson at .Lot 19, Phase 1.A, Kure By
The Sea are in compliance with the percentages allowed in the
restrictive covenants. According to the survey by Mr. Stocks,
the impervious area represents only 28.6.0 percent of the total
area of the lot. Mrs. Masterson is in compliance with both the
restrictions and the requirement of the Division of Environmental
Management of the State of North Carolina.

Dear Lot Owner,
I have enclosed for your review a copy of a letter I received
from the Division of Environmental Management of the State of
North Carolina dated September 3, 1992. I have also enclosed a
copy of the particular restrictive covenant referred to in the
letter and I have hi -lighted the applicable language in the re-
strictive covenants for Kure by the Sea, which have been violated
by the extent of building activities on your lot.
The State is requiring that we adopt a plan of action to per-
manently correct the violations prior to September 25, 1992.
There are several alternatives available to correct this
situation.
The first alternative would involve the removal or redesign
of the concrete driveways to reduce the amount of paved surface,
in some cases this would be insufficient.
The second alternative would be to increase the size of the
lot. According to the enforcement personnel it is not necessary
for our purposes that the additional land acquired to increase the
size of your lot be adjacent to or contiguous to your lot.
The second alternative may prove to be the best approach and
to that end I have been authorized to make the following offer:
(i) The allowable building area currently allocated to the
Gazebo Lot (Lot 18) would be transferred to and allocated prorata
among the 69 lots in the subdivision West of US Hwy 421, which be-
longs to the homeowners association.
(ii) I will transfer additional square footage from each of
the unsold lots (53) to the five (5) lots on the West side of US
Hwy 421 that will give those lots an increase of 441 square feet
each. This will give each of those lots a coverage area of 2127
square feet.

above lot owners to provide the additional land in the subdivision

The above prices reflect an approximate 20% discount from the
existing price list for the three lots in question. The above
costs could be reduced significantly if this plan were paired with
a plan to remove a significant portion of the concrete parking and
driveway (paved) portion of the offending lots.
There are other alternatives including litigation which need
to be discussed and explored thoroughly. I would like to have the
opportunity to meet with all of you as soon as possible to discuss
and plan the best way for us to deal with this problem.

Stormwater Regulations, Number 890508, was issued to you for Kure
by the Sea, Phase 1, located in New Hanover County at Kure Beach,
North Carolina. That Certification was based in part on
restrictive covenants which limited the build upon area within
the project.
On March 6, 1992, an on -site inspection was conducted at
Kure by the Sea in response to a report that density restrictions
had been exceeded on all lots built as of April 24, 1992. The

Stormwater Regulations were also discussed during the meeting.
This letter is written in response to the on -going nature of

location, height and orientation of such building or structure,
drives, parking areas and.. proposed alterations to the grade,
elevation or physical characteristics of the site), and
construction schedule shall have been approved in writing by the
Company. Refusal of approval of any such plans, location or
specifications may be' based by the Company upon any grounds
including purely aesthetic and environmental considerations, that
in the sole and uncontrolled discretion of the Company shall seem
sufficient. Without the prior written consent of the Company, no
changes or deviations in or from such plans or specifications as
approved shall be made. No alterations in the exterior appearance
of any building or structure, or in the grade, elevation, or
physical characteristics of any lot shall be made without like
approval by the Company. One (1) copy of all plans and related
data shall be furnished to the Company for its records. The
Company shall not be responsible for any structural or other
defects in plans or specifications submitted to it or in any
structure erected according to such plans and specifications.
No more than 1686 square feet of any lot shall be covered by
structures and/or paved surfaces, including walkways or patios of
brick, stone, slate or similar materials. This covenant is
intended to insure continued compliance with stormwater runoff
rules adopted by the State of North Carolina and therefore this
provision may be enforced by the State of North Carolina through
its duly authorized agencies.
5. APPROVAL OF PLANS. (a) No house plans will be approved
unless the proposed house will have the minimum required square
footage of enclosed dwelling area. The term "enclosed dwelling
area" as used in the minimum size requirements shall mean the
total enclosed area within a dwelling; provided, however,' that
such term does not include garages, terraces, decks, open porches,
and like areas. The minimum enclosed dwelling area shall be 1200
square feet.
(b) KURE BY THE SEA BUILDING SETBACK GUIDELINE REQUIREMENTS.
Since the establishment of standard inflexible building setback
lines for location of houses on lots tends to force construction
of houses both directly behind and directly to the side of other

On June 21, 1989, a Certification of Compliance with
Stormwater Regulations, Number 890508, was issued to you for Kure
by the Sea, Phase 1, located in New Hanover County at Kure Beach,
North Carolina. That Certification was based in part on
restrictive covenants which limited the build upon area within
the project.
On March 6, 1992, an on -site inspection was conducted at
Kure by the Sea in response to a report that density restrictions
had. been exceeded on all lots built as of April 24, 1992. The
actual built.upon square footage as reported by the project
engineer, Mr. Carl Farmer of Henry Von Oesen and Associates, is
as follows:

Options which would result in Kure by the Sea being returned to
compliance with the Division of Environmental Management's
Stormwater Regulations were also discussed during the meeting.
This letter is written in response to the on -going nature of
these violations. Failure to provide a plan of action or
permanently correct the violations prior to September 25, 1992
will result in initiation of appropriate enforcement action by
this Office. The action may include a recommendation that the
Stormwater Certification be revoked and a recommendation for the
assessment of civil penalties.

On behalf of the General Partner, Mr. Thomas D. Wright, we have reviewed
the density requirement status of the above subdivision in order to bring the
project into compliance. The following information is provid-.d:
I. Phase 1A (Oceanfront Lots)
A. Adjusted area of Lots 14, 15, 16, 17, 19, 20, and 21 is 60,898 s.f. ✓
allowable.
B. Allowable built -upon area = 18,269.40 s.f. or 2,610 s.f. per lot. ✓
C. Breakdown of built -upon area (see Attachment No. 1) of lots 19 and
20 indicate that these two owners need to reduce driveways by 277 s.f.
and 459.5 s.f., respectively.
D. Copy of recorded covenant is attached for these lots.
II. Phases I and IIA
A. The calculated allowance for Phase I was 11,686 s.f.
B. Taking the entire tract (Phases I, IIA, IIB, and III plus Lot 18
(common area for these phases)) gives a total of 521,720 s.f.
C. The allowable built -upon area=156,516 s.f. Subtracting streets
constructed and proposed = 108,280 s.f. This gives an adjusted
built -upon area of 1,569 s.f/lot for 69 lots.
D. The detailed breakdown of the individual lots which have been built
on in Phases I and IIA is shown on Attachment This breakdown
shows all owners have over -built from the "Coed covenant amount.

E. Kure By The Sea Limited Partnership are developers of the lots only.
The individual lot owner built the houses which are not in compliance
with the recorded covenants.
Mr. Wright suggests the following steps to bring Phases I and IIA into
compliance:
1. Require each of the owners who have over -built to install an engineered
infiltration system to handle the excess built -upon area.
2. Set out an adjusted built -upon area of 1,569 s.f./lot for the remaining lots
which have not been built on. Record an addendum to the restrictive
covenant for this and inform owners of sold lots.
3. If the approach of Item 1 is not acceptable, require the owners to reduce
the amount of built -upon area, mainly by reducing concrete drives to drive
strips or as an alternative, provide "deck style" timber drives or walkways.
We will follow-up with a revised application for Phases I and IIA together
upon your response.
